at no greater cost than that of carriage

Before proceeding to hear and de-
cido upon the sovcral applications for
hotel licenses now presented to us for
syndication it is proper that both ap
plicants and citizens generally should
be informed as to the views held by
tho court upon the subject of tho ex
tent to w hich the court may exorcise a
discretion upon the subject of granting
or refusing licenses. It is tht, more
necessnry that our viowrs bonnnonnced
because some judges havo held that
the discretion committed to them is
wholly arbitrary, while others hold
that tho ct of 1875 takes from tho
courts all discretion and requires them
to grant all licenses applied ior.with
out regard lo the publio necessities.
In order to ascertain both the power
and the duty of the courts in tbe mat
ter of granting and refusing licenses, it
is necessary to consider sovoral Acta ol
Assembly relating to tho subject.
Briefly staled, the legislation upon this
branch of t be excise lawa is as follow.
Tbe act of 11th of March, 1834,
(pamph, p. 117) gave the several
Courts of Quarter Sessions power to
grant Iiconsoa aixjording to the regula
tions thorein contained. One of thoso
restrictions wa that "no court shall
license any Inn or tavern which shall
not be nutwsnary to accommodate the
public and entertain strangers and
travelers.

bly from 1834 down lo 1872, and from
them deducts the conclusion, that ''it is
tbe duty of the Court to bear and do

facts; to ascertain the fitness of the
applicant and tbe necessity of the
houso for the public' accommodation."
To be a rightful judgment it must bo
exercised in the particular caso and
upon tho facta and circumstances be
fore the Court afW they have Iwen
board and duly considered.
It is noticeable that tho new luw,
except in regard to the amount of the
license foe, and the amount and the
condition of the bonds required of
applicants, makes no mention of a
single requisite soummuv to tbe. ob
taining of a license. , As to tho citizen-
snip ol the applicant tbo filing and
publication and tho contents of tho
petition the certificate of character,'
and the the action to be taken by thoj
voun upon petition, remonstrances
and evidence presented, and also in re
gard to transfers snd revocation of li,
censes, It ia ailent. 'Unless, therefore,
tho former laws upon these subjocU
remain in force, Ihero is nothing to
guide the practice of the Court, or
govern Its decisions upon bconso ques
tions. It is a woll settled rulo, that a stat
ute can be repealed only by express
provisions of a subsequent law or by
necessary implication; and this can
only bo whon there ia such repngnanry
between tbe new law and the old that
they cannot stand together. "When
ever," says J. C. Black, "two acta
may bo mado to stand together it is
the duly ol the judge to give both
ol them full effect ; even when they are
seemingly repugnant, they must, if
possible have such a comtruction that
ono may pot repeal the othor, unless
tbe latter one contains negative words,
or Ibo intention to rcwal is manifest
by some intelligible term of expression."

There are no words of appeal in tbe
act of 1875, except as to the Local
Opition law. The natural, If not
necessary inference therefore Is. that
the Legislature intended it tobeauxili
ary to, and in aid of tbe purpose of the
old law. Instead of evincing any in
tention to limit or diminish tho powers
ana discretion of tbe Court based npon
ov.denoe, as conferred by former laws,
it expressly ' re-enacts in th same
words so much of tbe act of 1856 as
requires "tho Courts to fix by rule or
standing order a time at which appli
cation for license shall be beard, at
which time all persons applying or mak
ing objections to applications for li
censo may bo hcant by evidct.ee,
petitions, remonstrance or counsel."
The hearing thus required was not de
signed to be a mere idle ceremony. It
purpose is fully explained by tho adl
of 1858 and lHo7. It is made thereby
to extend, not only to tho fitnoss of the
applicant, hut tbe Court is required to
reli.se tbe license if u. its opinion the
necessities of the public and tho enter
tainment of strangers or travelers do
not require i publio bouse to be kept
at tho point designated. If tho Legis
lature bad intonded that the character
ol objections to a license, should not bo
as broad and comprehensive as before
allowed, it surely would in some way
have at least intimated such lutontiou
by appropriate words. In the absence
of a clearly expressed or Implied In
tention to abrogate the laws which
have for forty years authorised tbe
Courts to bear and pass upon each ap
plication according to its merits, 1 hold
that no intention existed. ,
