Order No. 1, for $30,00, given es feesof Audi
tors and Secretary for servlaes In auditing
accounts of Bloom Poor District forthe year
1894 at the rate of $5 per day Is excessive and
Illegal The Act, of Assembly provides that
suld auditors shall be entitled to receive $1.60
for each and everyday actually employed.
Tho salary of the secretary Is tlxrd for Uie
year and be was not entitled to extra compen
sation for attendance at the meeting of the
Auditors. It Is clear that the dl lectors had
no right ropay tho Auditors and Secretary
the $38 50 In excess of the amount allowed by
lft.w; HaT"8" nought to the money the I'oor
District Is clearly entitled to recover ltbac.lt
from the directors of that year. But the An
dllors and Secretary of that year should pay
the Directors the amount received In excess Lo
what they were legally entitled.
Orders No. 16 and 73, amounting to J7.50 were
given to one of the Directors of the poor: and
part of order No. 88, amounting to $!8.oo to an
other Director for furnishing manure forme
Improvement of the property of tho poor dis
trict. This Is clearly In violation of the laws
of Pennsylvania of 1874, page 180 which pro.
vldes "1 hat It shall not be lawful for any Di
rector of the poor In any county in this Com
monwealth, where said otllce exists to ba

dor No. 4ii amounting to $15.53 for carpenter
work by one of tho Directors on the buildings
of lie Poor District, Although the Vow
District received the benetlt ot the amt, ot
these orders, yet, the transactions were Illegal
and tho Directors who received the money
should pay It back to the treasurer ot tho (lis
trlct. Orders No. a3 and 58, amounting to $68 wem
given to pay forthe services ot two stewards
during part of the month of March last Th
Aot of Assembly lncoiporatlng Bloom Poor
District provides forthe appointment nfonly
one steward. It would Therefore be Illegal to
pay forthe service of two at the same time.
Hie Directors who appointed and paid forthe
services of these two stewards should pay in
to the treasury of the poor district $18, beinir
t he amount In excess of the regular salary ot
tho steward of that year.
Order No. 106, for $10 to J. A. Howard for
board and care of R. s. Miler up to Sept. tsth.
1895, was given without authority oflawani
should be paid to the Poor District by the Di
rectors who authorized the payment. The
order shows that It was not drawn for the re
let of R.S. Miller but to pay bills wliicil hS
been contracted previous to the time 'he or
drrw?? Fl!'en- tlle 8ul'"me Court has de
cided that tho overseers of the poor are strictly
limited by the various Acts of Assembly re
lating to the maintenance ot tho poor and ex
cept In rare and special cases they cannot
step beyond the letter of these acts "This Is
allowed In special emergencies only, as where
medical aid or other assistance Is Imperative
ly required before relief can be obtained "
Orders 107 aud 131, for $107,17 were given for
coal for Bloom Poor District. The actunl cort
of the coal delivered at Bloomsburg was $" 75 a
ton, amounting to93.fti but the orders wore
made up of this amount, and of $t8.6i for ex
penses during two trips to Kingston to pup
chase the coal. The bills show that the coal
costs $3.75 a ton and the orders Indicate that
It costs $3.15 a ton. This wus a mistake and
the Director who Ipurehased the coal should
Bay $ 8.61, being the excess of the actual cost,
ut he Is entitled to pay for his necessary
traveling expenses and by presenting an
Itemized bill tho board of Directors should
Order It paid.
