lawyer who makes any pretence te a knowl
edge of criminal law, while its absuulity
from a common sense point of view will-be
recognized by all sensible persons. The
theei y that Masen cannot be tx icd for as
sault with intent te kill because Guiteau
happened te be out of bullet range when
the shot was fired i as centiary te receg-
nized principles of eiiininal practice as it
is against common reason. Its lecogui lecegui lecogui
tien would lead te some novel lcsults. On
the same principle no man could be charg
ed with a murderous intent if his victim
was found te have en a coat of mail, or if
the pregiehs of the bullet was stayed by a
book luckily in the pocket, or if the wea
pon used was net leaded with powder
enough te de the deadly work. Xe per
son could be indicted for an attempt te
kill by poison if I12 administeicu a dose
tee Mnall or tee large te cause death. Ne
one could be held guilty of an attempt te
pick a pocket when the pocket happened
te be empty, or of an attempt te commit
rebbeiy when it was found that theie was
nothing te steal.
But these subterfuges lmvcbeen biu-hed
aside by the courts which have sustained
crimiual indictments for attempted crimes
in a scoie of cases like the above and
ethers analageus te that of Masen. It is
a gcncial rule recognized both in Amcii
can aud English ceuits that when a man
intends te commit a csimc and makes the
eflbit with what appeals te him te be ade
quate means, le may be indicted and pun
ished for the attempt, although, for some
reason unknown te him, the accomplish
ment of his criminal purperc is imnossi imnessi imnossi
ble. "Wheie the ciiminal lesult is net
accomplished," says Bishop, " simply be
cause of obstructions in the way or be
cause of the want of the thing te be oper
ated upon, when the imppffisbcnt is of a
nature te be unknown te t!e offender,
who used what seemed te be appropiiate
means, the criminal attempt is committed."
The same principle has been clcaily stated
by Judge Giay, new a justice of the
United States supicme court, in tltcae
words : " Vriiencvci' the law makes one
step tewaul the accomplishment of an un
lawful object with the intent or purpesj
of accomplishing it criminal, a person
taking that step with that intent or ptu ptu
pesc, and himself capable of doing every
act en his part te accomplish that object,
cannot protect himself from lcspensibility
by showing that by leasen of some tact
unknown te him at the time of his erim
inal attempt, it could net be fully can icd
into effect in the particular instance."
Ne question has ever been laised or
doubt entertained that Masen fully intend
ed te kill Guiteau. Masen fcven beasts in
the most profane language that he did in
tend and try te sheet him. He bad ovey
reason te believe that his crimiual purpose
might prove successful. He knew that
Guiteau was iu the habit of .standing at
the window of his cell and he fired at that
spot. He did all in his power te kill his
intended victim, and failed only because
Guiteau liappencd te be lying down, a,
fact of which the offender had neither any
knowledge or suspicion. Te held that
Masen was illegally convicted and sen
tenced en the ground that it was impossi
ble, te kill Guiteau under- these circum
stances is te misconceive or misieprcscnt
the main fact in the ca-e and te show a"
striking ignorance of or disiegaul for the
law governing it. It is net a act that
Masen could net possibly 'hurt, Guiteau,
for the ball might have glanced :nd killed
him. ' But even if the victim was safe
from all harm, Mr.seu as none the less
guilty in law of tdioeting with intent te
kill. . ..

makes te give it the appearance of sound

If Masen has bceu illegally coin ictcd
let his sentence be set aside. If he is
guilty of no offence or jueiits no puui-Ji-ment
for having tried, te kill a prisenci
whom he was trusted te guard let him be
paidened. But let net ridicule be brought
upon our criminal procedure by setting
aside the results of the trial already had
and possibly picvcntiuga new one by the
civil authorities through mcliicct auu
illegal means. If there is any icasonable
doubt that such will be the effect of adopt
ing the recommendation made by General
Swaim let the opinion of the attorney
general be taken en the Icjal question in
