Secretary hkeraan's Fraud.

The result of the trial of the test case
between the sugar importers and tbe trea
sury department hIiews conclusively that
it was Secretary Sherman, instead of our
merchants, who was jruilty of fraud. The
United States circuit judge, doing all that
he conscientiously could in behalf of the
collector, who was the nominal defendant,
was compelled te declare that the govern
ment had net presented a particle of evi
dence in defense of its claim, and he there
fore decided the case in favor of the im
porter without even submitting it te the
JU'.V-
The whole course of the department in
reference te the sugar duties has been an
outrage from the very beginning. After
being defeated at Baltimore. Secretary
Sherman tried te iudnce Congress te
change the law ; and when this was re
fused, he ordered the collectors te levy
upon the sugar importations tne uuues
which Congress had declined te impose.
These exactions were paid under pi otest,
and the importers brought suit for the re
turn el the illegal collections. The first
of these suits brought by Messis. Knowl Knewl Knowl
ten & Ce., against the collector was de
layed in every pessible way, until at last
the patience of the jadge was exhausted,
aud some months age he appointed a day
for the trial. On the pretense that they
were net yet ready te show up the fraud,
the ellicials who acted at Sherman's dicta
tion withdrew their defense te Kuowlten's
suit, aud the collector was thus compelled
te refund te this house the money of which
they had been rebbed.
The case of Messrs. S. & W. Welsh, de-
cided yesterday, was held by Secretary
Sherman as the strongest of the multitude
depending en the issue, and all that the
resources of the United States could sup
ply by the use of money and official iuflu
ence was cast into the scale te vindicate
Secretary Sherman's infamous policy.
Aud we see the result ! There was net
eneugli presented te the court te make
even a question for the jury, and this
leaves Mr. Sherman without se much as
the ghost of a pica te sustain him in
his warfare upon a great commercial in
terest. All who have been the victims of the
late secretary's attempt te enact and en
force a new tariff by the illegal exercise
of his ewu atbitrary will, ought te have a
remedy against the real culprit. Secretary,
new Senater, Sherman, ought te be com
pelled te pay the cast and damage of this
whole proceeding out of his own private
purse. Of course this cannot be done, and
nothing we suppess but taxed costs can be
recovered of the collector. We iufer from
the tone of Judge Wallace that he must
feel indignant at the attempt se frequently
made during the trial te induce the court
te become a party te the injustice ; and he
cannot of course grant the certificate that
would save the collector from the costs of
the litigation.
Seme of our readers who are net famil
iar with the history of these wrongs, may
have been a little surprised at the positive
language we have se often used concern
ing them. We point te the story of this
trial for our cemplete vindication. If a
judge of the United States circuit court,
eminent for talent and judicial dignity,
could say as Judge Wallace did, alter the
government had exhausted all its resources
te meet the claim : "In all my experience
I have never known a case that was tried
mere unprofessieually than this one," we
may be sure there can be but one opinion
among decent men in regard te the nature
of the exaction that had se little te sup
port it. Governer Woodferd (the United
States district attorney) made the best de
fense he could, but Judge Wallace is re
ported as saying that " the defendant's
counsel throughout this case had pre
sented a false issue, and he could net sit
there and allow that te be dene."
The fact is that nothing but Secretary
Sherman's arbitrary will is behind the
whole oppressive proceeding. There is
nothing whatever in law or in equity te
sustain the course of the collector in going
behind the color of the sugar ou which the
law levies the duty, and attempting te
exact a new rate according te the quantity
of saccharine matter contained iu it. The
government could net produce an iota of
evidence that the color of the sugar had
been chauged alter its manufacture, for
no such change had in fact been attempt
ed ; and the whole charge falls helplessly
te the geund, leaving Secretary Sherman
in the character-of a despotic oppressor
who attempted te blackmail or rob his
fellow citizens.
