fusal of a witness to appear and testi
fy beforo a logislalivo eommitleo was
mado a criminal offenso and n requisi

facts, taken in connection with the
testimony finally givon by him, and
the direct contradiction thereof by S.
P. Brown, cause us to havo grave
doubts as to tho truth of his assertions
in regard to the disposal of tho money
retained by hi in out of tho collections,
and we cannot resist tho conclusion
that if his etnloinenl bo truo, ho has
without cause or necessity refused or
netrlccted to civo to the State, whoso
agent be was, until about to bo com

met in January, 1871, the largo sum
of 307,853.12 more than ho was en
titled to under bis own unfounded
claim. Your committee cannot under
stand why tho attention of tho Legis
lature of 1871 wns not called to this

On April 11, 1871, another sttlo
ment wits obtained by I'vansnt Wash
ington, resulting in a balance upon tho
lust claims filed, in favor of tho State,
of $137,822.59. Warrants In favor of
John W. Geary, Governor, or order,
wero drawn - on that day for tho
amount, which wero paid lo Evans
April 15, 1871, without tho endorse
ment of the Governor, nnd this money
reached Iho SUto Treasury April 25,
1871, through tho hands of Governor
Geary.
May 15, 1871, another balance wns
struck in favor of tho Stato for $242,
107.57, for which n draft was drawn
to tho order of tho Gqvurnor, was en
dorsed by Evans, attorney in fact, do
posited by hi in in tho Farmers' and
Mechanics' national bank of Philadel
phia, iho evidence thcroof sent to
Govornor Geary, nnd it reached tho
Treasury Slav 10, 1871, through him.

it was Appleton k Co., but nm not
certain and that it would cost forty
thousand ($40,000) to publish tbe Mil
of Governor Geary, being about ten

anticipated. Another consideration
ho was lo give to Governor Gonry was,
that ho (Evans) was cither lo purchaso
oonti-.dlinn; interests in a paper In

date for tho Presidency. This pro
posed paper was to be run wholly in
tho interest of Governor Gonry and to
bo under his (tho Governor's 'i control.

their names but ho declined to givo,

statements of Mr. Evans in viow of
this testimony, and of all the facts and,
