ABUSES FROM MONOPOLIES.
Liability or Railroads for Discrimination In
Freight OhvN
la the case of Jehn flays & Ce., against
the Pennsylvania railroad company which
was tried at Cleveland last week, Judge
Baxter delivered a very important and in
teresting charge te the jury. The case
was one brought by the plaintiff, who was
formerly a large wholesale coal dealer of
Cleveland, against the railroad company
for $100,000 damages, en account of nn
just discriminations in freight charges,
the plaintiff claiming that lower rates of
freight were charged the Ohie and Penn
sylvania coal company for bringing coal
te Cleveland than was charged the plain
tiff for transporting coal ever the Cleve
land and Pittsburgh railroad, from the
Carben Ridge and ether mines in Somer Semer
villc, O., te Cleveland, and, also, that deck
privileges granted te ether shippers were
refused te the plaintiff, although he was
equally entitled te them. These discrim
inations were alleged te have occurred be
tween April, 1871 and September 1879.

After reciting the claims of the plaintiff's
petition that the railroad was the plain
tiff's only means of transportation, and
that the discriminations destroyed the
business of the latter, the charge is as
follews: " The defendant interposes two
defenses. It denies the facts as stated te
be true, and claims that' the action is
barred by the statute of limitations. These
defenses present questions of fact te be
determined by you. But as a correct ap
preciation of the rights and duties of rail
road carriers may aid you in the discharge
of the duty which the law imposes upon
yen of correctly deciding upon the facts, a
lew gcneial observations touching the mat
ter will net, I tiust, be considered as inap inap
prepiiate. Railroads are quasi-public high
ways. If the Legislature of your state wefe
te enact a statuta purporting, en any
pretext whatever, te autherize one or
mere persons, either with or without com
pensation, te take private property and
appropriate the same te his or her private
use, the courts would, under the responsi
bilities imposed upon them by the consti
tution, be bound te declare the statute
unconstitutional and void. It is only upon
the'hypethesis that railroads are quasi
public highways that the Legislature can
constitutionally invest them with author
ity te condemn private property te their
use. And being such highway, every in
dividual constituting a part of the public,
for whom railroads are constructed, pos
sesses the right te equal facilities and
accommodations in their use. If the law
were otherwise, as you cau readily see,
the business interests of individuals and
communities would, be, te a greater or less
extent, dependent en the favor of rail
road officials. If a railroad corpor
ation could, with impunity, carry
the same class of freight ever
the sitme read, and between the
same points, for one man, or class of men,
at a .'.'s rate than they exact from ether
and competing interests; if they could
Uv.iully require ene man te pay fil teen
eeni-s per bushel for the transportation of
wheat from Cleveland te New Yerk, while
they did the same service for another and
i ival merchant for ten cents; or bring hither
merchandise for certain favorite firms and
refuse te carry for ethers, they qeu!d
niak and unmake the fortunes of whom
seeer they chose. Railroads, whose ca
pacities for geed and evil were net fully
comprehended a quarter of a century age,
are new regarded as essential te the rapid
development and prosperity of the country.
Ne one can at this time successfully com
pete in manufacturing, mining, .or in com
mercial pursuits, without the use of rail
roads. They have pretty much superseded
any ether means of inland transportation,
and if their manipulators are authorized
for any reason, sinister or otherwise, te
invidiously discriminate against one man
or community in behalf of ether and rival
interests, they would be in possession of a
power which, skillfully exerted, would
demoralize trade and extinguish honest
competition te the impoverishment of
these they dislike and the enrichment of
their favorites. And if, by chance, selfish
aud ambitious men should ever acquire
control of any considerable number of
competing reads, they could, by disfavor
ing the refractory and rewarding the
obsequious, largely influence both busi
ness and public sentiment within the
radius of their influence, and thus increase
their individual fortunes and strengthen
their power.
I am glad te be able te say, gentlemen,
that railroad corporations are invested
with no such dangerous power. Their
officers are, in a qualified sense, tiustecs
for the public as well as the shareholders,
and are in law, as well as in morals,
bound te execute the trust imposed upon
them by tHcir charters, se as te secure te
everyone applying therefer equal facilities
in the use of their reads, and upon the
same terms. Yeu are te decide in this
case whether there has been any discrim
inations made against this plaintiff.
It is conceded that the schedule
freight rates for 1876 from Salinc
ville te Cleveland were $1.60 per
ten for the first 8,000 tens shipped,
thirty cents less en the next 8,000 tens',
forty cents less en the third 8,000 tens,
fifty cents less en the fourth 8,090 tens aud
sixty cents less en the fifth 8,000 tens, and
en all coal in excess of the last amount
transported for any one man or firm. The
effect of this rebate was te .give te the
heaviest shipper better rates than ship
pers of less amount enjoyed. Is Buch a
discrimination authorized by law? I
wholly dissent from the preposition that it
is. If such a rebate is authorized in ship
ping coal, it is in transporting wheat or
anything else transported in large quanti
ties. The effect of such a policy would be
te add te the 'strong and crush out the
weak. If you find higher rates had te be
paid by the plaintiffs' than were exacted
from ethers, such a discrimination is
wrong te the plaintiffs, and they are en
titled te reclaimwhat they overpaid, with
interest."
After briefly referring te the claim that
the plaintiff's business had also been in
jured by the less of the deck privileges,
aud stating that all customers were en
titled te equal chances for using the
deck, the plaintiff having as much right te
it as any one else, Judge Baxter cencluded:
" The plaintiffs state that their business
was ruined by the discriminations aud
ask for damages en that account. At the
begiaiugef the trial I declined te enter
into an examination of that injury.
These would come under the head of
speculation damages, and have neplace
here. Courts refuse in this form of an action
te inquire into and determine this ques
tien. The plaintiff had a remedy ferthesel
uainages at we ume. no coma nave paia
the high rates and then recovered back the
overcharge by suit, or he could by an action
in this court have compelled the defend
ant te extend te him the same privileges
that ethers had. Although the overcharge
may have been the legitimate eaase of
failure, that branch of the subject is new
withheld front your consideration. There
