Taxes on Tobacco, Snuff and Cigars. SUPPLEMENTAL REGULATIONS TREASURY DEPARTMENT, OFFICE OF INTERNAL REVENUE : Washington, October 27, 1868 The Secretary of the Treasury fired the 23d day of November, 1868, as the day when all the provisions of tho law relating to Oro use of stamps upon to bacco, snuff and cigars should take of. fect, These stamps will be as follows: 1. Stamps for tobacco and snuff of twelve denominations, viz : ono half pound, 1 pound, 2 pounds, 3 pounds, 5 pounds, 10 pounds, 20 pounds, 30 pounds, 40 pounds. 50 pounds, 60 pounds, and 100 pounds. 2. Small stamps fur cut tobacco and snuff, in packages of one-half ounce, 1 ounce, and 2 ounces, of the 32 cent class, and 2 ounces of the 16 cent 3. Strip stamps for cut tobacco and snuff in packages of 4 ounces, 6 ounces, 8 ounces, and 16 ounces of the 32 cent class, and 4 ounces, 8 ounces, and 16 ounces of the 16 cent class. 4. A stamp for tobacco intended for export as required by section 74, act of July 20, 1868. 6. Cigar stamps for boxes contain ing 25, 50, 100, 250, and 500 cigars respectively. Those must be used both for domestic and imported cigars and for cigarettes weighing over three pounds per thousand. 6. Stamps for cigarettes weighing three pounds or less per thousand and taxable at $1 50. Until additional stamps shall bo found necessary, only ono will be prepared suitable for boxes of five hundred each. These stamps will be furnished to collectors upon requisition, and, with the exception of the exportation stamp, will bo sold to manufacturers at their full value as indicated by the tax on the quality represented by each. For each exportation stamp 25 cents will bo collected when the entry is made for the transportation of the tobacco to an export warehouse. If these stamps aro delivered prior to November 23, collectors may sell them to the manufacturers, who may immediately commence their use. Monthly Returns The monthly returns of tobacco and 4 cigar manufacturers for the month of November must set forth the whole quantity sold during the month, the number of cigars stamped by •the in spector under the old law, and also the quantity upon which tax paid stamps were affixed, and the tax will be assessed only upon the quantity sold without tax•paid stamps. When stamps have been supplied, the returns of tobacco and cigar man ufacturers will no longer be put upon the assessment list, or be receipted for by collectors on Form 23i. Reworking of Tobacco not Allowed Under the act of July 20, 1803, no provision is made for the reworking or re-handling of spoiled tobacco after .the same has been stamped. Absence of Stamps Prima Facie Evi dence, &c. Tho absence of proper stamps on any- package of manufactured tobacco or snuff, or on any box of cigars, sold or offered for sale, or kept for sale, (sections 70 and 90,) is declared to bo notice to all persons that the tax has not been paid thereon, and to be prima facie evidence of the non-payment thoreof, and such tobacco, snuff, and cigars may bo forfeited. It is enjoined upon all assessors, as Boon_ as stamps are provided, to make, through their assistant assessors, a thorough canvass of their several dis tricts for the purpose of obtaining full And accurate inventories from all deal era of tobacco, snuff and cigars, of tho stock on hand on the Ist day •of Sep tember. Any person who shall sell, or offer for sale, tobacco, snuff, or cigars, not properly stamped and cancelled after the day fixed for the use of stamps, (September 23,1868) and which have boon included in any monthly inven• tory required by section 78 and 94, or any person selling, or offering to sell, the same, who has neglected or refus ed to make such monthly inventory, will be liable to the presumption of having violated the law, and upon complaint made-against him the bur den of proof will be upon him to show why proceedings for the forfeiture of the goods belds by him without hav ing the proper stamps affixed should not be commenced. Mixing and Cancelling Stamps. By virtue of the provisions of the act of July 20, 1868, it is hereby pre. scribed that the affixing and cancella tion of stamps placed on packages con taining tobacco, snuff and cigars, shall be done in the following-manner, viz : Affixing.—Tho stamps aro he affix ed to the packages by using such ad hesive material as will cause them to stick to the wood, paper, or other package securely and permanently. Cancellation.—Section 67 requires that stamps used on any wooden pack age shall be cancelled by sinking a portion of the stamp into the wood with a steel die. This should be at least one inch in diameter. Tho export stamp will be cancelled in the same manner. The small stamp for cut tobacco and snuff, in packages in one-half ounce, one ounce, and two oundes, and the stamped foil wrappers, must bo can called by writing or imprinting upon each stamp the manufacturer's or pro prietor's name, and the date of cancel lation, The strip stamps, for tobacco and snuff will be cancelled in the same manner, and, in addition thereto, each strip stamp mat be so affixed on the package that in opening the same or using the contents thereof, the stamp shall be effectually destroyed. The strip stamps for cigars in boxes will be cancelled by the use of a sten cil plate of brass or copper, in which there shall be cat not less than six waved lines, long enough to extend not less than three quarters of an inch beyond each side of the stamp on the box. XlO to Affix and Cancel Stamps When stamps are affixed and can celled before removal of the packages from the manufactory, ,the work of af fixing and cancelling must be done, or pane to be dorie, by the manufacturer. When tobacco or snuff in bond are to be withdrawn from an export, or Class B, bonded warehouse, after the tax has been paid thereon, the proper stamps must be affixed and cancelled under the supervision of the storekeep er as herinafter directed. at.(A. a.(3€3.
