- MUSIC IN CHURCHES.
An interesting question, defining tiurrela
tire powers and duties of Church Sessions
and fokiards of Trnstbeel, under the Presby
terian leorm of Church Government, has
just been decided by Judge Pierce, of the
Common Pleas of Philadelphia. The Wal
nut Street Presbyterian Church proposed
several amendments to its charter, among
which was the following :
"The said Trustees shall have power to
appoint an organist (subject to the approval
of the session,) a sexton, and any other pfx
sons they may think necessary for the in
terests or convenience of the corporation,
and to pay their salaries."
The congregation had become divided in
sentiment on the subject of - elnploying a
paid choir, and exceptions were filled to the
amendments on the ground that the music
of the church was a part of the religious
serviced sad should be subject to the con
trol of the Session ; that the Trustees, whose
duties relate 'exalts/rely to the temporal af
fairs of the church, ought to have no voice
in the election of any one appointed to con
duct the worship of the house of God. It
was futher excepted that the Trustees, un
der the aforesaid clause, claimed the right
to introduce a paid choir, in opposition .to
the wish of a majority of the members of
the congregation. .-
Judge Pierce, in deciding the question as
to the relative duties and powers of True,
tees and Climb-Sessions in the Presbyter
ian Church, quotes limn the acts and deliv
erances of the General Assembly of the
United States, and adds :
"It will he twceived.from these standards
of authority in the Presbyterian Church
the spiritual government of the congrega
tion; Itet l 4 ll 4 theo l bl; iongdp, licom
milted to tbe.nrinister and church aessipn.
It is usual to commit the temporal interests
of the coneeption and the custody of the
church property to the care of the trustees,
though these interests may bemannted by
the congregation at large. The object of
the association of the Walnut Street C arch,
as set forth in the character, is the worship
of God according to the usages and forms
of the Presbyt eria n Church. This directs
the mode of the worship and prescribes
who'khall have control of it. It is a Pres
byterian Church, and is to be governed in
its wonhip by the usages and &arms of That
Church. The duty of directing that is com
mitted, by the laws of the Church, to the
minister and church session.. A majority
of the congregation, however mitaaroas,
cannot direct otherwise, or give to the trus
tees a power to control or a&ct the public
worship in any nurturer whatever. This is
according to the forms and usages of the
Presbyterian Church, and is declared by the
highest judicatory in one branch of the
church to be the fundamental law of the
church."
'Applying the fendamental law of the
Church to this case, theludge decided that
the exceptions to the proposed amendment
were well taken and must be sustained. It
Is thus held to be a violation of the funda
mental law of the Church for the Trustees,
even with the approval of the Sesaion, to
appoint an organist. If provision be made
by the congregation, or the trustees; or the
employment of an organist, the exclusive
power of appointment, direction and re
am:mai of him belongs to the Churn &s
-alon, otherwise t h ey katre notthat direction
of The public worship which, by the law of
the Presbyterian Church, is committed $o
them. The same objections apply to that
other portion of: the proposed amendment
which empowers the trustees to appoint
"any other person they may think necesary
for the interest or convenience of the cor
poration, and to fix The salaries ;" if it be
intended, as is alleged, to Trovide thereby
for the employment of a choir to assist in
the church music.
In regard to how far majorities may go in
church matters, the .lbllowing proposition
were laid down :
In general organizations of united
churches the law of the general organism is
binding on all the individual churches, and
even a majority see ding last all the/1 . 11E41s
in the church property. The majority may
control consistently with the laws of the
organism, but not in violation of them.—
The question is not which party has the
majority, but which is right according to
the law by which the body has hitherto
consented to be governed.
