people. Gentlemen upon tho other
side say that tho return of Hieksof the
vote of Somerset county is to bo taken
as conclusive and the action of the
board to be regarded as null. Surely
no lawyer who aspires to bo a states
man should contend for so narrow a
construction. When tho rightsof the
pooplo are involved, technicalities must
yield to tho broad viewa that equity
and natural right inculcate. When the
rights of sufirago and representation
aro involved, tho highcBt duty of the
lawyer is to so construe the iaw that
tbe largest liberty consistent with the
scoH3 unu purpose ft tlio enactment,
shall bo attuincd. Theso papers are
to be taken as a whole, and from the
two we must erect a single return ,and
from the fuoo of both, taking the high
lloiiso miiHt judgo who shall prima
facie ho sworn in ns nieinbsrs."
Ho goes on to arguo that thoso, hav
ing the highest number of votes, were
entitled to bo sworn, and tho amend
ment of Sir. Pershing, which was in
favor of tho cortilicate, signed by a
majority of tho return judges, was
voicd down by the llounu, and I find
that four members of tlio Senate
voted with tho majority. They were
in tho IIouto at that tiino. They are
hero to voto upon this question to
dy. The doctrines advanced then on
ono sido aro advanced now upon the
other. This question confronts them

Senators voted to give to the gentlemen

TEE GLORIOUS DEMOCRACY.
Tho Indiana Ileniocrutie State Con
vention was held at Indianapolis on
the 8tli instant, and covered itself all
over with honor. Instead of the
nonsenso and moral cowardico of tho
National Convention of 18G8, which,
under tho lead of "smart politicians,"
wont about hulf way towurds nigger
ism, it endorsed nothing that tho
traitors, lunatics and fools havo been
at for ten years past, but, on tho con
trary, rejected everything in conflict
with tho Constitution of the country.
This is the position, tho only position,
that tho Democracy can siuna ny.
Indiana has set a noblo example, and
wo trust tho Dcmocraoy everywhere
will soon organiie on tho samo basis
utter hostility to everything for ten
years past in conflict with the Consti
tution of the father.
We can give our readers no sounder
arguments than are to bo found in the
resolutions, and we therefore publish
tho wholo series. They are worth
reading and pondering over because

This Saturday night- the wind
howled ns it whirled by, lifting dirt,
dust, rags, and the like from tho street
to dash them in tho faces of those who
hurried ulong. And it was cold, shiv
ering, garment-searching, as if in an
ger at ono who would be comfortable.
The heavy omnibuses rumhle by over
the fror.en pavement. Tho horses
seemed all in a shiver tbe driver sat
ooundini! his tdoved band on bis
knee, bis fuco well muffled, as the 'bus
turned from Broadway into Four
teenth street. Every one was hurry
ing to reach home, or somewhere.

horses lo a curriage. The driver
turned out to meet the omnibus. A
little, little ragged girl ran to cross
the street did not notice the team
two gentlemen sprang at the same
time with us to save her, but too late.
The carriage, with its driver in
livery hurried on, as ir it were not
worth while to pick up a ragged little
girl!
We helped bear her into a store.
Her little face and hands were blue
with cold. Tho little calico frock and
tbin petticoat did not keep the cold
from her body. The ragged shoes
kept her feet from cold pavement, but
