At the last term we were asked by the Commissioners what we thought of it, whether you should be paid ? At that time two of the Judges of the state, we think, will not le certain, Judge Pershing of Schuylkill and Judge Bennett of Luz erne had decided that you are not en titled to pay, not even to your mile age. We answered the commission ers that we thought you were entitled to your mileage ; but the commission ers, as we understand, being governed by the opinion of the two judges be fore whom the question had been raised, withheld your pay per day fearing (no doubt) that if they paid you it would be at the risk of being obliged to reimburse the county out of their own pockets. Our answer to the commissioners at that time was not what is called an opinion, was not a decision of any question before us, but merely an obiter dictum in no way binding upon the Court or determina tive of any contested right. Since then Judge Biddle of Cumberland county has carefully considered the matter as submitted to him. He holds that the old law compensating con stables is not repealed, although the late act fixing the fees of constables does not mention such compensation, that constables are still entitled to pay for the day as well as for mileage. We are informed that the solicitor for the County Commissioners is of the same opinion, if sorobably you will have no difficulty ivjgetting your pay for this term and for any term now in arrear." The patient has been in a critical condi tion for several days past, but the operation had to be performed to give him any further chance for life.
