said offender to the county prison,
thero to remnin until discharged by
due course of law; provided, that when
tho fino imposed exceeds the sum of
ten dollars tbo party complained
against may appeal from the ducision
of stiid alderman or magistrate to the
Court of tuarter Sessions upon bis
entering bail in tbo nature of u recog
nizance, in tho usual manner, for bis
appcaranco at said court, when the
offence shall bo prosecuted in the same
manner as is now directed by law in
other cases of misdumcanor.
Sec. 2. if in lieu of deciding tbo
cause such alderman or magistrate
shall bind over or commit such person
to appear at tho Court of (Quarter Ses
sions, or if such person shall appeal as
aforesaid, or upon such binding over
or commitment, appear before the said
court, and be thero convicted of such
misdemeanor, be shall bo sentenced to
pay a fine not excoding two hundred
dollars, payable us aforesaid, or under
go an imprisonment not exceeding one
year, or both, at the discretion of the
court.
Sec. 3. If any person shall bo ar
rested lor carrying, or causing, or
allowing to be carried in or upon any
cart or other vehicle whatsoever, any
crca(uro in a cruel or inhuman man
ner, the person tukinghim intoenstody
may toko charge of such vehicle und
its contents, and deposit tho same in
some safe lace of custody, and any
necessary expenses which may be in
curred for taking chargo of and
keeping tho same, and sustaining any
animal attached thereto, shall bo a
lien thereon to be paid before tho
same can lawfully bo recovered, or
the said expenses, or ony part thereof
remaining unpaid, may be recovered
by tho person incurring tbo samo of
the owner of said creature in any ac
tion therefor.
She. 4. Jf any maimed, sick, infirm
or disabled creature shall bo by any
person abandoned to die in any public
place, such person shall be guilty of a
misdemeanor, and it shall be lawful
for ar.y alderman or magistrate to
appoint suitable persons to destroy
and remove such creature, il unfit for
further itso, at tbo cost of the owner
thereof, recoverable before tho said
aldermen or magistrate thereof.
Sec. 5. Any policeman or constable
of any city or county, or any agent
for the Pennsylvania Society for the
I'rcvetijion of Cruelty lo "Animals,
shall, upon his own viow of any such
misdemeanor, or upon tho complaint
of any other person who may declare
his or her naino and abode to such po
licemun, constable or agent, mako ar
rests and bring beforo tiny alderman
or magistrate thereof t.ll'eiidcrs viola
ting the provisions of this act.
