Slici ill's testimony
'1 be following is tho statement of
the Sheriff of Mitchell county, sworn
to by himself and other prominent
citizens. It is addressed to tho mem
bers of the Legislature :
On Saturday, the PJth inst., it was
made known to tho citizens that
John Murphy, of Albany, (ia , had is
sued a circular nnd secretly circulated
the sumo amonir the colored men ot
. . ? ., . i
this county, ordering thorn to bring
their arms with them to a politico
meeting advertised for that day ot
this place. The information was cor
roborated by statements made by
ltobert Cochran, Sr., Thomas Jones
and others, who came from the road
in tho direction of Albany, stating
that armed negroos were assembling
in largo numbers at China Grove
Church, waiting for tho delegation
from Albany, headed by tho said
Murphy and Poorco, candidates for
Congress, who were to bo tho speak
ers on the occasion. At the request
of the citizens, Mr. M. J. Poor, tho
Sheriff, with a committee of six othor
citizens, wont out to meet said pro
cession, and to protest against armed
negroes being marched in procession
in our town, and to stalo to them dis
tinctly, that if thry would lay down
their arms no objection would be made
to their entering the town and holdinij
their political meeting. Tho Shoriil'
delivered this message to Murphy and
Pcareo tho leaders of 'ho procession,
and they replied that they had noth
ing to uo Willi these armed men, tlio
guns belonged to them and they were
in the habit of carrying them when
ever they went. IheMierill replied
as a peace officer it was hit duty under
the law to forbid the assemblage of
armed men at political meetngs, and
assured them that if they entered the
town with their music and banners, of
lowed by armed men as they then were
that there would be a breach of the
peace., and that he would not bere.'pon
sible for the consequences.
Shortly afterwards tho column
moved into the town in regular order,
headed by l earco, tho (white), in a
buggy, armed with a doublebarrcl
shot gun and a Spencer rifle, and two
pistols, with a quantity of amumlion,
h was afterwards ascertained j next
followed a co!n of wgro men, on toot,
of between three and four hundred,
attended by abuut twenty mounted out
riders. At least one half, if not two
thirds, wero armed with guns, and
most of them with pistols. The mu
sic was ployinc and the crowd were
noisy and threatening in their con
duct. Murphy and one Philip Joiner,
a negro, were in a buggy in the rear.
As the bead column approached the
square, one ofour citizens, Jas. Johns.
who was intoxicated, approached
within a few feet of the column and
ordered tho music to stop, which was
not done, and the Coluniu moved on.
When about twenty steps from bim
his gun was fired, whether intentional
ly or not is not known, hut it was
pointed in a different direction, and
I ho shot struck the ground about
twelve feet from him. Tho column
fired a volley, some of the shots at
Johns, most of them in tho direction
of Maples store, thirty or forty steps
from the column, at w hich place there
was a numherof our citizens, all un
armed, wounding six of them. Imme
diately, ubout twenty of our citizous
sprang to their arms and fired into the
crowd, by which two negroes were!
Kinca nnu an unknown iiumner woun
ded. The negroes immediately broke
to a thick cluster of limber one hun
dred yards north of the court house.
At this point there was an attempt
made by Prareo to rally his routed
forces. Our citizens, to tho number
of about thirty, a part of them being
mounted, immediately made a charcro,
and completely rooted the w hole force,
Pearce flying through the woods and
fields, Murphy and Phil Joiner esca
ping in a buggy up tho road towards
Albany.
Seven negroes were killed, and from
tho best information we have bocn
able to procure, between thirty and
forty were wounded, all of whom have
been properly cared for. It ia a
source of deep regret that the calami
toils consequence of this afTair foil
exclusively upon tho poor deluded
negroes, led on by wicked w hite men.
Murphy, Pierce and Putney, mnde
gnod their escape in the hour of dan
ger, with but littlo injury to them
selves. This sad result is to bo
attributed more to the sharpness than
shrewdness of their gallant leaders in
effecting their escape, than to atten
tion on the part of our people We
hereby disavow any purpose, or inten
tion on the part of ourselves or our
citizens to violate luw or tho peace of
inornate in what was done. Me
wero willing, and so expressed our
selves to these leaders, for them to
hold their political mectine at tho
Court lloiisu in our town if tho no-
Kr"''' wen disarmed ; but wo did
think, and still think that it was our
duty to o
bey the orders of the Sheriff,
a civil oflieer of this Suite, in break
ing up this unlawful as embhige. We
felt, as their null, hers vastly exceeded
that ol our citizens present, that hud
this meeting taken plaei,, the hv.s of
our wires and children would be at the
mercy of an infuritated vmli, while its
