' the statute, and if there Is a doubt as to I
their right thus to do, have that doubt
resolved by a judicial decision, and not;
to act on this scheme and assume that, I
by artfully contrived phrases and ambig-

repeal a portimi of the criminal law of
the State; and create again a system of
gambliug diatomic., likes pestilence pre- I

honorof the Commonwealth, and against i
1 which advancing Christian elyiliza- •
tion raised its voice, and a system I lint '

in all its forms is allowed by law.
1 Second—The acts of the first meeting
were .not legal. A..majorit,:,% of the cor
porators were not p resent, and the statute
does not give authority to 11 corporator
to delegate litapower to any one.
- Thi.n—The supervisors, having been
i created at that fiat meeting, were crea- !
ted by those who had no power to create '
them ; and I will further add that, had
the meeting been properly and legally
held by the corpurators, they could not
have created such a body of supervisors,
and given tolhem the power that is giv-
en to them by the by-laws, and surren-
I dered to them for a consideration the
important franchises of the corporation.
Among the supervisors chosen there is
not one of the original corporators select
ed by the Legislature, but they are men
who have long been known us lettery
venders and whose names are nototious
' ly connected with lottery grants in Other
States.
Fourth—l have read the statute, I have
read the minutes, I have read the lty;
laws, and I have 'read the proposed
scheme, and it is my opinion that 'the
t statute does not authorize any such
scheme; and as Attorney General, I re-,
quest you, as president of the corpora
tion, to give these corporators notice that
I will resist the execution of that scheme
by prompt legal proceedings.
I believe I have substantially compiled
with your request. At your proposed
meeting on Tuesday yo 'u can treat the
