THE CONVENTION WAS HARMONIOUS.
(Continued from 1st pnge. '
by Judgi. Dunham, Jerry Hess is
entitled to the nomination. There
was considerable division of opinion
ahd chairman Hower stated that he
would not pretend to assume the
responsibility of iutrepreting the
party rule bearing on the question,
and had decided to submit it to the
convention for settlement. At this
juncture Thos. Iilmes, ol Franklin
addressing the chairman, demand
ed to know the party rule, that he
had been informed by the organiza
tion on Saturday that one candidate
on each side of the river was to be
nominated, and that he as well as
many others were there to abide by
the party rules. Chairman Hower
read the rules after which Herman
Young, of Catawissa, on behalf of
W. B. Shuck offered the following
petition:
To the Democratic Convention
of Columbia County.
The petition of William B.' Shuck
respecfully showeth:
First. That siid William B.
Shuck, the petitioner, was a can
didate for the office of county com-missioner,-
at the primary election
of the Democratic party, held in
said county, on Satuiday June io,
1905.
Second. That at such elections,
as shown by the approved returns
thereof now before said convention,
the candidates for said offices and
the vote received by them, were as
follows: . Charles L. Pohe, 1977
votes: William B. Shuck, 1902
vote; John A. Breisch, 251 votes;
George H. Sharpless, 199 votes;
Jeremiah Hess, 1542 votes, Isaac
Reichart, 750; William Bogart,
1008; George W. Sterner, 497;
Arthur A. Creasy, 812.
Third. That by said returns,
the two candidates of said office,
who received the highest number
of votes were the said Charles L.
Pohe and eaid William B. Shuck,
the former receiving 1977 votes and
the latter 1902 votes or 360 more
votes than next highest candidate.
Fourth. That it is provided by
Section 4 of Article 1 1 of the Rules
or the Democratic party of Colum
bia county, as follows:
"That the candidate who shall
have received the highest number
of votes as shown by the approved
returns thereof, shall be declared
the nominee. In a case of a tie
vote, the nomination shall be de
termined by casting lots.
"where two persons are to be
nominated for the same office, the
two candidates receiving the high
est number of votes shall be nomi
nated." Fifth. That under the provis
ionsof this section, the said William
B. Shuck, the petitioner, respect
fully requests the Chairman of said
convention to declare the said Will
iam Shuck one of the nominees of
said party for the office of county
commissioner.
Sixth. That the amendment of
said rules which reads as follows:
That hereafter when two candi
dates are to be nominated as two
members of the legislature, two
county commissioners or two county
auditors, each voter shall vote for
one candidate from the district ly
ing North of the Susquehanna river,
and one candidate from the district
lying south ot the river." is not in
the way of the petitioner's claim.
Said amendment does not repeal
expressly or impliedly Section four
above quoted. It only directs how
each voter shall vote. There is
not a word or line in the same,
which requires the convention to
nominate a candidate for said office
of commissioner from the North
side of the river and one candidate
for said office from the South side
of the river. , ,
The absence of such repealing
clause, shows that it was not the
intention to repeal section 4. The
petition further refers to the circum
stance in support of his claim, that
nine years ago, Hon. William
Krickbaum, and Mr. John W.
Gordon, two candidates from the
North side of the river were nomin
ated and ekcted commissioners by
such convention, on the ground
that they received the highest num
ber of votes. This precedent should
be followed by the convention.
Moreover, Mr. George W. Sterner
and Mr. Bogart, our present county
commissioners, are both from the
North side. Until Section 4 of
Article II above quoted is repealed
the petitioner claims that he should
be declared the nominee of the con
vention with Mr. Pohe, and most
respectfully requests the convention
so to declare by its chairman, and
in case of his refusal so to do, to
appoint a committee to pass upon
the claims of the petitioner.
W. B. Shuck.
Columbia County ss.
W. B. Shuck the within named
petitioner being duly sworn accord
ing to law says the contents of
above pethion are just and true to
the best of his knowledge and be
lief. Sworn to and subscribed, June
13th 1905. Wm. B. Shuck.
A motion to make Shuck the
nominee of tbe convention was
made, but was lost by a vote of 37
to 12. Then a motion to declare
Hess the nominee was made and
carried without opposition. A num
ber of the South side return judges
voted against the motion to make
Shuck the nominee for the reason
that they believed that the spirit of
the party rules was for one candi
date from each side of the river.
Among this number was Chairman
Hower, who in answering to his
name, stated that his voice had
always been raised and his vote re
corded for the recognition of the
South side, but as he believed the
intention was to have one candidate
from each side, he had voted against
the motion.
C. M. Terwilliger was then nom
inated for Prothonotary; Frank W.
Miher for Register and Recorder;
Harry Rhodes for County Treasur
er; Jerre Hess for Commissioner
from the North side and Charles L
Pohe for Commissioner from the
South side; C. A. Small for District
Attorney; John J. O'Donuell for
Mine Inspector, and Clyde L. Hide
man and Harry B. Ceasy for
Auditors.
The committee on resolutions
made the following report which
was accepted:
Resolved, That with Creasy and
Harman in the Legislature and
Cochran in the Senate our county
and district is ably represented by
the Democrats of towering strength.

permit was an active worker and a
regular attendant at all its services.
The deceased was a daughter of
the late John H. Brown and leaves
