Attorney General Elkin gave on Thursday as his legal opinion that under the act of 1887 relating to the Bosicmment of claims, if the West Virginia claim agency presses the writs of attachment against railroad ers and compels railroad companies to pay the debt, the railroaders may proceed against the merchants or other ci editors making assignment of hesc claims and under the law re cover from them as a penalty the full amount of debt, interest and costs so collected. Some time ago Frank Snaveley and A. J. Johnson and other employes of the Pennsylvania Kanroaa vo., wisn ing to ascertain what legal right the West Virginia Collection Agency had to hold ut the wages ot railroad em- nloves in Harnsburg, Altoona and other points along the Pennsylvania line lor debt, sent a letter to Attorney General Klkin statine the case and asking his opinion on the subject. Mr. Elkin concludes his opinion as follows: " This whole system of mak ing collections is vicious and should not be encouraced. It seems to me that when merchants and other cred- itors fully understand the true charac ter of the suits instituted ana the pen alty which they must pay if the suits are pressed against them they will re frain from making assignments of claims for this purpose."
