The election in the district composed of the bor
ough of Sbippensburg, Sbippensburg township, and
that part of Southampton township not included in
the Leesburg election district,'will bo held at tbo
Council House, borough of Sbippensburg,
And In and by an act of the General Assembly of
this Commonwealth, passed (he 2d July, 1839, it is
thus provided, * 1 That (ho qualified electors of parts
of Nowton and Southampton township in the coun*
ty of Cumberland, bounded by the following lines
nnd.distances, viz: Beginning at tbo Adorns county
Hne.lhenco along the lino dividing the townships of
Dickinson and Newton to the turnpike road, theneo
along said turnpike to Centre School House on said
turnpike, in Southampton township, tbcnco lb a
point on the Walnut Bottom road at Reybuck’s, in
cluding Roybuck's Farm, thence in a straight di*
rectlon to the Saw Mill, belonging to the heirs of
George Clever, thonco along Kryshcr’s run to the
Adams county line, (hence along the lino of Adams
county to (ho place of beginning, bo and the same is
hereby declared a now and wperatc election district,
tbo election to bo held ol tho public house.of Wm. ;
Maxwell in Leesburg* Southampton township."
Wolico is Hereby Given, ,
That every person, excepting Justices of the
Peace, who shall hold any office or appointment of
profit or trust under the United Stales, or of this
State, or any city or Incorporated district, whether 1
a commissioned officer or otherwise, a subordinate
officer or agent, who is or shall be employed under 1
the legislative, executive, or judiciary departments 1
of this Slate, or of the United Slates, or of any in
corporated district; and also that every member of i
Congress end of. the Slate Legislature, and of the 1
Selector Common Council of any dily, or commie* '
■ioaer of any incorporated district, is by law inoa-.
pable of holding or exercising at the same time, the
office or appointment of judge, inspector or clerk of
any electrons of this Commonwealth, and that no
or any other officer of such election
•hall be elegibla to bo then voted for.
And the said aoi of Assembly, entitled an act ro-|
Sating to the elections of Ibis Commonwealth, passed i
July 2d, 1833, further provides as follows, to wit:
“That the Inspectors and judges shall meet at the
respective places appointed for holding tho election
in (he district to which they respectively belong, be
fore 9 o'clock in the morning of tho Second Tues
day of October, and each of said inspectors shall
appoint one cleric, who shall be a qualified voter of
such district.
"in case the person who shall have.received (ho
■ooond highest number of voles for inspector, shall
hot adena on the day of the election, (hen (ho per*
son who shall have received (he second highest num
ber of votes forjudge at (ho next preceding election
shall act a* Inspector in his place. And in case (ho
person who shall have received the highest number
of votes for inspector shall not attend, the person
elected Judge shall appoint an inspector In his place;
■nd in esse the person elected a judge shall not at
tend, then.the inspector who received the highest
number of votes shall appoint a judge in his place;
or if any vacancy shall continue in the board for.

the opening of the election, the qualified voters of
the township ward or district for which such officer
shall have been elected, present at the place of dec*

# htll be the duty of the several assessors re
spectively to attend at the place of holding every
general, special or township election, during the
whole lime said election Is kept open, for the pur
pose of giving Information to the inspectors and
judges when called on in relation to the right of
any person assessed by them to veto at such election,
or such other mailers In relation to the assessment
of voters as the said inspectors or either of them
•ball from time to time require.
No person shall be permitted to vote at any eloc
ution as aforesaid, than a white freeman of the age
of twenty-one years or more, who shall have redded
in (his Stale at least one year, and In the eleatlon
district whore he offers his vote at least ton days
immediately preceding such election, and within
two years paid a Slate or county tax, which shall
‘ have been assessed at least ten days before the elec
tion. But a oillion of (ho United Stales, who has
previously been a qualified valor of (his Slate, and
mmoved therefrom and roturnod,ond who shall have
resided In (he election district and paid taxes afore*
■aid,'shall bo entitled to vote alter residing'!:* this
Stale six months: Provided, That (ho while free
men, citizens of the United States, between the ages
of (wooly.qne and twenty-two. years and. have re.
sided intho election district ton days os aforesaid,
shall bo entitled to vote although they shall not.have
paid taxes.
No person shall.be permitted (p vote whose namp
Is not contained in the list of taxable inhabitants
-furnished by. the commissioners, unless, First, ..ho
ho produce a receipt for the payment within two
years, of a State or county-lax assessed agreeably
to (ho coNstitution* and give satisfactory evidence
cither on his oath or affirmation or tho oath dr-affir*
malion of another that ho has paid such a tax, or
on failure to produce a receipt shall make oath to
the payment thereof. Second, if ho claim a right
to vote by being ah elector between the ago twenty*
ono and twenty-two ycarp. ho shall depose on oath
or affirmation that ho has resided In the State at
least ono year next before hla application, and mako
such proof of residence in tho district as is required
by this act and that he.docs verily believe from tho
account given him that ho Is of tho ago aforesaid,
and such other evidence as. is required by this abt,
whereupon tho name, of tho person so admitted to
vote shall be insetted in tho alphabetical list by tho
inspectors, and a note made opposilo'lhoreto by wri
ting tho word 'tax,* if ho shall bo admitted to yoto
by reason of having paid tax, or the word 'ago, 1 if
ho shall bo admitted to vote by reason of such - ago,
shall be .called out to tho clerks, who shall make
the like notes In the lists of voters kept by them.
In all cases whore the name of tho person claim*
ing to vote is found on the list furnished by the
commissioners and assessor, or his right to voto
whether found thoreon or not, is objected to by any
qualified citizen, it shall bo the duty of the Inspec
tors to examine such person on oath as to his quali
fications, and If he claims'to have resided within
the State for one year or more, his oath shall’be
sufficient proof thereof, but shall make proof by at
least one competent witness, who shall be a qualified
elector, that ho has resided, within tho district for
more than ten days next immediately preceding said
election, and shall also himself swear that his bona
fide residence, in pursuance of his lawful calling, is
within the district, and that ho did nut remove into
said district for tho purpose of voting (herein.
Every person qualified as oforesaid, and who
shall mako due proof if required, of his residence
and payment of (axes as aforesaid, ho shall be ad
mitted to voto in the township, ward or district In
which ho shall reside.
, If any person shall prevent or attempt to prevent
any officer of any election under this aclfrom hold
• ing such election, or uso or threaten any violence to
any such officer, or shall interrupt or improperly in*
torforo with him in the execution of his. duty, or
shall block up.tho window or avenue to any window
where the same may be. holding or shall riotously
disturb the peace, at such election, or shall use or
' practice any intimidating threats, force or violence
with.design to influence unduly or overawe any elec
tor, or to prevent him from voting or to restrain the
freedom of choice, such person on coviclion shall bo
fined in any sum not exceeding five hundred dollars
add be imprisoned for any time not less than throe
nor more than twelve months, and if it shall be
shown to the court, where .tho trial of such offence
shall bo had, that the person so offending was not a
resident of the oily, ward, district or township where
tho offence was committed, and not entitled to vole
therein, then on conviction, ho shall be sentenced to
pay a fine of not less than one hundred nor more
than one thousand dollars, and bo imprisoned out
• less than six months nor more than t\yo years.
i If any person or persons shall make nny bet or
[ wager upon the result of any election within the
Commonwealth, or shall offer to make any such bet
or wager, either by verbal proclamation thereof, or
by any written or printed advertisement challenge
or invito any person (o make such bet or wager,
upon conviction thereof, he or they shall forfeit and
pay three timea the amount so bet or to bo bet.
If any person not by law qualified, shall.fraudu
lently vole at any election in this Commonwealth,
or being otherwise qualified, shall fraudulently vote
out of bis. proper district, or if any person knowing
tho want of such qualification, shall aid or procure
such person to vole, the person offending shall, on
conviction, bo fined in any sum not exceeding two
hundred dollars, and be Imprisoned for any tcim not
exceeding three months.
If any person shall vote at more than one election
district, or otherwise fraudulently vote more than
once on tho same day, or shall fraudulently fold and
deliver to the inspector two tickets together, with
the Intent Illegally to vote, or shall procure another
so to do, ho or they offending shall on. convict lon' be
fined in any sum not less than .fitly nor moro than
five hundred dollars, and bo imprisoned for a term
not less than three nor more than twelve months.
If any person hot qualified to vote in this Com
monweahh, agreeably to law, (except (ho sons of
qualified citizens) shall appear at any place of elec
tion for the purpose of issuing tickets or of influen
cing the citizens qualified to vole, he shall on convic
tion forfeit and pay any sum not exceeding one
hundred dollars for every such offence, and be im
prisoned for any term not exceeding three months.”
Agreeable to tho provisions of tho .sixty-first see
lion of said act, every General and Special Election
shall bo, opened between the hours of bight and ten
In tho forenoon, and shell continue without inter
ruption or adjournment until seven o'clock in (ho
evening, when the polls shall bo closed.
And (he Judges of the respective districts afore
said, are by the said act required to meet at (ho
Court House, in tho borough ofCarlisle on (ho third
day after (ho said day of election, being Friday the
17th day of October, then and there'to perform the
things required of them .by law. I
