COURT DOINGS.—But two cases were
disposed of in Common Pleas last week, 'viz :
Peter Diehl vs. The Adams County Fire
Insurance Company —Action - to recover
amount of Policy of Insurance on Tannery.
The insurance had been granted on a Tan
nery without *team. Subsequently Mr.
Diehl leased the Tannery to his sons, who
put up an engine and operated the Tannery
by steam. A few months thereafter a pcir
tion of the buildings burnt down. The Com
pany declined to pay because of the conver
sion into a steam Tannery without its con
sent. On trial, Plaintiff offered to prove
that he had given notice to the Company of
the intended change—that one of the Mana
gers had examined the premises—that an
assessment had been made on the Premium
Note, 6:c., which offer was overruled by the
Court, on the ground that the Policy itself,
which was the evidence of contract between
the parties, expressly provided that the
change should suspend the policy, unless
such change were made by consent of the
Company and endorsed on the Policy. No
tice of change was not sufficient. Nor was
it in the power of an Agent or Manager to
change the contract. The Jury under in
struction of the Court, rendered a verdict
fur Defendants.
Jonathan 13. :Myers vs. Gibson Myers—
Summons in Partition. Plaintiff claimed
the undiVided half of a tract of 66 acres of
laud, with improvements, in Reading town
ship. Defendant resisted on ground that
Plaintiff had; not paid one-half of the pur
chase money. Verdict for Plaintiff, that he
have equal partition of the lands.

quently tried and found &illy, but new

Mr. Vtat WycK, and goes into a detailed
examination of the origin and progress of
the swindle, as given by witnesses examined
before the Committee, including some of
the originators of the scheme: `,The Report
is too lengthy for our columns, but we give.,
the substantial facts; It seems *at a prowl.
nent and wealthy tobacconist of,!New ;York.
John Anderson, during the war, invested
largely in diamonds'. A portion of them
were tainted With fraud, and Mr. - Anderson
instituted criminal proceedings, against the
parties who had swindled him.. After the
war these diamonds, purchased with gold at
200 and 20,-raPidly deprerilate4l, and. Ander
son and his friends oast about fo; some expe
dient to make themselves "whole." Calling
in R. France, P. A. Edgerton and S. T. Dick
inson; well known professional lottery .gam
biers, it was determined to get up a lottery
'scheme, with the ostensible object of bene
fitting disabled soldiers. To make. the
scheme more plausible an Agent was sent
on to Gettysburg to purchase's portion of
the battle-field as the site of the centemplared
Asylum. The next thing was to get an Act 1
of Incorporation. Ex-Recorder . Smith, an
minent lawyer of New Yoik, Who had long
been counsel for these lottery gatnblers, was
consulted, who in due course of time advised
them that it would be impossible to get an
Incorporation from the Legislature of New
York, by reason of the prohibiting clauses
in the constitution. He was than requested
to-examine to the constitutions of other
.States, to see where the way might be clear
for them. In due time' Judge Smith re-
ported that the State of Pennsylliania had no
uch prohibition. „These charitable patriots
at once directed their. steps to liarrisburg,
where masking their real purposes and mov
ing in the shadoW of the names kff Generals
Meade and Pennypacker asineorporators,
with a promise of $300,000 for the establish
ment of an Asylum at Gettysburg, they pro
cured the charter, which is now ! the subject
of litigation in the Supreme Court.. Mr.
Anderson at once paid $lO,OOO into the State
Treasury, and a meeting of the Trustees was
called, winch was _attended by but one of
the corporators named in the bill—Generals
Meade and Pennypacker knowing nothing
of it. The charter thus secured, the mask
Ls thrown off, and the master spirits step up
on the boards, Messrs. France, Edgerton and
Dickinson undertaking to run the machine.
The charter provided that before each dispo
sition of property $lO,OOO should be paid in
to the State Treasury. This contemplated 30
different dispositions before the $300,000 could
be realized. As the first disposition contem
plates the sale of tickets to the amount of $l,-
2Q0,000, it is easy to see that by the time the
"Gettysburg Asylum" would realize its
e 300,000, somebody else would realize in the
neighborhood of $30,000,000! For every
SIO,(N paid over to the Asylum, these patri
otic corporators would pocket :over half a
million! Mr. Yau SV'vek, in further expo
sition of the scheme, shows that Anderson's
diamonds, for which Ile claims to have paid
$150,000, (and a swindle that,) are put in
the scheme at $306,000, while a farm in Mr.
Van Wyck's own district, assessed at $3,500,
is advertised as worth $60,000! So with
other prizes.
As soon as General Meade's attention Viras
drawn to the scheme, with which his name
had thus been associated, he add Yessed Mr.
Brewster, the Attorney General, who at once
took steps to arrest the swindle. Anderion,
alarmed lest his diamonds, then on exhibi
tion in Philadelphia, should be seized by
the police, removed them to N`ew York,
where the parties opened shop under cover
of the charter granted by the Legislature of
Pennsylvania=—France & Co. retiring from
the active{ manag / ement, and a Mr. Hitch
cock. whO had been previously 'successful
in gift enterprises, taking charge of it. Mr.
„Hitchcock testifies that thus far the scheme
'has been a failure, by reason of the.public
denunciation acid mistrust—that the expen
ses have been about $BO,OOO more than the
receipts, only $20,000 having been received.
Postmaster General Randall, who had giv
en the enterprise his endoriement, recom
mending it as a "truly patrßaic and benevo
lent enterprise," has withdrawn his recom
mendation, as .appeal's by the December
number of the U.B. Mall, which !says :
"We are authorized by the Postmaster
General to say, that at the time he was in
duced to sign this recommendation he be
lieved the enterprise was a praiseworthy
one, and intended to aid a noble charity ; but
that he has become convinced• that the
scheme hes been perverted to fraudulent
purposes, and he desires to withdraw the re
commendation he then made."
The Committee are pretty severe on John
H. Diehl, Collector of the 2d District, Phila
delphia, on whose certificate Commissioner
Rollins granted the exemption from taxes,
and close by recommending the adoption of
the following'resolution :
Resolved, That the 'Commissioner of In
ternal Revenue be - requested to revoke the
permit heretofore given exempting the
scheme known as the Gettysburg Asylum
for Disabled Soldiers from pegiment of spe
cial tax and license,
said revoTation to take
effect from :Slay
,2S, 1867, aud that taxes and
license be collected from said asso6iation the
same as if no permit had ever been given.
SLEIGH-AID E.—Our goo&natured
friend, NrcrioLAs WEAVER, who .is in the
habit of doing clever things, on dno of the
bright, sunshiny days of the past week, sent
word to the officers and children Of the Na
tional Orphans' Homestead, that it was his
purpose to treat them to a sleigh` -ride. In
due time some four or five hugil=glisighs, ca
pacious enough to receive all connected with
the establishment, old and young; appeared
at the Homestead, marshalled by Mr. WEA
VER himself—the hories gaily dedked with
nags and oVerything calculated to delight
the little ones. As the large cavalcade
passed through our streets,Vith the merry
jingle of the bells and.the joyous notes of the
children, S'inging as they went, it attracted
much attention. We believe this is the
third ride Mr. WEAVER has giveU these or
phan children of the Nation's heroes, and
we are requested, on behalf of the officers
of thr Institution and the children, to return
to him their most dordial, thanks. ,

since Mr. A. Speer of Passaic, N. T., present

In our turn, we presented it to a friend who

marked benefit from its use. We find that
many invalids in this city are using Speer's

EARNINGS OF THE COMPANY
At present, the profits of the Company are derived
only from Its local traffic, but this is *heady much more
than suißcient to piny the latarest on all the Bonds the
Company can issue, If not another mile were built. It Is
not doubted that when theund le completed the through
traffic of the only line connecting the Atlantic and Pacific
Stater will be large beyond precedent, and, u there will
be no competition. it can always be done at prolltaple
rates.
• It will be noticed that the Union Peak Railroad is, in
fact, a Government work, built under the supervision of
Government officers, and to a large extent with Govern
ment money, and that Its bonds are iareed under Gov
ernment direct km. It is believed that no similar recur
ity is so carefully guarded, and certainly no other is
bailed upon a larger or more valuable property. As the
