Memorial Day in Kbensburg was on
set ved w ith the usual appropriate '-re-inonies,
tlii1 parade forming at oui-o'clock
ill the opera house and inarching to the
court house w here Hon. A. V. Matker de
livered an address.
After the address the parade formed and
marched to the several cemeteries in this
place w here a Hag and wreath of flowers
were placed on each soldiers grave.
I n t he evening a camp liie was held at
the court house w here Rev. C J. I-'eight
delivered an address.

Thomas Cush, w ho was shot by Harry
Marsh .a tramp, at Johns town, on Mon
day of last wick, mention of which was
made in last week's Fkkkman. died on
Friday morning. After his death a charge
of murder was made hy Constable Logan,
of the Fifteenth warn. Iiefore Alderman
Mums. A coroner's iinjue-t was held and
a verdict that "Thomas Cush came to his
death hy a bullet lired from a revolver
held in the hands of Harry Marsh.'
Marsh is 'S.l years of age and was brought
to jail on Saturday.

however, in the appointment of a court
house janitor.

Chester county has recently had a suit at
law over division farm fences, the solution
of w hich has effectually atlirmed the force
of the act of lsj' so fiir as it relates to this
class of fences. Hi this suit the plaintiff
and defendant own adjoining farms. The
plaintiff was dissatisfied w ith the charac
ter of a piM tion of the division fence main
tained hy the defendant, and taking action
under the act of 1S4-, called the auditors
of the township, w ho, hy the specilic pro
visions of the act. became the fence view
ers of the township. After tieing duly
sworn, these fence viewer carefully ex
amined the feme iu dispute, ami after de
liberation made the following report:
That Mr. Kobcrts. the plaintiff, maintains
KM panels of fence and Mr. Sarchet, the
defendant ll'.i panels. That Mr. MoU-its"
fence is a suflicieiit and lawful fence, but
ot M r. Sarchets" fence Ti panels were not
suOi cieiil and law Inland needed re-set ting
with new posts, ai d r.l panels reiiiired re
pairing. "We hereby decide and direct
that Joseph Sarchet proceed within ten
days to reset ami repair the said fence at
lils expense ar.il complete the same in a

After t he lapse of t w el ve days Mr. Sar
chet having made no move towards re
pairing the fence, the fence- v iewers di
rected Mr. Wyalt to make the necessary
repairs, ami ordered t lie expenses charged

brought to recover the hill for repairs,

On hearing the case an i considering the
evidence. Judge Hemphill decided in favor
of the plaintiff, and ordered the ilefemiant
to pity the hill for repairs, ami iu making
this decision the judge very distinctly
ruled that t he repeal of I he general fence
laws of lToii ami l?t- iu no way affected the
provisions of I he act of March lllh. 1 '.

Robert Pitciiirn. superintendent of the
Pittsburg division of the Pennsylvania
railroad, said al Pittsburg on Tuesday
that the question as to what kind of a
bridge was to lie built at Conemaugh was
entirely iu the hand- of t In-olli. ial- in
the genet ill office of 1 In-com pan y at, Phila
delphia. Some kind of ;i structure w ill be
necessary to take the place of the tempor
ary bridge built at thill point. So much
money will be involved, how ever, t hat con
siderable time will be necessary to reach
a final deef ion.
The place was to have been inspected
on Tuesday, preparatory to reaching some
conclusion, but as the decision w ill be
made only after a t borough investigation,
it may be some time before anything is
done. Danger of high w atcr is t bought to
be over for t his season, and l he struct tin
built last week will answer all purposes
for some month at least. Consulting en
gineers have been on the ground. Mefole
taking definite action all 1 In-plan-w ill
have to be ratified by the general officers.
Meanw hile the temporary structure has

almost completed. The plan adopted w as

Flmer tirant, the well know n pugilist,
who was liorn and taiscd in Johnsiown,
died at his home it: Reaver Falls
on Sunday morning, aged .'!.". years.
He had suffered much for a long time from
catarrh of ihe stomach, which baffled the
skill of the medical fraternity. His case
is a remarkably sad one; from a rugged
athlete of -".'. pounds of clean bone and
brawn, he wasted away until at the time
of his death, he weighed a scant one hini
h ii ml red pounds Mailing the usual fail
ings of men given to such a life, he had
qualities of a character that made many
friends and kept them; he had a kind
heart and had his lines fallen iu different
p'aces he would probably have left a re
spected memory. The deceased leaves a
wife and three children.

sylvania State Fdiloriul Association have
decided ii (ion the summer excursion for
July 2nd tit '.ith. The trip will he made lo
Ashbury Park, N. J., and as the annual
meeting of the National Editorial Associa
tion occurs at the same time and place,
this w ill no doubt tm the most important
and entertaining summer outing of the
State Association for many years. It is
proMsed to have all who participate in
this excursion rendezvous at Philadelphia
on Monday night, July 2nd, and leave
Rroad street station in a body by special
train for Ashbury Park on Tuesday morn
ing. July 3rd.

On Monday the Republican county con
vent ion met at the court house and was
called lo order hy Chairman Dr. J. S. Tay
lor. One hundred and forty-eight dele
gates responded when the roll was called,
and F. Y. Jones, of Johnstow n, and T. C.
Patterson were elected temporary secre
taries. Anderson 11. Walters, of Johnstown, was
elected chairman over A. M. Coont, of
Coopcrsdale, by a vote of .Vf to After
electing the temporary secretaries as per
manent secretaries, the convention got
(low u to business and proceeded to make a
noun nat ion for sheriff.
David W. Coulter, of Franklin; Samuel
W. Davis, of KlH-ushurg; Samuel M. Mill
er, of Johhslow u. and James T. Young, of
Ftichsburg. were each placed in nomina

that the claims are to he paid hy the
school lioaid of f-iich township. For the
last few ears i t. has been the custom and
w as made so by an act of the legislature,
that the school hoards of each township
or Ixiroiigh iu the county should levy all
dog taxes, collect all money and pay all
claims for damage done to sheep by dogs.
In May, ls'.i:t. an additional act was passed
which gave the power to lay an.l collect all
taxes ami to settle all claims into the hands
of the county commisiouers. The new law
look effect June 1. 1 S'.CS. The layv was not
know ii by tin- hoards of directors generally
throughout the coumry and the hoards
continued to lay the taxes. Lately it
came to 1 heir know ledge that the power
lay in tin- hands of the comiiiissioiiers. and
w hen application was made to them for
claims by those who lost, sheep they had
t hem forwarded through the justices of
the peace lo the county- commissioners.
The comiiiissioiiers have decld -d that
since the levy was made hy the school

they have the right to pay all claims. In
asmuch as no money has been received
through the county treasurer for dog
taxes, the comiiiissioiiers claim they are
not jusi itied in pitying the claims. All the
claims received by thecolliinissionel s were
returned to the justices to lie given to the
school boards for settlement. If he
school boil ids refuse to settle them, on the
plea t hat the law places I he pow er ill the
hamls.of the coinmissiiiiiei s, a lawsuit may
result. After June 1. ls'.M, all the dog
taxes will lie levied hy the commissionei s

earnest Patterson delegate front one of
the northern districts was tailoring hard
try ing to convince a delegate who was in
clined to vote for Roberts lo change his
views. He said "We don't want new men;
we want men of experience. Stineman has
served one term and Patterson was there
as doorkeeper and knows as much about
the business as Stineniaii. Yote for Pat
terson and we'll have two men that have
had experience."

successfully defy the aggressions of the

assured, the question of wages will lie eas
ily adjusted. As the world was created
