Judge ISutler Renders an Opineu Against tiie Reading Ceal Company. Philadelphia, May. 5. An opinion was rendered by Judge Iiutlcr this morn ing in tbc United States district court in an admiralty suit brought by the owners of the schooner .Tese.h and Franklin, against the Philadelphia & Heading coal und iron company's steam Colliery Potts Petts villc. A collision occurred between these vessels early en the morningef June'.), 1881, in the Delaware river, the schooner being sunk. The libellauts set forth that the steamer was tunning at a high rate of speed and that she had en the lookout a sixteen-year-old boy of only five weeks' experience. The respondents contended that there was a Heavy leg at tne tunc and the schooner gave no signal. The judge's opinion was in favor of the libel ants, with costs. The examina tion of Senater Blair was resumed this morning. Representative Blount con ducted the examination. Witness re fused te say what amount of stock had been tendered him by Shipherd as an in ducement te act as counsel. It was un derstood he was te act as counsel for him, but no amount was fixed. " Blaine un derstood that I appeared at the state department as counsel. He knew that I was desirous of aiding 3Ir. Shipherd. I asked the secrctrry if from his knowledge of the affair there could be any impro priety of my acting as ceunsel, and he said he could see none. This was befere this interview with Shipherd. Xe ene intimated te me that there was any im propriety of my being connected with the cempauy until this investigation began. i never concealed my connection. I should de the same thing ever with the same light. I have no apology te offer here or elsewhere." Witness said he never regarded it r.s of any value unless the agreement with Pen; nart been carried out ; that is te say, si' the company had been organized and the money raised it would have been a wealth v and powerful company. Witness was questioned in reference te the opinion of General Grant upon the claims and replied that he knew nothing of Grant's opinions in this relation that he (Blair) did net consider highly honorable te him. Some discussion ensued as te witness being made te answer direct from what source he derived his knowledge of Grant's opinion, and Mr. Blount said: "If the name of General Grant and the influence of the government has been brought te bear te induce the payment by Chili of twelve hundred millions of dollars, I thin!: it pertinent that the mimes of all parties interested should be known." Witness then stated that he had per sonal communication from Shipherd aud documentary evidence relative te General Grant's views. In reference te witness' privilege as counsel in declinibg te answer questions, Mr. Blount thought the com mittce had a right te a view of their own, and did net believe that a scheme, such as Shipherd's, hich might have involved this country in a war with Seuth America, should be covered up by any such protec tion as the privileges of counsel. Witness then said his knowledge of General Grant's views was derived from Shiphcrd's statement te him exclusively with the one exception or General Grant s endorsement upon a draft of instructions te be sent te Minister llmlbut. Being questioned upon the words " Geed efiices," witness said he did net care te be questioned upon specific words. Witness did net knew who prepared the papers Shipherd sent him (Blair), a copy of which he (Blair) showed te Mr. Blaine The latter declined, however, te make any use of them cr de mere thau he had indi cated in his instructions already given. In further leply te Representative Blount witness said he did net care te say that Mr. Shipherd had wilfully misrepre sented him. The committee had seen mere of Mr. Shipherd thau he (Blair) had and could judge of him and the character of his mind. Se far as his (Blair's) ex pression! were concerned he had been misrepresented. He (witness) had never put things in se strong a light as Mr. Shiphenl's very hopeful natnre has pre bably conceived. Mr. Blount then quoted freniShipherd's testimony that the subject of bribing Hurlbut had been mentioned in Mr. Blaine's presence and the remark of Mr. Blaine's, "I don't think that will fetch him." Witness did net hear any such conversation. ' Blount then read a letter written le Mr. Arzela and asked witness if he understood that te correctly state the attitude of the country and if it were net a gross misrep resentatieu of the state department. Witness was net prepared te define it as an outrage, for he was net here te abuue a man who had once been his client. Witness in reply te another quasi ion said he would iiavc considered it his high est duty as a senator if he had seen that the state department was being grossly misrepresented te step in and in tervene, but he could net see hew, inasmuch as this letter pass ed through the hands of the Ameri can minister, who was en the spot and armed with his instructions and harm could come of it or any misrepresen tation of the state department could be made, no matter what Mr. Shipherd might write. Witness was then questioned relative te the Landrcau and Cecket claims which he explained at length and stated that he believed in the justice of the Ceehct claim, net as te the amount but he believed there was jus tice at the bottom of it. The hearing was then adjourned until te morrow. MURDER OP A PEDDLER. What Seme Farm Hands Pound While bolus te Werk This Morning. Pla infield, X. J.. 3Iay 5. At about 7 e clock this morning some farm hands going te their werkjsaw lyine in a piece of wuuuiauu wuuiu a rea or the read, the dead body of a man with the head half severed from the body. A basket of tin ware steed about a red away from the body with the contents undisturbed. The body was still warm. The mau was identified as one of a couple of tin peddlers who had been seen in the neighborhood the night befere. Ilis compauieu was missing, but a tramp who had been seen iu the neighborhood an hourbefeio the discovery, was followed te the NethcrwoecT depot, a mile from thesccne of the murder and arrested. He was searched and small stains like bleed wero feuud upon some clothing in his pack, and upon a razor, no admitted having been iu the neighborhood during the morning, but deuied all knowledge of the murder. He was locked up and will be held until an inquest takes place. The dead roan was of medium height, light build, black curly hair aud aged about 20. There were no marks of a struggle around where he lay, and he is supposed te have been murdered as he slept. The man arrested is a German tramp and gives his name as August Schlachley.
