.f the Court on last Tuesday, Judge Dean
read a very able and exhaustive opinion on
the Bill iu Equity liled by the Cambria
Iron Company, at the last December Term,
against -the County Commissioners and
j certain collectors of taxes in the southern
e6i ' Poltiou of the county. As our leaders
j fully understand from what lias heretofore
! been said in our paper, this Bill in Equity
254.33 ! prayed the Court to compel the t ounty
j Commissioner to enforce & certain Act of
; Assembly, approved April Sth, 1S72, chang

This is a bill iu equity filed by th Cam
bria Iron Company, complainant's, prayii.yi,
for the reasons therein set forth, that an in
junction may issue to restrain the resnond-
I ents, the County Commissioners of thisconn
j ty, and the tax collectors appointed by them
and acting under their warrant, from collect
ing by levy, distraint, suit, or otherwise, the
! taxes assessed uihui the property of com
I plainsnts in Johnstown, CouemaiiKh, anil the
! boroughs and townships contiguous thereto.
Hitherto the taxesof Cambria rotintv have
le'u assessed and collected under and in the
manner provided by the Act of 18'3-1 and the
several Minplements and amendments there

From the wording of this section the ques
tions to be here tivcided mainly arise. The
1 ei olid section enacts that it shall be the duty
of the Treasurer togive public notice in each
township and borough, and attend in person
or by deputy at least one day. before the 1st
day ol" September in each year, for the j.-ir-pos
of receiving taxes ; wilh a proviso, that
if any jw-rson shall, on or lief ore the 1st day
of September, pay the taxes assessed against
him to the county treasurer, he snail be al
lowed a deduction of five per cert, on the
amount ol his tax. From ihe third to the
eighth sections, inclusive, provision is made
for the enforcement of payment against de
linquent taxpayers and defaulting officials.
Scciiou nine fixes the compensation of the
county treasurer. Section ten declares that
all laws for the collection of taxes, iu so far
as they relate to paid county, and are incon
sistent with said Act are repealed.
It will be observed that this Act is ap
proved bv the Governor April 8th, 1872.

The complainants arer in their bill that
the appointment of borough and township
collector, antl the delivery of duplicates to
them, wilh warrants for the collection of
taxes, were acts without the authority of j
law ; that the Act of April 8th, 1872, took
effect from its passage ; that it repealed all j
Acts inconsistent therewith, and necessarily
ihercforn the Act of 1834, under which the
commissioners profess to have acted ; that
it was the duty of the county t-ommis.-iiotiers
to deliver, and is now their duty to deliver,
to the county treasurer a "fair duplicate"
of the taxes in and for said bounty for the
year 1872,inclmiing the taxes assessed against
the complainants; that it is the right and
duty of said treasurer to receive and of com
plainants to pay to said treasurer the taxes so
assessed; that iu the assertion of a right, and
to set ure a brnetit conferred upon tnem, as
well as ujMiu all others who choose to avail
themselves thereof, by said Act of April 8,
1872, they tendered to the county treasurer
the gross amount of taxes assessed against
tiiem, prior to the 1st day of September, '72,

law, the collectors appointed by the commis
sioners are threatening to lery upon the pro
perty of complainants, and they therefore
pray the Court to enjoin said collectors, etc.
The respondents, while they accuse eom
pla. nants of laches, in waiting until the 2d
nay " Ceccunlier before riling their bill, and
hindering at this late day respondents in the
collection of the taxes by raising a question
w hich could have been raised ami decided
months ago, file a general demurrer, atlmit
tine the tacts set forth in the bill, but deny
ing the right of the complainants, ou the
facts, to the relief prayed for
The respondents claim that the Act of 8th
of April, Js.72, by its terms only authorizes
the adoption by them of the mode therein
pointed out for tha roliction of taxes in the
future, to wit, in the year 1873, and each anj
every y ear thereafter ; that by no reasonable
construction of it can it be applied to the
year 1872 ; that they intend ami are ready to
follow its provisions for the year 1873 ; that
under the old law, which was considered by
them in force lor the year 1872, they made
out and delivered to the collectors the. dupli
cates. Tints, we have two different interpreta
tions of the same statute. One, claiming
that the omission to fix the year 1873 in the
Act as the time at whicn it should go into j
effect, and declaring that "on and alter the
passage of this Act" it shall Ixs the duty 01 j
the county commissioners, etc., indicates
an intention that it should apply to the col- j
lection of taxes for the year 1872. The other,
that as 1872 is not named in the Act as the
year, and as it is made the duty of the coun
ty commissioners, "riot later" than the first
Monday of April, tot ause their clerk to make
a fair duplicate, etc., and the Act lieing dated
after the litst Monday of April, 18i2, the

to future years.

Keeping, then, iu view these rules of in
terpretation, we have before us a law passed
on the 8th of April, 1872, which prescribes
that a certain duty, to be jeTformcd by the
county commissioners, shall be performed
by them not later than the first Monday in
April of each and every year. So far as the
year 1872 is concerned, then, the time for
the performance of the first act on the part
of the commissioners bad passed before the
law had psd. No word in the statute in-
! dicates 1S72 as the year, or we might Fay Unit

April of that rear, was not within legisla
tive mind. The words "from and alter the
passage of this Act" have no special signifi
cance which warrants the construction that
the year 1872 was meant. With these words
the Act goes into effect at the same time as
without them, and no sooner. Statutes take
effect from their date, unless it he otherwise

words are rendt-red nugatory unlt-hs the law
h applied to 1872, in not, it seems to us, well
founded. The assessment and collection of
taxes is not a daily nor a monthly duty im
posed upon the commissioners. Itisunnual,
to lie performed once in each year for that
year, and the Legislature may very properly
have thought that- lor the year 1872 this duty
had beeu partially performed under lh old
law. Thinkinir thus, it is probable thy did
not have, as they did not express, an inten-

effect, but only intended that the first ptr-
foriuance of the yearly duty of the couiinis-

with its provisions. If this le correct, the
words have their literal force, and the law is

the Legislature, it is not material whether
the duty of the commissioners could have

And while it is true that laws designed to
benefit public interests and we have rio
doubt that this law was so intended and that
it will benefit the public are to be liberally
construed, ret

is directory merely, that it wa Intended to

fit is postponed by the construction we give

effect than was intended by the power that
made it.
T he course for complainant has cited and
relied on the case of Commonwealth vs. Civ.
nynj.'ham, lbth L. I Smith,!, as ruling the
questions raised here. We do not think it
does. In that case the Legislature, by Act
of March 3d, 1870, provided for the appoint
ment of three coal mine inspectors for thn
counties of Luzerne and Carbon, upon thn
recommendation of a board of examiners to
bo appointed by the Court of Common I'lnas
of Luzerne co.mty. The fourteenth Section of
the Act provided that these inspectors should
be appointed Ly the Governor, upon the re-
oommondatioti ot the board or examiners,

Further, that
the examiners should be appointed bv the
