OTEKFLOWUFTHE RESERVOIR.
The Result or JUUdWM Mischief.
This morning about 2 o'clock Geerge
Mowery, who lives en East Orange street,
near the reservoirs, discovered that the
west reservoir was full and overflowing.
He at once notified Constable Cramer,
who in turn notified Superintendent Kitch,
and that officer sent a fleet messenger te
t-ie water works te have the pumps
stepped.
The overflow was ever the north wall of
the basiu. It did no damage te the inside
wall nor te the footway en top of the em
bankment, but several cartloads of sod
and earth are washed away from the
Orange htrect slope.
The accident was caused by the break
ing of the wires of the electric bell con
necting the reservoir with the water works
en the Conestoga. This bell is in the en
gine room of the water works and is se
connected that whenever the reservoir is
as full as it is safe te lyivc it, it sounds
an alarm and centiuues te ring until
the water has fallen sufficiently te
bieak the electric current. As long as the
bell docs net ring, the engineer continues
te work the pumps. When it rings he steps
one or mere of the pumps as may be ne
cessary te reduce the height of the water,
always keeping the water at or a little be
low the ringing point.
An examination of the bell and its con
nections leaves no doubt that they were
maliciously tamered with for the purpose
probably of injuring the reserveirs and
bringing discredit en the officers in charge
of the water works. On several previous
occasions the electric bell has been se much
injured that it would net work. Only last
Sunday the large ice-house en the reser
voir grounds was burned down. On Mon
day the privy was set en fire and burned,
together with several panels of fence. On
several occasions the stakes driven in
the bottom of the cast reserveir (new
undergoing repairs) as a guide te the
workmen in levelling the bottom, have
been pulled out or driven in tee deeply,
thus rendering them useless, while bar
rows and ether tools have been injured or
destroyed, and various ether acts of van
dalism have been perpetrated in and about
the reservoir. One of the prison watch
men says that while en duty last night he
saw men either wading or swimming in the
reservoir net far from the electric bell.
These several acts prove that some one or
mere perseus arc engaged in them and
that they are actuated by malice or revenge
which they held against the present offi
cials. It is a question whether both econ
omy and the safety of the rcicrveirs de net
demand the employment of a night watch
man te guard them.
As long age as last April Mayer "Mac "Mac
Oenigle proposed that a waste pipe
be laid, leading from near the surface of
the cast basin te the Groffhtewn read,
se as te carry off the surplus water in case
the rcseveir should fietn any case become
tee full ; and te have the east and west
rscveirs connected by a pipe near the top
of the wall which separates them. This
improvement was sanctioned by councils,
and will be added as seen as the repairs
new being made shall be finished.
Wlien " tli; Fourth " Palls en Sumlny.
The Fourth of July this year falls en
Sunday, a happening that will net lepeat
itself again until 181)7. The Fourth only ec
curs en Sunday when the Dominical or Sun
day letter for July happens te be C, which
takes place en the second, eighth, thir
teenth and nineteenth jears of each solar
cycle. This cycle is a period of twenty
eight years, during which the days of the
month of each year return te the same
days of the v eck as in a corresponding
year of a pieeeding cycle, and the same
connection is observed between the
ehauges of the day of the week in passing
from one vcar te the next. It
is tiuc that the same day
of the month falls en the
same day of the week four times
during this cycle, but the same regular
session is net preserved in the intervening
yeais. Hence the entire period of twenty
eight years is required te regulate the cal
cidar. A new cycle commences in 180G,
and the Fourth of July falls en Sunday in
1807, 190:5, 1908 and 1814.
A ICA1HUT CASE.
Prosecutor Locked Up and Defendants Dis
charged. Seme weeks age L. B. Clark, of Martic,
made complaint against Jeseph Rankin
and Eli "Warfel, of Martic, and Frank
Jenes, of Columbia, charging them with
violating the game laws by hunting rab
bits with a ferret and hunting en Sunday.
Te-day the case was heard before Alder
man Spurrier. Several witnesses were ex
amined, but none of than 'gave any testi
mony against the defendants, who were
thereupon discharged. The prosecutor was
net present, but was seen afterwards pick
ed up very drunk in an alley by Officer
Titus who took him te the lockup te await
a hearing for drunken and disorderly con
duct.
A Little Mere Census.
The enumerators of Earl township have
made their returns. The population is set
down at 3,5-12. In 1870 it was 2,975 in
crease 507.
Strasburg township is returned at
2,011. In 1870 it was 18C4 increase 147.
Our figures for Ceney, yesterday
(3.121), were about 1,000 te high the
enumerator made it 3,121, but the revision
of his book will reduce the figures a little,
perhaps te 2,100. In 1870 the population
was 1984. There has been a slight in
crease in the township, but a decided
decrease iu the village of Bainbridgc the
population of which in 1870 was 7G2, and
is new only CC8.
Lett His Discharge Uchind.
Gee. Bleiner, an old soldier, who draws
a iensien, left his discharge lying in the
prolhenotary's office, a few days age, while
arranging his pension papers. It was
taken iu charge by the clerks of the office,
who are holding it for the owner.
Legs Amputated.
Charles Glenn, the conductor who was
injured at Harrisburg yesterday morning,
had both legs amputated below the knees
after being taken te the hospital. He was
visited j'esterday by his father and ether
members of his family. He is in geed spir
its and will recover.
Be Careful, Beys.
Beys should be careful net te build
large bonfires in the streets as they may
be the cause of a great conflagration. The
police have been ordered net te allow the
one which was te have been started en
Seuth Duk street, unless the size is greatly
reduced.
In Town.
Alexander Duncan, burgess of Tork, is
registered at the Grape hotel te-day.
The Drunken Man's Favorite Amnseaseat.
This afternoon a drunken man named
Backius, from Mount Jey, attempted te
get en a western-bound train, at the Penn
sylvania depot. He caught held -of the
bandies of the caboose, but lest his foothold
and was dragged for a long distance.
While he was hanging te the caboose,
Baggage Master Clinten ran te his
rescue, and catching held of him,attempted
te pull him from the car. The train was
running quite fast at the time, and Mr,
Clinten was thrown down and had his
pantaloons badly tern. Buckius by this
time had lest his held en the car, and he
fill off, escaping with but a few bruises.
Arm Dislocated.
On Tuesday Mary Killinger, a ten-year-old
daughter of Officer Killinger, fell and
dislocated her arm. It was first believed
that it was merely a sprain, but as it did
net seem te improve, Dr. Boyd was called
in yesterday and he attended the wounded
limb.
Nplndle Broken.
Last evening a young man named Snyder
was driving en East Orange street. When
near Ann street the spindle of his buggy
broke. Mr. Snyder and a lady who ac
companied him jumped out and were net
injured.

LIABILITY OF THE COUNTY FOB COSTS.
Fee of the Mayer, Aldermen, Justices of
the Peace, l'elicemen and Constables
in I'rosecutlenH ler Trespassing
Upen Railroad Trains, etc.
The following opinion of County Solic
itor Hugh It. Fulton, esq., given te the
commissioners en Thursday last, will in
augurate considerable of a change in the
matter of the payment of costs by the
county te magistrates, constables and the
city police :
Te the Commissioners el Lancaster County.
Gentlemen : In reference te the dis
puted fees, I submit the following :
I. Trespassing Upen Railway Trains.
By a recent decision of the supreme
ceuit of Pennsylvania, published in the
Lancaster liar, June 20, 1880. the county
is net liable for and cannot hereafter pay
either magistrates or constables costs in
prosecutions for trespassing upon railway
trains.
II. County Net Liable Unless Defendant
Sentenced te Hard Laber.
By the same decision and that of Judge
Harding published in the Legal Intelligen
cer, September 13, 1870, the county is net
liable ler the costs of any conviction be
fore a justice of the peace, unless it is ex
pressly required by statute or the defendant
is sentenced te hard labor and commit
ment fellows the sentence.
III. City Ofllcers Untitled te Half Fees Only
Th'e act of 1809, P. L. 454, sec. 7, amend
ing the charter of the city of Lancaster,
limits the mayor of the city and all ether
officers receiving a salary from the city te
half fees iu prosecutions for drunkenness
and diserdcily conduct and vagrancy, when
such persons arc committed, and provides
that they shall receive no fees for cases
dismissed.
IV. The Fees.
The full fee fixed by the act of 1808, P.
L. 870, for the mayor and aldermen of
Lancaster city for all services in disorderly
conduct and disturbance of the peace cases
is fifty cents, of which the mayor charges
one-half.
The full fee for the policemen and con
stables of Lancaster city iu such cases, by
the same act, is thirty cents, of which the
city police can only charge one-half.
V. Fees iu Vagrancy Cases.
Fer the mayor and aldermen of Lancas
ter city, and all justices of the peace in the
county, the fee fixed by the act of 1879 P.
L. p. 04, for all services in vagrancy cases
is twenty-five cents, of which the mayor
charges one half, and for constables for all
services twenty-five cents and mileage, of
which the city police charges one half and
mileage.
VI. Fees in Cases of Drunkenness.
Fer the simple offense of drunkenness,
when the defendant is ordered te pay a fine
and costs, the county is net liable for these
costs in case the defendant docs net pay
them.
If, however the defendant is sentenced
and committed te hard labor under the act
of 1794, Purden's Digest p. 1172, sec. 4,
the county is liable for the alderman's,
justice's and constable's full fees according
te the fee bill of 1808, the mayor and city
police being restricted by the act of 1809
te half fees.
VII. Receiving and Duplicating Unfound
ed Complaints.
" A justice of the peace is net bound te
issue a warrant whenever it is applied for ;
he is te use a legal discretion, and deter
mine en mature deliberation of all the cir
cumstances whether a warrant should
issue, and if upon hearing the charge open
ed, be thinks it net te be an offense within
the law, he ought net te proceed upon it ;
which would be te no purpose but merely
te put persons te unnecessary trouble and
charge." 1 Yeates, 74.
Under the above decision it is very evi
dent that where complaints are received
or duplicated without just cause merely
for the purpose of docketing fees te be
drawn from the county en their dismissal,
the county is net liable for the costs.

A Decision in Its Faver.
Pittsburgh, Pa., July 3. A test case
involving the qucsiten whether Allegheny
county should be compelled te
pay the interest en the claims for
losses incurred by the great riots of
1877 was decided in the court of common
pleas this morning, Judge Ewing holding
that the county was net liable for the
interest. The case will be taken te the
supreme court for finnal adjudication.

Link Williams Pays the Death Penalty.

Williams was hanged here yesterday for
the murder of a man named Blissner.
About 1,500 were present. Williams made
a short speech, warning his friends of his
