Upon repairing to tho place, ft win found to bo confined to a email building uned as an oflico by a pernon known us the "Indian Poctrer-it," located in the rear of Dougherty's barber bliop. The poople renpoudud to tho alarm with their uttual promptness, and in a few moments hundreds tvereon the ground, forming lines and passing water to the flames with as much regularity as if guided by machinery. This building was entirely consumed. It was soon discovered that the barbershop could not bo saved, when the door was forced open and ull the furniture,(or nearlyall ) was removed to n place of safety. One of tho buildings in tho most im minent danger, was tho residence of Mrs Duulap, Iter houso being a frame, situated about twenty feet from the (ire. Ladders were raised, and in a few moments the roof was covered with men. Lines were formed across the street, and a continual stream of wuter was poured upon the roof and gable end of the building. Notwith standing all this, it caught fire several times in three or lour phicm, but was promptly extinguished. The residence of Mrs. Welch, on tho north, (only about ton or fifteen feet from tho tiro,) was fortunately plastered on the out side, nr it would undoubtedly liavo been consumed. That this lire was the work of an incendiary there can scarcely ho a doubt. It appenrcd to have originated in tba southwest cor ner of the Indian Doctress' wigwam. An investigation was held beforu Estjuiro Porter on Monday, but no fads were brought to light to throw suspicion on any onu. The property destroyed was fully covered by insur ance. Too much cannot bo said in com mendation of tbe promptness, energy and ubility of our citizens in caso of a fire ; but without an- broad hints or square tellings, we think tho authori ties ought to see by this time tho ne cessity of taking some steps in "time of pence" to "preparo for war" in tho future. This is to bo a first-class honso in evory respect, and will be a threo story building, fronting seventy-six feet on .Market street and extending sixty-seven feet on Front Street. It will contain a parlor, sitting room, dining room and oflico on tho first floor, and the second and third stories will contain about forly-flvo bed rooms. The contractor, Mr. Er.ra Ale, informs us that this is to be a first-class hotel in every re spect, and is to bo furnished with all tho modern tnd convenient improve ments, from tho cellar to the attic; and if ho is riot disappointed in pro curing material, the whole building will be completed by the first of Jan uary, 1870. The Supremo Court of Kansas is of opi lion that railway companies have certain rights as well us liabilities. In a recent case of appeal from a lower court, tho court held: "The cattle of the plaintiff wero killed on tho railway track of the defendants, by a traiu running over them. And the court held that il was error for the court below to charge the jury that the defendants were liable if tho cattle were killed through the negli gence or want of ordinary care of the defendants. It was an error to re I use to chargo the jury that tho defendants were not liable unless the catllo w ere killed through the gross ncgligenco of the defendants. The court further more held that when a person allows his cattle to run upon tho lands of tho railway company, iu tho vicinity of a railway track, thereby endangering the lives and properly of passengers and others, ho can recover only lor injuries done to his uallle through tho most gross anil wanton negligence of the railway company. The Supreme Court of Kansas nas expressly declared that the Legislature 'has nowhere at tempted to enact any law giving to any person any rights upon any other's land, whether it is fenced or not.'
