COURT OF COMMON 1'LEAS.
Before Judge Livingston.
In the case of Jehn M. Hershey vs. Gee.
H. Moere, the plaintiffs, in rebuttal, called
Tobias Ilershcy, who testified in legard te
the consideration defendant gave for the
note and stated that 8477.09 was paid June
8, 1872, a note for $82.09 and an order en
Solen Cherry for $395, which was shown
te have been accepted and paid. At the
time defendant signed the note he did bus
iness for himself and witness did net knew
that his brothers had leased the farm. The
case was given te the court shortly before
neon.
Leuis Stark vs. Jeseph Stark. This was
an action te recover $04.24, the amount of
a bill claimed by the plaintiff for black
smith work done for the defendant. The
defense was that the plaintiff shed defend
ant's henses in a manner that caused them
te be hoof-bound, and he was therefore un
able te sell them at the time he desired te
and was compelled te keep them for sev
eral months. By this alleged injury the
defense claimed te be injured te the ex
tent of $80. The jury rendered a verdict
in favor of the plaintiff for $40.87.
Themas Furniss vs. Henry N. Brene
111:111. The history of this case, which had
been previously tried and a verdict of
$007.07 rendered for plaintiff, is familiar te
our readers. They will remember tiiat
Furniss was county treasurer and a politi
cal partner of Levi Sensenig ; Iircneman
was a candidate for shcrill and Ivcnuig
tax collector and small politician in Provi
dence township. With a view te getting
his assistance for their " peel " ticket
Furniss agreed te take Kendig' s check
for $1,000 in part payment of the county
taxes and allow him the five per cent, abate
ment granted for prompt payment, and
ISrciicinaii endorsed the check. It was
net paid, Kendig alleging that he had been
robbed after collecting the taxes and
Jireuciiiau denying that the check had been
duly protested and alleging that he had
never received any consideration for nor
incurred any liability by his endorsement.
Air. Furniss testified that he get the
cheek from Kendig endorsed by Brcncman,
who asked him net te present itat bank and
lie would sec it paid ; that Kendig had
paid uiic-thinl of il; balance never was
paid.
Fer the defence Levi Sensenig testified
that he wrote the check en the day of its
date, at the Lancaster County house ;
Iircucmaii, Furniss and Kendig were there.
Furniss said he would net use it, as Ken
dig's sureties were geed, and he would
net want Breucniau te pay it ; the
reason Furniss wanted ISrcneinau's
name te go en the check was
that, being ceirity treasurer, it would
net de for his (Fmniss's) name te appear ;
these arrangements were made at different
places ; witness could net tell exactly where
it was drawn up. The arrangement was
for Kendig te make $50 for himself and te
secure Kendig, for this amount, te fight for
Grissingcr. It was get up te make votes
for Grissingcr, Funiiss's candidate for
county treasurer ; don't recollect having
any conversation with Grissingcr in re
gard te this matter.
Be-examination : At the time of the
making of the check it was said that Mr.
Ireiiein:m was te incur no responsibility
en account of this check.
During the cress-examination of Sen
senig Mr. Kline, counsel for Furniss, pro
posed te impure of Sensenig concerning
the "peel '" of that year en all the candi
dates, but Judge Patterson would net al
low the question. Rep.
.On trial.
A Wise Cat.
About six mouths age Jehn II. Rey, of
the Helly Tree inn. this city received from
Isaac Bradley, of Bradley's mills, Fulton
township, a cat, that was a noted mother
and ratter, notwithstanding she was blind
of an eye. The cat became perfectly
domesticated at the Helly Tree, and
seemed te be perfectly satisfied with her
new home as long as there were any rats or
mice te catch. But she presecuted her
business in this direction with such un
abated energy that at last there was
net a rat or mouse about the premises.
She became, uneasy and acted as though
there was something "in her mind. " A
week age she was missed from the Helly
Tree, and te-day Mr. Rey received a letter
from Mr. Bradley, stating that the cat had
returned te the mill in Fulton township,
some thirty miles distant. She had
evidently pondered the situation and
reached the conclusion that there was a
better supply of rats and mice at the mills
than at the Helly Tree, and like the Arab
of the desert had quietly cushioned her
claws and silently stolen away te her old
home.
A Government Building for Lancaster.
In accordance with many letters for
warded te him by men of large business
and political influence in this city, Hen.
A. Heir Smith has introduced in the Heuse
:i bill providing for the erection of a gov
ernment building in Lancaster. It is
urged in behalf of such a building that it
is needed here for the growing wants of
the postefficc and revenue department.
This revenue district is the third largest
in the state and Lancaster county is the
largest division of it and this city the most
important centre of population. Its busi
ness is rapidly increasing and the leaf to
bacco trade greatly enlarges its outlook.
The postal business also increases rapidly.
The building contemplated can be erected
cheaper here than at auy ether point and
the interest en its cost would net be
greater than the amount that will seen
lie required for rentals.
Paralyzed.
Hen. Wm. Hamilton, of Williamstown,
was stricken with paralysis jesterday
afternoon about 1 o'clock aud at last ac
counts was lying in a very critical condi
tion. His entire right side is paralyzed
from head te feet, and although he ap
pears te be conscious and tries te speak,
his speech is se much affected that he can
not make himself understood. Mr. Ham
ilton is one of the most prominent men in
his neighborhood. He was fennerly an
active Democratic politician, but cast his
fortunes with the Republican party about
the time of its organization. He was
elected te the state Legislature in 1853
and 1830. and te the state Senate in 18u0.
Uigh-Prlccd Fun.
The seven young men who, ' for fun "
kicked up a row at R iwlinsvillc a short
time age, were te have had a hearing
before Alderman Barr this morning.
When they met the prosecutors they suc
ceeded in settling the case, which they did
by paying all costs, amounting te $131.75.
This may be cheap fun in the country but
young men can have a geed time in the
city en less than that. Perhaps this little
affair will teach the young men te respect
the law hereafter.
Latter, the Brewer.
Frederick Lauer, the Heading brewer, is
in town te-day looking after his business
interests. He says business is "boom
ing, " but the brewers are much exercised
because of the failure of the ice crop. He
has recently visited Chicago, Atlanta and
ether cities where ice-manufacturing ma
chines are in operation. If the present
cold snap should disappoint the ice
gatherers, Mr. Lauer says he will be com
pelled te buy a machine costing $16,500,
as that will be cheaper than buying ice at
the prices which will be sure te rule in the
event of a fanure of the ice crop.
flutter Stelen.
This morning about 5 o'clock a thief
stele a basket of butter from the market
stand of Jeseph Bear, in Centre Square.
Mr. Bear had occasion te leave the stand
for a very short time and told his neighbor
of the adjoining stand te keep an eye en
it. He did se, as closely as he could, but
having his own customers te attend te, his
attention was for a moment withdrawn,
and the butter stolen. It is believed te
have been taken by a man who was pric
ing fish. A description of the fellow has
been given te Mr. Bear and he will prob
ably be arrested.

Temporary Chairman.
Harbisbure, Pa., Feb. 4. The Repub
lican state convention met here in the
opera house at 12 o'clock te-day, and was
called te order by Chairman Hoetcn, of the
state central committee. S. II. Miller, of
Mercer, moved that Hen. Russell Errett
be appointed temporary chairman, and
General Albright moved te amend
by substituting the name of Geerge V.
Lawrence. A vote was taken, which re
sulted in favor of Errett 158 against 92
a victory for the Grant people. It was
decided that a cemmittee of one from
each senatorial district be appointed 0:1 0:1 0:1
rcsolutien, and committees en contested
seats and permanent organization were
also appointed,
Errett's Speech.
Mr. Erret upon taking the chair spoke
as fellows :
"Gentlemen of the convention, I thank
you most heartily for this mark of your con
fidence. The place te which you have called
me is of but temporary importance, but as an
evidence of your kindness and esteem, I
appreciate it fully. This convention is the
opening of the campaign of 1880. Te-dav
we pass its threshold and enter upon ether
active struggles for the right. In taking
her place at the head of the Republican
column Pennsylvania witnesses the usual
flurry and excitement that attend a definite
expression of the will of the people of a
commonwealth, but I feel sure that when
that flurry is ever we shall all le
a firm and unbroken line for the success of
the candidate who may be chosen at Chi
cago, whoever he may be. Wc have our
individual preferences new and wc
dilTer as te modes and methods of action ;
but when the final decision of the
Republican national convention is uttered
all differences will vanish and Pennslva
nia will be found as she has been
found in every presidential election
since 1800 upon the side of na
tional ever state supremacy ; of the
Union indivisible and indestructible ; of
honest money ; of a protective tariff ; of
pure and honest as well as free elections,
and of the equal rights of all under the law
te life, liberty and property, without dis
tinction as te race, color or nativity.
" Invoking upon your deliberations the
spirit of harmony, of that charity for eacli
ether's differences which suilcrcth long
and is kind, and thankinir you airain for
your confidence, I await the further pleas
ure of the convention."
Hen. Jehn Cessna eftcred a resolution
that a committee of nine be appointed te
report, subject te the approval of the con
vention, a list of delegates with their al
ternates te the Chicago convention, and a
list of electors after consulting with the
delegations from the various districts.
Mr. Stewart, of Franklin, offered an
amendmeut, as fellows :
Resolved, That a committee of one from
each congressional district be selected by
the delegates from each congressional dis
trict, whose duty it will be te report te the
convention the names of four dclcgatcs-at-largc
te the national convention and two
clecters-at-la rge.
That it will be the duty of the committee
te report also a list of district delegates te
the national convention who arc te be
chosen bj the delegates from the respec
tive districts, including in their report the
names of these persons who have already
been chosen as delegates from their respec
tive districts by the action of the people
thereof.
Beth of these resolutions, however,
were withdrawn, and at 1:20 p. m. the
convention took a recess for one hour.

Harrisburg dispatch te the Press.
Up stairs, with the doers closed te all
except the most confidential friends, was
Senater Cameren, who had staked his po
litical future in a great measure upon the
result. Near at hand, in another room,
were the chief lieutenants. Quay, Sam
Barr, the prospective congressional candi
date in the Dauphin congressional district ;
Christopher Magec, the fiery young mana
ger of Allegheny, under whose guid
ance tne unit and instructions reso
lutions of last Saturday were
forced through at Pittsburgh ; the
genial state senator from the First district,
Geerge Handy Smith ; Rutan, whose love
of politics is net barred by the federal
civil service order ; Mr. Jehn Cessna, who
is always in the thickest of the fight ; and
brilliant Wilsen Norris and Chris. Kneass.
And up another flight of steps the pigmies
of the engagement held council.

Editorial dispatch te the Press.
The vote en "Wolfe's amendment revealed
but 13 majority for the Grant pregramme.
One vote was declared one hundred and
ten for te one hundred and twenty-three
against. The real vete is stated te be ene
hundred and seventeen for te one hundred
and fifteen against. Several gentle
men who were present have told
me that that they personally observed
persons who voted for as many as three,
four and five absent delegates. The ex
citement was great, and officers had diffi
culty in making an accurate count. The
anti-Grant men will insist te-morrow en an
open vote in the convention, when there
can be no mistake or fraud. The moral
victory is altogether with the anti-Grant
men. The Grant vote, without Alle
gheny, Lancaster aud ether delegations
chosen by machine committees, would
have been overwhelmingly beaten.
