SUIT FOR FEES.
The City vs. the County of Lancaster.
Before Alderman Spurrier yesterday
afternoon was heard the case of the city of
Tirattr vs tlm ceuntv of Lancaster for
the recovery of certain fees for hearing Had
bv the mayor of cas
ses ei vagrancy, umw-
derlv conduct and drunkenness.
As is
eenerally known all fees received
by the
mayor are paiu ey mm into uiu city ucta-
ury for the benefit of the city. In making
out his bills against the county he made
them out for lull fees. The county com
missioners resisted payment, claiming that
the city was only entitled te half
fees in committed cases and no fees
at all in dismissed cases. The act
of Assembly of 18G9 provides that the
mayor shall receive only half fees for hear
ing drunken and disorderly cases when
commitments were made and no fees at all
when the cases weic dismissed. The act
of 1874 provides that all fees pertaining
te the office of mayor of Lancaster shall be
paid into the city treasurer for the use of the
city. Alderman Spurrier holds that the act
of 1874 neither increases nor diminishes the
fees, and that therefore the act of 1S08 is
in force and the city can claim no mere
fees than the mayor could if he received
them for his own benefit. In cases of dis
orderly conduct the act of 18C8 makes fees
for mayor or alderman eJ cents ler an
cases whether committed or dismissed.
Alderman Spurrier holds that the act of
18C9 does net repeal the act of 18G8 se far as
it relates te disorderly cascs, and the mayor
is entitled te receive for the use of the city
50 cents for each c.ise heard, whether he
commits or dismisses the offender. In
casts of vagrancy the mayor holds that
under the act of 187(5 and its supplements
and amendments p:issed in 1878 and 1879,
the mayor is entitled te receive for the use
of the city 25 cents for each ease heard
whether discharged or committed. He
gave judgment therefore in favor of the
city for $24.45, the amount of fees due
under this construction of the law.

Before Alderman Ban- last evening was
heard the case of Corener Mishlcr against
Cenrad Sauber, who was charged with re.
sisting the coroner while in the discharge
of his official duties. It appeared that

Chas. A. Hitz (mere generally known as
Chas. A. Kline), who was reported te have
died suddenly, te inquire into the circum
stances attending his death. Sauber reach
ed the house just as the coroner did, went
inside, and, as the coroner alleged, locked
the deer after him, preventing the coroner
from getting in. Sauber denied leckina
the deer, and there was evidence te show
that it was locked by the woman in the
house. Sauber was thereupon discharged.
