' I cannot premise ie be present at your
trial because I have ether engagements
which are likely te make it impossible I
must thorcfiue decline any tender of fees
which would bind me te act as your oeun-t-cl.

law, which, though interesting, ate easily

" Any number of employers may com
bine together and act in concert te n diKO
the wages of their workmen, and nobody
has ever called that a conspiracy ; bat if
the bberers in a shop unite te increase
their wages and threaten te jiiit uulsws
they are better paid, this, according te the
old decisions in England and Aur.i.cu, is
a criminal offcuse.
' More recent cases, however, lay down
the rule that a body of labuieis may as
lawfully say what th.-y will lake as em
ployers may determine what they will give.
Somewhat slowly, and with evident re
luctance, capitalists iiave sulfeied the
judicial mind te reach the conclusion
thai the employer does net exactly own
the workmen. If, therefore, the aim of
your asociatieu was nothing wei.-.c than te
put up the price of your labor te a satis
factory standard and te counteract the
natural tendency of ether iiiti-rc.-t.s te re
duce it, you are innocent pr.eileand the
court will say se.
' I infer from your letter that you solic
ited ethers te join with you and make a
demand for wages as high as your own, or
else step work. That was net wrong
either. If you had a right te form the
association, you had an equal riht te get
as many into it as you could, se that out
siders might net defeat its purpose by
cutting under, but you did net confine
your membership or your influence te
your immediate fellows working together
with you in the employment of the same
master. Yeu went te another niiue owned
by ether parties and peri-traded or tried te
pcrsuadn the underpaid coal diggers there
that justice te themselves, as te you, re
quired them te lay down their tools unless
they get the rates generally received in
the neighborhood. At first blush
this leeks like intermeddling with a mat
ter which did net concern you ; but in
truth you had a fair interest in it, because
the acceptance of smaller compensation by
one always tends te depress that of an
other. Your re-dstaueote low wages was,
no doubt, weakened by tee submission of
ethers near you. 1 ins principle is un
derstood by employees. If Scott and
Garrett and .leu oil would agree te reduce
the wages of the laborers en their railroad

ings. In addition te these charges of
conspiracy and riot you arc accused, as 1
understand, of bribery. The miucis whom
you were trying te convert te your way of
thinking, had agreed that they would for
feit $10 apiece if they did net work a full
year at the rate of wages previously agreed
upon between them and their employers.
This penalty of accepting your doctrine,
and acting upon it, they could net pay
without assistance. Your association
offered te give them the necessary material
aid. This does riot come within any com
mon law or statutory definition of bribery
that I knew of.
" I may have misconceived this wh.de

the facts as I gather them from your

proximately correct as a general outline,
you are certainly iu no danger of even
