Pear Sir : The nhovo notico I saw
about three months mnco in the 23d
"So. nnd 15th. volume of your pnper,
and Be I am there referred to as being
one of tlio mill hunds, who, if olive,
could substantia to tlio accuracy of the
nnrrntivo, I cheerfully give my testi
mony, although it in at a Tory late
hour, because I feci it in a duty I owe
to Mr. Marshall, nnd perhaps to tlio
public. I havo not seen tlio work ro
ferrod to, neither have I teen any per
son who said they hud.
I was ono of the men at work at
Coloma at tho time tlio gold was found
by Mr. Marshall. I wall remember
when he sent a young Indiun for
James Brown to send him a plato.
Brown was on tho top of a saw pit;
liojumpod down saying: "I wonder
what Marshall wants with a tin plate?"
After wo had quit our day's work,
Mr. Marshall canio into our shanty
and told us he believed ho had found
gold, and directed Brown and myscll
to shut down the hend-gato early in
tho morning, tjnd throw in dirt and
leaves so as to completely shut of the
water, which we did, whilo Marshall
went alona down in tho tail race, lo
a few minutes ho tamo back with a
most pleasing smilo on his face curry
ing his old white hat in his arms, say
ing: "Boys, I believe I have found a
gold mine." At this ho tit his hat on
the work bench, that stood in the mill
yard, nnd tho mill hands all gathered
around in an instant ; nnd thero, sure
enough in tho top of his hat crown
(the top knocked in a little) was the
pure melul ; how much I do not know;
perhaps an ounce. One of our com
pany by tho name of Ar.ariah Smith,
pulled out a fivo dollar gold piece and
compared the coin with the praticlcs.
There was a difference in tho looks,
but this we accounted for on account
of the alloy in tho coin. Any of us
would have been willing to havo sworn
nnd testified that what James V.
Marshall had lying on tho top of his
old hat crown was gold although nono
of us bad ever seen gold dust before.
Somo three or four days after this
Marshall went down to Sutter's Port
to see about grub nnd to havo tho
mineral tested, lie was gono four
days. When ho returned, and was
nuked what ho mado out of tho metal,
his reply was, "Oh, boys, it is tho pure
stuff. I and the old captain locked
ourselves up and was half a day try
ing it; and the outsiders wondered
what in h 11 was up, and surmiiscd
that I had found a quicksilver mine,
for you see thero is a quicksilver mine
found by a woman down towards
Monterey; but wo let them sweat.
Wo found it ngrccd with tho encly-1
cepedia, and wo applied aquafortis,
nnd it has nothing to do with it. We
. thon woighod it in water by balanc
ing ino uust against silver on a pair
of scales, in tho nir, having a basin of
water. We let tho scales down, and
when it camo in contact with tho
water tho gold went down and the
silver up (motioned if out with his
hand,) and that told the story that it
was clear stuff." llo then laid Sutter

ing early, before tho old gentleman
oame down, wo did a Marshall pro
posed. Just as tho mill hands were
tinUbing break fust, wo saw tho old
gentlcmun coming stubbing along
with .his cano in his hand (a wufi
clrosscd old gontlemsn, too1) : Mr. Mar
shall op one sido anj M. Werner on
the other, Sutter in the middlo. As
they neared our shanty wo went out
ana met turn. Alter shaking hands
and passing tho common salutations,
we were an invited try flutter and
.Marshall to eo along and have a gen
eral time prospecting in tho race.
Just at this timo ono of Mr. Werner's
little boys, not knowing what was up,

every particle and camo running back,
nonny out ol breath, meeting us and
exclaimed, "Seo here, how much I
have found ! having perhaps fifty
tlollurs' worth in liis linnils, and wo
dar not sny word lest tlio joke
would bo found out and wc loso our
liquor. The old pootlonian, as soon
as ho saw whnt tho boy had, thrust
hisrane into tho ground, saying: liy
