A brief session of the Klair county
court was held at llollidayshurg last Kri
dav. Hon. A. V. Ilark.-r. of t his place, pre
siding. The case of Frederick .Ia kel vs.
Israel C. Caldwell came up before the
com t on the motion of the defendant for a
new trial. It will be remembered that a
jury at the March court rendered a verdict

services in bringing Caldwell's Cambria

lllrple Appeals.
The case of James M. tiillespie, Df l"p
ler Ytnler township, w hose saloon lie nse
was revoked by Judge Harker on Monday,
will lie cat ie,l to the supreme court.
When the license court met in February
a remonstance was presented against Mr.
Gillespie's petition, but it was so feeble
that Judge Harker at the March term
granted the license. Subsequently a com
munication was received by the judge
from Albert Ream, setting forth that the
applicant had sold liquor to minors, and
swearing to the statements made.
ThereiijMin a rule was granted to show
cause w hy the license should not lie revok
ed. Many w itnesses were examined, some
of whom testified that during (jillespie's
first year as landlord ils'rj) he had sold
liquor to minors; Allien Keam was the
only w itness w ho swore that miners pur
chased liquor at (lillcspie's place in lsti.1,
and his tesliinonv was shattered bv that
of fourteen persons who swore that they
would not believe him on oath.
The testimony was submitted to Judge
ISarker several weeks age. and 011 Monday
he gave his decisiou revoking the license.
In appealing from this decision to the
supreme court (iille-pie questions the
authority of a judge to reyoke a license 011
account of violations under a license
granted two years Ijefore. The testimony
of Keam is not considered of tn'iug of any
account liecause so many w ilnesses testi
fied that he was unworthy of belief. An
other question that Mr. (iillespie wants
decided is. can a judge grant a conditional
license? That is. a license may be revok
ed because of violations under a previous
license.
The necessary papers in this appeal were
tiled with the proper officials on Tuesday.
The supreme court w ill meet in I'iltsburg
in October, at which time it is expected
the case will come up. Meantime Mr.
(iillespie is doing business at the old stand
in I'pper Voder township.
Il is understood that this is the lir-t li
cense case ever carried to the supreme
court from Cambria county.
Mr. (iillespie, beside paying the regular
license fee of f loll and the attorney's fee for
presentation, has been assessed with so
much bv way of exira law yers' hills and
expenses of the hearing that it has cost
him about Jl.il to push the case thus far.
The friends of Mr. (Iillespie say that his
troubles have been caused by Johnstown
parties w ho for business reasons want an

ROSS Died at his home in Elicnsburg
on Wednesday. May Kith, 1'.4. James M.
Koss, in the faith year of his age.
The deceased was lrn in Allegheny
county but came to this county with his
parents when unite young, his father, the
late John Ross, being one of the early set
tlers of IMacklick township. During the
late war the deceased enlisted in Company
(. 11th Pennsylvania Cavalry, and served
nearly four years. He is survived by a
widow and five children. He is also sur
vived by one brother John II. Ross, of
Reynoldsville, Pa., and by three sisters
Mrs. Eliza J. Evans, of Ehensburg. and
Mrs. Edith M. Reyer and Miss Nancy J.
Ross, both of Strongstown. The inter
ment will take place in Lloyd's cemetery
on Friday at ' o'clock, v. si., w ith Capt.
John M. Jones Post O. A. K. conducting
the ceremonies.

A horrible story of poverty, death and
negiect comes from Itigler township:
(ieorge Merrltnen, the husband, is in the
county jail, charged with stealing, as he
alleges, to keep his wife and five children
from starving. OnThursday night last the
wife, residing in a hut with four children,
was alone and gave birth to a child.
Mother and child were found dead at 10
o'clock on Friday morning after informa
tion had been made by the little children
who were ignorant of the caure of their
mother's death. The details of the case
are horrible, but in the absence of reliable
information as to all the facts, further

"Without desiring to enter intoa contro
versy," he proceeds to indulge in a liltle
personality. I fail, however, to see what
the "conjecture" that I "own a farm near
Carrolltow n" or that I follow the occupa
tion of a pedagogue" has to do w Ith the
subject in hand; the condition of t he labor
ing classes.
l!ut he wishes to make a little illustra
tion for my benelit, of course its so much
easier to make little illustrations than ar
gumnets. Let us look at his illustration
for a moment.
He assumes that the opening of a mine
or the starting of a manufacturing works
on the laud adjoining my supposed farm
w ill greatly enhance iis value, which is of
course true not only of mine but of all the
land in the vicinity, on account of the de
mand for it caused by the presence of
population attracted by these works.
Values of this kind are made as welcome
as a cat would make a mouse. It is of
course natural for human sellishuess to
take advantage of this increase in land
values for privats enrichment no matter
what the injury to the general welfare.
Hilton tne other hand what could he more
just than to tax this value which comes
from the presence and growth of popula
tion for public purposes, instead of taxing
the products of labor.
Further on he refers to the man who
started works or opened a mine, a "mo
nopolist who brought all the trouble
about." If he is a monopolist he is such,
not becau-e he did these things, but in
quite another way in which he is encour
aged by our present systems of taxation
both direct and indirect.
In fact my friend J. M's illustration il
lustrates nothing so well as the fact that
he does not understand the single tax
theory. I would advise him to read it up.
As to the un-American doctrines of
Henry (ieorge, etc. Is it un-Ameican that
all men have an equal inalienable right to
life, liberty, and the pursuit of happiness,
or that the producer is entitled to his pro
duct or that a system that condemns w iHii g
workers to idleness and starvation amidst
ex ha ustless resources must evidently be
wrong or that it is letter to give people an
opportunity to work than to feed them in
the soup-house? I think it is brother J.
M. who should hire somebody to kick him
for not posting himself on so important a
subject before he tries to put it down with
an ill-fitting illustration and a contemp
tuous sneer. .1. k.

It is not generally known among the
farmers of this state that there is a tio on
ly offered taxpayers for the planting and
culiva I ion of shade trees along the public
highways. The law was passed in ls7..
and says: "Any person li ible to road tax
who shall transplant to the side of the
public highway on bis ow n premises any
fruit, shade trees or forest trees 01 suitable
size, shall be allowed by the supervisor of
roads, w here roads run through or adjoin
cultivated land, in abatement, of his road
tax. tl for every four trees set out: but no
r vv of elms shall be placed nearer than 7
feet, no row of maples or other forest trees
nearer than r feet, except locusts which
may Im- fto feet apart, and no allowance
shall be made -iiiless such trees shall have
been set out tin? year previous to the de
maud for such abatement of tax, and are
living and well protected from animals at
the lime of such demand." No person
shall lw allowed an abatement on h s
highway tax, more than one-quarter of bi

On Sunday afternoon lire broke out on
the line of the P. & N. W. railroad near
Lloydsyille and soou traveled to a number
of houses owned by the company.
Nine houses and a iiuiiiIht of stabh s
were tiurucu to the ground in a short
space of lime. The lire is now couliiieti to
the timber and there is but little prosf ecl
of getting it under control until there is a
shower of rain.
The tod house belonging to the railroad
was also burned and for a time several
h tndred freight cars that were standing on
the siding were threatened with destruc
tion but on account of the low wind pre
vailing, escaped.
