He testified further that the night was se dark that he could hardly see a hand before him. Chas H. Wilmer, the defendant, was called, and testified that he never haw Sirs. Tayler until he saw her at the squire's office en the day of his hearing ; he was net at Cairnes's house en the 12th of Feb ruary ; did net leave his own house en that night; did net assault Mrs. Tayler; pleaded guilty of attempted rape in 1871 and served a term in prison for the offence. F. Beyer, esq., solicitor te the prison inspec tors' presented the following paper from the prison inspectors, which the court di rected te be presented te the grand in quest : That a large quantity of weithlcss tobacco has accumulated at the Lancaster county prison from picvieus years some of it purchased eight or ten years age and that they arc unable te use it in the manufacture of cigars; that when the grand jury visited the prison yesterday, this tobacco was stored in a room along with ether tobacco in geed condi tion and could net be properly examined by the grand inquest ; and that no mem ber of the beard of inspectors was present te call attention thereto ;" that the benid of directors have advertised the same for sale at 1 o'clock, p. m., te-day and have this morning caused the geed tobacco te be separated from that for sale and the latter te be exposed te public view. They, therclbic, pray the grand inquest te be present at said sale te see exactly what is sold and the manner iu which the sale is conducted. In the afternoon Governer Ileyt and Lieu tenant Governer Stene, by invitation, made brief addresses. The governor as sured the convention that he would de all in his power te prevent a recurrence of the inability of the state te meet its ebfiga tiens te the schools of the state, as had been the case the past year. There was a reed deal of sharp criticism by some of the superintendents at the way the school fund was managed. It was contended that the school warrants were net honei ed and that there ought te be an explanation. A committee of fifteen was authorized te be appointed te ask the state treasurer's presence this morning. OBITUARY. Dxatlief Sirs. Margaret liinney and Martin W. Nissley. Mrs. 3Iargarct Hiuney, widow of Samuel Hinney, died at Mount Jey last night at nine o'clock. The deceased was 74 years of age. She leaves a family of three daughters and one son, all of whom are married, one of the daughters being the wife of Jehn II. Sellers, clerk of orphans court of the county. Mai tin W. Nissley, aged 56 years, of East Denegal township, died yesterday of consumption. He leaves a wife three daughters and one son. Presentation. Yesterday afternoon the tobacco packers at Funk's warehouse, en the Marietta pike, presented their foreman, Mr. S. H. .Wal lach, with a handsome geld headed cane. The presentation speech was made by Mr. 31. M. Fraim, te which Mr. Wallach re plied, thanking the hands for the kind gift, after which they all sat down te a fine set out. Large Sale of Seats. The chart for the sale of reserved seats for Emma Abbett was opened this morn ing at the box office of the opera house at half past seven, and before nine o'clock ever 200 seats were sold. The number of Siats taken at neon was about 300. At neon ever 230 seats had been sold for Carn cross's minstrels. Sudden Illncs. This afternoon Samuel L Fowler, resid ing en "West James street, was taken very sick while standing in the doorway of the law office of J. W. F. Swift, esq., en Seuth Queen street. lie was carried into the office and Dr. Carpenter was sent for. After a short time Mr. Fowler had im proved somewhat, and was removed in a carriage te his home. Tired el the West. Three weeks aje a man named Smith, with eleven children, left his home in the lower end of this county and went te Ar kansas. Last night they returned te this city and they left for their old home this morning. Sale of Hersei. Samuel Hess & Sen, auctioneers, sold at public sale ou Monday, at the Franklin house, this city, for Jacob Sener and ethers 14 head of horses, at an average of 1132.50 .per head. runaways. Twe Six-Hene Teams MakiflgOoed Time. Yesterday a son of Henry P. Breneman and a son of Samuel "Welgamuth were each driving a six-horse team along the pike about two miles north of Mount Jey. Welgamuth's team was behind, when the horses frightened and started te run, pass ing the team of Breneman. The horses of the latter then became frightened and be gan running. Beth teams then did their level best and passed aleug the read at a high rate of speed for some distance. Finally the team of Welgamuth was stop step ped, and the horses of Breneman, coming up, passed around him. They were also stepped in a short time. Neither of the drivers was hurt, but the horses were bruised, and the wasrens. one of which was upset twice, were badly broken. An Old Stage Which Should be Removed. This morning Daniel 3Iayer, tobacco dealer, was driving ou Seuth Queen street, near the end of which there is an old stage lying, which was wrecked en Saturday night. When 3Ir. Mayer came opposite te the old stage he met a man named Hirsh, who is a blacksmith in New Danville, and who was also driving. The horse of 3Ir. Hirsh frightened at the old vehicle, and, jumping aside, ran the wagon te which he was hitched against the buggy of 3Ir. Mayer, upsetting it. 3Ir. 3Iayer was thiewn out, and besides having his wrist sprained he was badly bruised about the body. The buggy was broken in several places. Tobacco. Mt. Jey Star. Michael S. Wittle, of Iiaphe township, has sewn a patch of about one thousand square feet in tobacco seed ; two hundred and sixty-two feet of it is up and covered with nice young plants. The first seed was sewn en the 20th of Maich and the last ou the 15th of 'this month. He has a tobacco plant that was set out en the 2d of April, and is growing nicely, the leaves of which measure five inches long and three inches wide. He also tried tobacco seecd that was ten years old and it came up nice. Discharged. A rather singular tscene occurred iu the Heuse this morning, in ine jxecera tnere appears a speech in blank verse entitled "The Immortal," which is copyrighted by Mr. Downey (Wyoming), and which purports e be in support of his bill providing for the painting of biblical pic tures en the wall of the capitol. Mr. Garfield (Ohie) called attention te this fact and moved that the speech ba re ferred te the committee en rules te inquire whether it is competent for a member te copyright his speech, pointing, out at the same time the dangers which might atteud such a practice. Mr. Downey replied that he had the opinion of the librarian of Con gress upon the competency of his copyright ing his work. He had no objection however, te Mr. Garfield's motion. Mr. Cenger (Mich.), however, did oppose it in a rather amusing speech, in which he intimated that Mr. Garfield was envious of the rising young poet. The yeas and nays were or dered en Mr. Garfield's motion, and during the roll call the members separated into groups, the singular speech being the sole topic of conversation. Garfield's motion was agreed te. The Heuse then went into committee of the whole en the naval appropriation bill. The Subject Considered In the Senate. In the Senate Mr. 3Ierrill submitted a resolution instructing the printing com mittee te take such measures as shall ex clude Delegate Downey's copyrighted argument from the Recerd, but after argu ment it was withdrawn. The reading of the bill was interrupted by the receipt of a message from R. B. W. A. Wheeler also laid before the Senate the joint resolution passed by the Hense accepting the gift, in the name of the nation and thanking the donors. Mr. Dawes said he could net suppose that the Senate would object te a momen tary interruption of its regular business by se interesting a subject. He spoke in favor of the resolution.
