miles in length, and extends from ("resson
('ainhria county, to Irvoua. Clearfield
county. It has two hranches running to
coal mines, and traverses a country ricli
in coal, lumber, and mineral resources.
.lohn McTaniany a miner, was killed
on Wednesday about noon in the mines of
the Lilly Coal Company at Lilly. He was
engaged in what is known as extra work
in company with. lohn McCool when there
was a sudden fall of slate. In this Mc
Taiuauy w as caught and his death w as al
most instantaneous, lie was aged forty
years, was married and leaves a wile and
family. This is the lirst fatal accident
that lias yet occurred in the mines named.
-On the 1st of .lanuary, Mr. I. A. Mi

Commissioners w ill resign his position to
take hold of the office of Register and Re

John Henderson, a wayward Sunday
school teacher from Somerset coun
ty, w as found lying on the street in Pitts
burg ou Wednesday of last week. A watch,
a rusty horse-shoe, a silk stocking, ami a
woman's garter were found in his pocket.
He said money had been entrusted to him
iii the interest of his Sn mliy-school to
make arrangements for a Christmas tree.
The money was gone. A city friend had

was sent to jail for live days.

says that an alleged constable, Robert
Haleton, of Walnut (Srove, is in serious
trouble. Muring court last week Ha.leton
went up to Kliciishuru, although, it is said,
he had no cases up there. It si-ems that
while he was there, he met Miss Muttit
Love with whom he fell in love, lie and
Mattiesoon begun to haye a good time, al
ttioic.li he was already a married man
Ha.leton all this time explained his ah
si nee to his wile, bv telling her he was in

A letter which Matlie had written to

on Thursday afternoon of last week. Af
ter a number of challenges on txith sides.

After the opening of the case by District
Attorney O'Connor. Anselm Kirsch, the
prosecutor, vas called and testified snb-
tantially as follows:
I reside in Harr township, Cambria
ountv; I have lived there all niv life; T
ni about twenty years uld; I lived vith
my mother about a mile from Nicktow.i;
I have known the defendant my wife
for alxiut two years; ve vere married on
the tenth of May of this year at Carroll
town; after lieing married ve went to
Philadelphia, and returned the Saturday
afternoon of the same eek; ve
went out on Saturday afternoon to her
home and went from there to my home;
he stayed w ith me one A-ek and then re
turned home and stayed two veeks; I weni
out to see hy she would not come back;
he said she would not return until my
mother signed the property over tome; my
mother owns a large firm and some er-
sonal property; I tixik Father Ruliertxvith
me and he got her to return w ith me; she
refused to cohabit w ith me in a sexaal way
from thcTmh of May, the time we were
married, until the rrJiul of July, the time 1
got sick; she refused to occupy the same
Ix-d with me most of the time; after she
got two Ix-ds in the room she refused;
while we were away on our trip she occu
pied t he same tied, but ret used to cohabit
in a sexual way ; when we returned home
we occupied the same tx-d thai night, but
he refusinl me sexual intercourse; she
p'aced another l-d in the room ve occu
pied and she occupied one bed and I the
other; I remonstrated with Ler for this
Action and had a conversation with her
a little over a week In-fore I got sick; I told
her I vould give her a w eck's time to make
up her mind, and, after that time, would
have sexual intercourse w hether she xvant-
ted to or not; she didn't say vhether she
would or wouldn't ; ontheind of July
that vas the last day I had given her to
make up her mind I started to mow and
broke the machine and I vent to Carroll
town and got the piece I broke, and when
I came hack she got. dinner for me, and
lie asked me to taka a cup of tea; she gave
me the tea and w hile I w as eating she sat
back and pretended to lx- reading, but I
saw she was just wutching me; after din
ner I started up-stairs lo change clothes,
and felt sick going up-stairs, and sat down
on the upper step; I then changed clothes
and went down and went into a room and
got a drink of w hiskey ; my mother asked
mo what I vas doing and I told her
I felt bad and took a drink of whiskey, and
my ifesaid she felt bad too; when 1 went
to the field I felt very sick and vomited,
and then I got so sick I had to go to the
house; after I vent to the lield, my wife
look a bucket and pretended she w as going
for berries, but she went up and sat under
in apple tree in the orchard; when I got to
the house she came down and came to the
the house; I sent for a physician that
night, mid in the morning 1 was U-tter; I
was -wy thirsty and drank lemonade; my
sister was to see me, and when she went to
go, my mother went w ith hei to the bug
gy, and I asked my xvife for lemonade and
Ik; went to get me some, and I tasted It
and it didn't taste very good; she said it
xvasn't fresh; 1 drank it and live or ten min
utes after that I got so bad I could hardly
live; mother made me a drink of strong
coffee and I drank that, and about 1
o'clock tin' doctor came; the Monday af
ter the Friday I took sick, my w ife said to
me now that she could not give me any
thing, she would go home until I got well,
and I told her to go and never come back
again; after she went away. I never re-
ceived a word or letter from tier; 1 attend
ed a picnic with my w ife shortlcy aftei my
return from Philadelphia at Nicktown.
There w as dancing there that day, and she
said she didn't care to dance with tne, and
about live or ten minutes afterward she
was dancing with another party ; I dor.'t
know what Ix-came of the matter I threw
up; I saw the dog eat some, and it vas
sick as long as I w as.
Frederick H an-man, a chemist from
IMiihnlclnhlii. was called and testitied to
having examined a sample of the prosecu
tor's urine twenty-six days after the al
leged poisoning, and found traces of arse
nic.
A number of vitneses were called who
testilied to minor points in the case.
Frank Lehmire was called vho testilied
thai he had assisted in making the arrest
and had heard a conversation betxveentlu
defendant and her father. Her father
said: "You will have to lx-at him and
throw him into the costs." Mrs. Kirsch
said: "They ought to have Till arrestiil
for she got the txiison." The fither
answered: You ought to have given him
a bigger dose." The defendant said: "I
would if I had it to do over."
For the defense Mr. (S. W. Wagoner and
Mr. A. X Waketield, of Johnstown, and
Mr. Davison and Mr. Jones testitied to the
improbability of traces of arsenic remain
ing in the urine for twenty-six days.
The defei.dunt, Mrs. Maggie Kirsch.
was called and detailed the account of tin
marriage, wedding trip, return, and differ
ent trips back and forward from her for
mer home to Kirsch's; her testimony on
those points vas identical with the testi
mony Of the other w itnesscs; she gave the
same reasons for not w ishing the marriage
to lx- consiiiiiated, and rather clung to tin
statement that the arrangement made on
the wedding trip was understood by Ixith
parties to lx permanent. To this, she ad-
milted, her husband had objected, and
claimed he did not so understand it. She
accounted for her demand to have tlx
property in her husband's name by stating
that he had told In r it was all his; that hi
would have to pay only I.4oo to his mot I
er for the personal property: she and tin
old lady did not agree alxnit the manner
of housekeeping, and she wanted to pay
the money at once and have tlie say-so

she denied Htnt blank; denied ever having
any jxtlson about, or that any had ever
Ix en purchased for her; she denied ever

she was positively sure h neycr
said any such thing; she had jocularly
remarked that they couldn't do worse than
hang her. On the evening of the 4th of
July her husband said he had a big notion
to shiKt himself. S.he wanted the proper

Friday afternoon. On Sutui'day morning

guilty and recommended, the defendant to

Pennsylvania railroad company for the

Then follows a series of five to Jackson

four admit of two w hole weeks in the sun
ny South, while tickets for the fifth tour
are good to return by regular trains until

adelphia, and proportionately low rates
from other stations.

a period of three days, and rate includes

Last of all, the Pennsylvania railroad
company announces that it, during the

nitely announced later, proposes running a
distinct tour to the Yellowstone National
Park. It will be conducted on the same
general principles, and maintained at that
high standard manifested on all the Penn-
ylvania railroad company's (lersoually
conducted tours.

On Monday, December 12th, Harry
Miller, who registered as being from
Clearfield, arrived in town driving two
bay mares hitched to a buggy. He put up
at the Central Hole! where he gave out
that his business vas selling silverware,
although vhile in town he made no effort
to sell any.
On Saturday he traded a horse, harness
and buggy to Messrs. Crown, Kimball and
Apel. the liverymen, getting in exchange
a horse, harness and cart. On Monday he
sold the horse, harness and cart hei got
from Messrs. P.rown, Kimball it Apel to
Mr. Joseph Diinu.ire of Cambria township.
auu on tne same day lie traded Ins other
horse, harness and rotte to Harry Robb for
a gold watch. On Tuesday morning he
did not turn up for breakfast but Land
lord Crown thought nothing of his ab
sence and supposed that he was out with
some of the liverymen hxtkiug at some
horses. At noon, however, Mr. ISrown
learned that his slick customer had taken
his departure on the early train and ou his
arrival at Cresson had purchased a ticket
for Philadelphia. Miller !s alxiut thirty
years of age. alxtut 5 feet " inches in height,
with daik hair and heavy dark moustache.
He had plenty of lioney having exhibited
