A Great Crimk. The highway nb-
bery committed last summer by a number of des

bes attracted universal attention ia tbe aurround

Jnitioe hastbeaa ohoated for the time Doing, at all
events. Tbe Brook vllle Jtfftroninn tells bow tbe
ease wu disposed of at the recent term of Court,
at Brookvllle, In thla way :
In the ease of tbe Commonwealth vs. Alllion,
Anderson and Leeob, a noltr prwqui was entered
and tbe prisoners were disoharged. Considerable
dissatisfaction was expressed at this action of tbo
Court, aa many thought, and not without reason,
that there was collusion between tbe prosecutor
and defendants whereby the ends of Justice were
to be defeated. But the Court pur wed a proper
course in the premises, which every one will see
by calmly considering tbe points in the ease. J be
trial bad not proceeded Tery far, until'it was erl- 1
dent that the obief witnesses exhibited an astonnd-!
log lack of memory, targeting entirely what they j
had sworn to at tbe time of the preljutinerv ex
amination, aa alio of what they bad said in the
presence of the Urand Jury but a few days previ
ous. Had the trial beea allowed to proceed a
verdict of "Not guilty " must inevitably been ren
dered in aoeordaana with tha evidence, and tbua
the criminals wuuld bavs gone scot free, as tbe
law expressly forbids tbe trying of a perron for
any oflenoe the second time ; but tho entering of a
no?, pros, obviated this difficulty, and it Is now
altogether probable that the culprits will agato

term ol Court. We arc kd to this belief from tbo
fact that the proseootor, John Brink, was brought
into uourt and required to give bonds in the sum
of $1,000 to appear and prosecute tbe ease at the
coming term. The end la not yei, and seme
startling developments may be ei pec ted.
Railroad Riding at Niuht. vVo
have sometimes heard R remarked by timid per
sons, says an exobaoge, that they would not travel
at night upon tbe railroad their Impression be
ing that there Is more danger of accidents la the
dark than there Is In daylight. Upon first thought
It would seem to bo a foot. There are many cir
cumstances which make eight traveling compara
tively safe. All work upon the track Is stopped.!
Comparatively few other trains arc on tbe road. 1
Switches arc more likely to be right then at any
other time, u tbey ere not la use for other trains,
end are locked. Tbe aignals for night trains, be
ing made at night, would scarcely fail to be
observed and obeyed j sod what is more impor
tant, would be seen at a greater distance than if
made at daylight. Tbe engineer has less to at'
trut bis attention than lu dayllgbL While, after
all, a rock or tree felling across tbe bead oa the
track ta broad daylight, or an Intended' obstruc
tion, Is nearly aa much a " hidden danger " as il
encountered in tha night. There are many places
la ell the roads where tbe range of view Is less
than lbs reflecting head-light at night. So, aftar
all, fl would appear that one can take a night's
rest la a railroad ear with comparative safety.
