by tho Court of Quarter Sessions tor

hotels, iiins.w taverns, it is provided
that, "Licenses to vein! tho liquors
Aforesaid or tiny of tliem slmll he
granted to tlio citizens of tho United
.suites of temperate, habits and good
moral character, whenever the require
ments: of the laus on the subject are com
plied uith by such applicant." It is
objected on tho part of the opponents
to the glinting of lieenscs to the peti
tioners that they have not complied
with tho requirement of the law in
relation to tho afsemtincDt and valua
tion ol the yearly rental of tho Iiouhc
which the petitioners intend tooeeupy
for tho purpose of a hotel. That it it
on essential prcreqiiinil to betompliud
with by every applicant for a hotel
liccnso before the Court can grant
such a license. I n order to determine
whether this position is maintainable,
it will be necessary to refer to and
examine tho various acts of Assembly
which regulate the grnnlingof licenses
by tho Court, for the purpono of ascer
taining whether An nsvuwmviit and
valuation of tho yearly renlat of the
liouso intended to bo occupied as a
hotel by tho peliliouers, n such a
requirement of tho law ns is necessary
to bo observed by the. applicant for a
licenso befuro ho enn ask the Court to
prant it, and whether it is tho duty
of the Court to refuse such a liccnte,
w here it appears that no such assess
menl or valuation n made.

equalize and adjust the valuation re
turned to them, nnd shall deliver the

tavern, and every house intended to
bo used ami occupied for a hotel, inn
or tavern, is to bo assessed and val

incumbent upon every person intend
ing to apply for a liccnso to keep a
hotel or tavern, to havo this assess
ment and valuation mndo, in accord
auco witli tho Oth, Tlh, fill and Dili
sections of said act of S!!4, and the

I'lio oviilonco adduced before the
Court on (he hearingof these applica
tions clearly 6liovs tho absence of any
assessment and valuation. V hat is the
duly of tho Court T Tho act of As
sembly of April 20, 1S')H, under which
wo are authorized to grunt licenses,
declares in plain and unequivocal
language that licenses shall bo. granted
to citizens of tho United States of
temperate habits and good moral
character, whenever the requirements
of the law on the subject are complied
uith hi any tuch applicant. Having
mado a careful investigation of all tho
acts of Assembly regulating tho sale
of liquors, and conferring upon the
Courts tho power to grant licenses,
and after an impartial consideration
of the question submitted for our
decision, wo are. of tho opinion that
an assessment and valuation of the
yearly rental of tho houso which the
applicant intends to occupy for the
purpose of a hotel, is such a require
ment of the law as iiiuhI be complied
with by such applicant before the
Court cun grant Imn a license. Wo,
therefore, rcfuso to grant tho applica
tion of tho petitioners for a liccnso to
keep a hotel. Wo have arrived nt
this conclusion under a senso of the
obligation that rests upon every judi
cial tribunal to ascertain what the law
is, and when once clearly ascertained
to declare it, and onforce tin law thus
declared. 1'liis decision docsnot, how
ever, preeludo tho Court from grant
ing a liccnso to keep an eating house
or restaurant to the mid petitioners.
