The caso for tho prosecution, when

Tho caso at this stngo looked black
indeed for tho rclined lady against
whom nil these, aptly joined conclu
sions and damning spots wcro found.
The ingenuity with which tho prose
cution had joined all the links of infor
mation together was regarded as cred
itable to their sagacity and diligent
labor in the people's cause. Nineteen
days had they labored to weavo the
web around her, and when on lho27lh
of Decomber last Attorney General
Syesler rested his caso there appeared
to bo small room tor Mrs. Wharton's
escape from the meshes wKich would
hold her until the gallows claimed its
own. Tlio defenco arose to its hercu
lean task, and during tlio last eight
- days have done such serious damage
to tho caso for the prosecution lliulil
Rccma no longer lennblo. And tho
most curioo thing is that it lias boon
almost wholly by purely circumstan
tial evidence Ihnt lliishas beon brought
about. Drs. Ailtcn and Tonry pro
fessed to have found poison. Profes
sors McCulloch, Gentu and Roeso tes
tified and appear to have proved that
no nnlinmny had been found by tho
tests at all. They showed conclusive
ly that tho results obtained in the ex
iicrimenti could havo beon produced
ly the action of tho leagonls employ
ed by Aiken and Toriry upon tho mid
icino administered before General
Ketehum's death, and left it open to
serious doubt but Hint the poison, if
any, was contained in tho reagents
themselves. Tho discl'edi t Ih us throw n

tho ontecliiiical, who had taken the
prosecuting professor at their word.
Tho most fatal objection to tho ehomi
cat testimony emtio from Professor
Gcnlh. It may bo summarized in ono
of bis replies, as follows : " Whenever
fcubstanco is to bo treated for tho
jireseneo of at' poison antimony,
dor instance it is necessary under all
circumstances to life tho best methods
known, and which are not liablo to
error; and in caso of metallic poisons
to produco the metal, and to produco
thu metal in such a quantity that by
tt subsequent investigation of that
metal no doubt at-all can be left as to
its nature."
The profesors had net produced
their antimony. After thus nullify
ing tho analyses, tho defence proceed
ed lo throw doubt upon the medical
testimony as to tho cause of deulh.

cution, which places its ullegalinus in
an orderexactly inverse to those given.

much speculation on tho result. Now,
what is painfully apparent throughout
this trial Is the woful Incompetency
of fbo medical men engaged tounulyxe
tho conU'nts of hu stomach in
the first iiisUiuc-e. For tho accused
woman whoo lifo is in jeopardy we
havo profound sympathy that her
chances of a shameful deuih realed on
the fallacious and cureless conclusions
of such digraces lo a profession which
is nothing if not exact and absolute.
The failure of tho analyses will unfurl
uiiately leuvo a painful gap which it
will bu found impossible to Gil. It
mmy ba proven that antimony was
tnot found ; but it cannot bu now de
clared willi ccrtainlly.tliat it could
not havo been. This is extremely re
grettable, hs much for Mrs. Wharton's
sako us in the pure interests of justice.
It leaches a lemon that when searches
ur.d analyses of ibis kind aro required
to bo mado none but the highest ob
tainable science shou'd be used, as
fflono other is anything better than
fin cie III and criminal Tho public
will watch tho remaining ilaj of this
extraordinary trial with intense in
terest. When n Connecticut deacon nadged
