Tub Law of Partnerships. An
important declilon baa been recently made by
tbo Supremo Court of this State regarding part
nerships. It was in thecaie of Clark vs. Fletcher.
Fletcher had been a Director In an Incorporated
savings (natltutioh and had withdrawn from the
concern, giving notice in the newspapers at ths
time of his retirement, and therefore claimed that
he was not liable for the debt of the institution,
which tb Court below sustained ; but tho other
party appealed from the verdict on tbe ground
that euth notice was insufficient, Ibe law requiring
ox wren notice in order to shield the defendant.
Tho Supreme Court reversed the decision of tho
lower Court, and, In rerievrl ng the c.aie, laid that
"when an oiten-ible partner retires from a firm,
ho Is bound to advcrtlia, on the ground that per
son dealing with the firm are induced to trust
him. Thi rule is different as to dormant part
nera. But where partners do but i ties under an
artificial name, the public, of course, truat tho
parties compojlng the firm j hence, express notice
to nil persons dealing with the firm i necesiary
to exonerate n retiring partner from liability."
