Married Women. A BILL TO GIVE THEM ALL THE LEGAL RIGHTS AND DISABILITIES OF SPIN STKRS. The following bill defining tbo rights powers and liabilities of married wom en has been introduced into the Penn sylvania Senate by Mr. Wolverton, of Northumberland, and favorably re- puiivu ujr iuu vuiuiuiucb on uuaiciary General : Section 1. That hereafter marriage shall not be held to impose any disa bility on or incapacity in a married woman as to the acquisition, ownership possession, control, use or disposition of property of any kind, real and per sonal, or ber right and power to make contracts of any kind and to give obli gations binding herself therefor, but every married woman shall have the same right to acquire, hold, possess. control, ose or dispose of her property icai uuu personal, in possession or ex pectancy in the same manner as if she wero a ferae sole without tbo interven tion of any trustee and with all the rights and liabilities incident thereto as it sho were not married, and property ui uvury Kinu owneu or earned oy a woman before or during her marriage snau ociongto her and not to her hus band or his creditors. occ. 2. A married woman shall be capablo of ODterimr into and rendering herself liable upon' any contract to the extent or tier separate property, real and personal, and of suing and beinc sued, either npon her contracts or for torts done to or committed by her in all respects as if sho wero a ferae sole, and her husband need not be joined with her as plaintiff or defendant, or bo madu a party to any action, suit or legal proceeding of any kind brought by or against her in her individual right, and any debt, damages or costs recovered by her in any such action, suit or proceeding shall be her separate property, and any debt, damages or costs recovered against her in any such action, suit or other proceeding shall bo payable out of her separate prop erty and not otherwise. Sec. 3. A manied woman may make, execute and deliver deeds, con veyances, mortgages, assignments and leases of her separate property, real and personal, and notes, bills, drafts, bouda or obligations of any kind, and appoint attorneys to act for her, and it shall not be necessary for her husband to bo made a party thereto or joined therein, and in making deeds of con veyance by a married man it shall not be necessary for his wife to bo made a party thereto or joined therein, aud evoiy such deed of conveyance, mort gage or lease by husbaud or wife shall convey mortgage or lease the whole estato of the grantor, mortgagor or lessor, clear of the interest of the other as hmbaud or wife. Husband and wife may convey mortgage, assign leaso aud give judgments and obliga" tions to each other, binding their prop erty, real and personal, in tho samo manner as if they were not married. Tlio acknowledgement of a deed, mort gage, assignment or letter of attorney by a married woman shall bo taken nnd certified in tho samo manner and lorm as if she wero unmarried. Sec. 4. husband and wife shall havo the samo civil remedies upon con tracts in their own name and right against all persons, including each other, lor tho protection and recovery of their separate property a unmarried persons. As between husband and wife statutes of limitation shall be Mis pended until tho marriage shall be terminated, but tho timo which has run beforo marriage shall bo included in computing tho time far limitation of suits between husband and wife. Skc. 5. A married woman may dis pose of her property, real and personal by last will and testament in writintr, signed by her or manifested by her mark or cross made by ber at the end thereof in the same manner as if sho wero unmarried, and hereafter a will oxecuted by a woman beforo marriage snau not do deemed to bo revoked by her subsequent marriage. Important Points la Railroad Law by the supreme uourt. The supremo court enunciated somo important principles ot railroad law, in deciding tho case of Ucnjatnin l loung ogainst tho I'ennsylvania roil road company, which was taken up on writ of error from common pleas Mo, S of Philadelphia. In February, 1884, Young nnd threo companions were in Akron, Ohio, and desired to como baok to Philadelphia. They nleo wanted to stop oil about Unity-six hours at placo a short distance west of Sunbury, called Montanuon Junction; they not) fieil tbo ticket agent of this fact and he sold them "special liui'tcd tickets, which ho punched in such a way that they would bo good for six days. These tickets wero fold by the New York, Pennsylvania nnd Ohio railroad and ropditig via tho Elmira and William- sport to Williarasport, tbo i'hiladel pbia aud Erie to Sunbury, Northern Central to HarrUbtinr, and Pennsyl vauia railroad to Philadelphia. The party stopped of! at Montandon. nnd on resuming paid local tare to sunbury, After passing that point they offered their through tickets to the conductor, lie refused to accept them, and ejected tho wholo party becauso they refused to pay their faro to Harrisburg. They afterwards got on another train, whose conductor accepted the tickets. Suit was brought to recover damages for the ejection, but the lower court enter ed a non-suit. the supreme court holds, in reviewing the judgment, that tbo plaintiff was bound to sustain two propositions. These propositions wero first, that tho ticket was good for pass- ago trom bunburv to rhiladelphia on tho day when tho conductor refused itj secondly, that the conductor on the Northern Central road was an employe ot tho f ennsylvania railroad company, On tho first point Judge Sterrett says : "It appears that the New York, Penn sylvania and Ohio road acted as the agent of the other companies in tho sale of these tickets, and if so they were bouud by the act of the ticket agent at Akron, acting within the scope of bis authority. If he mado a mistake or violated tho instructions of his principals, it is very clear that the conuding traveler should not in cotise quenco thereof be treated as a tres passer. When a railroad ticket has been purchased in good faith from an agent acting within the general scope of his employment, it is the. duty of the several companies named therein to honor it until it is used or expires by its own limitation. The election of the plaintiff from the car was therefore a trespass lor which the company operating tho Northern Central road is answerable in damages. As to the second proposition, we think tho testi mony was sufficient to have justified its submission to the jury also. It is practically conceded that the defend ant company was operating the Elmira and Williamsport and the Philadelphia 1 T.. ! J. 1 .1.. ....!' uiiu .cue ru.ius, uuu iuu lesumouy tends to show that the train in which the plaintiff was carried to Sunbury, the terminus of the latter road, was the same that passed over the Northern Central, all the while in charge of the same conductor. The correspondence which followed also tends to provo that all the roads were operated by the defendant company. The evi dence is more than a scintilla, and in the absence of rebutting testimony the jury might well have found that tho trespass was committed by an employe of the defendant company and conduc tor of ono of its trains. Wo think, therefore, that the learned judge erred in withdrawing tho case from the jury. WASHINGTON LETTER From our Regular Correspondent. Washington. D. O., Feb. 1, 1887. The toilers on Capitol Hill confront ed various questions during the past week, gome of which were important, while others were not so. Araonc them wero the fisheries trouble with Canada ; woman suffrage ; pensions ; the bill establishing Agricultural Ex periment Stations j'the bill preventing members of Congress from action as attorneys for corporations with which Congress has important dealing ; the neuro-i'neuruouia bill ; tho Kiver and Harbor bill, and several of tbo other regular appropriation bills. the Woman fautlraco Association. which has just closed its nineteenth annual convention in this oily, saw the Senate remorsely voto down their suf frage amendment to the Constitution. liut sixteen benators voted in favor of the ladies, and that was a great victory for them. They have repeatedly seen both houses of Congress vote against the coudideration of the proposed amenumeni, nut tnis was tbe tirst time they ever bad a vote on the amend mei't itself. A committee of twelve ladies, all prominent in tho suffrage movement, called at tho White House to present to tho President a written protest against that portion of tbo Utah bill which disfranchises gentile women of Utah. The Mormons are already dis franchised, malo aud female. The President received the ladies gracious, ly, and spoke a few words to each as she was inlroductd to him. Several of them mado short arguments in favor of the rights of Utah women, to what they bad been allowed to exercise for fifteen years the franchise and urged the Presideut to veto the bill if it passps as it now reads. Sir. Clove land listened ittentively, promised to give the matter careful attention, and said ho had supposed tbe women of Utah did not caro to vote and did not vote when they had a chano?. The contemplated retirement of Treas urer Jordan at that time is openly no knowledged. Two miles south of this city stands a palatial resi dence owned by an English gentleman long since identified with tho Mormon Church. It has been untenanted for the last two years, save by an old ser vantnan named White, who at one time was connected with tbo Jczrels, of London, a sect similar to tho Mor mons. White claims ho was defraud ed by them out of his property aud latterly became couverted to "tho Mor mon faith. He was considered a trustworthy man and wa, therefore, partially through necessity, taken into the confidence of the leaders of tbe Mormon Church of Zion, which, ac cording to bis statements, is about to perpetrate a fraud to which he is un willing to become a party. He says : "two months ago there arrived at the mansion an oil gentleman bearing letters from my master in London, the purport of which was to obey his every wish and to keep his presence a secret to all except those to whom be , saw tit to reveal lumselt. Within a week persons began to arrive at the houso in twos acd threes. They were from Salt Lake City, and held long. whispered consultations with my mys terious guest. Little by httlo I gath ered from stray remarks that ho was a person of note, and soon after tbe truth burst upon me that be is none other than Brigham Young, the great rropnet ot our (Jburcb, who is to be. apparently, resurrected from the dead and preach to the people of Zion as one as having returned from tho grave to tell what lies beyond. That bis death and burial were a deception will soon bo seen by the wholo world. whilo thousands of his believers bow nt his feet and he dictates to them their ways of life. My guest's visitors are men of high standing aud it was in conversation with one of them, who supposed from tho way 1 talked that 1 know all, that my suspicions were veri fied, only my informant said Brigham loung had risen from the crave in Salt Lako City and was instructing his disciples here in order to prepare the people for the great event of his coming. 1 he old man told the story with a . .... . - . sincerity that warranted lurther in vestigation, and a merchant who for merly did business in Salt Lake City drovo out to tho mansion yesterday and rapped at tho door. Receiving no response he started around the house to apply nt tho rear, when through a bay window be saw the form and fea tures of an old man who was sitting inside. As he was unaware of bis presence the merchant approached to within a few feet of the window, scan ning the old man s face closely, and stepping back, immediately pronounced the man to uo Brigham Young, whose marked leatures he had often studied in Salt Lake City, and which once seen ho says can never be forgotten. For a few moments the man sat sileut ly, then raised his hand to his brow, revealing a scar about tbe wrist that still further establishes his identity. It is a well-known fact that the elders of the Mormon Church through out Utah and Arizona havo of lato been preaching the return of the Prophet. This, together with the fact that it was claimed by a St. Louis man some months ago that Young was seen nnd recognized in London j that a number ct prominent Mormons from Salt Lako City havo lately been seen upon the streets ot London ; that im portant legislation is about to bo en acted to tho detriment of tho Mormon Church and the veil of mystery with which the Prophet's death has alwavs been shrouded, makes it almost certain that the the Mormon bauners through out Utah will toon be unfurled, an- nouncing that "tie is risen. Had the alleged bill been ono creating an additional law judge for the 2Gth Judicial district, there might have been some occasion for excitemont and inquiry, but as it was repotted to po only tor Columbia county, the introduction of such a bill was not only highly improbable, but its passage was utterly impossible, as Columbia county hus not sufficient population to constitute a separate dis district, and under tbo constitution tho legislature has no power to creato an aidilional law judgo for a part of a district.
