Tho license applications of Hiram Hess
and J. B. Mcllcnry, of Benton, and of Ar
thur McLaughlin, of Ccntralla, which were
laid over from May 3rd, were disposed of
on Monday, the licenses being granted.
Judge Uockafeller, of Sunbury, requires
nil applicants for llce.'so to make affidavit
that they havo not violated tho liquor laws
during tho past year. If any refuse to
mako such nn adldavlt, no' new license Is
granted' them.

Aaron Hcndershott, an old resident of
this town, died suddonly at his home on
Market street on Monday afternoon, from
heart disease. He went up to Nantlcoke
In the morning for his neicc, and returned
on tho nftcrnoon train with her, and
walked up from the station to his house.
He had just got lusldo when he exclaimed
that ho was about tired out, and was as
slstcd to a sofa nnd In five minutes
breathed his last. His ngc was 70 years
nnd ho had been an employee In the store
of William JIcKelvy and his successors,
Mclvelvy, Nenl & Co., and I. W. McKcIvy
for nearly fifty years. Ills health has been
falling for somo time, and for several
weeks be bad been unable to attend to his
duties at the store. The funeral took placo
nt tho house on Thursday morning.
Only three cases were tried In court Ia3t
week, two of them occupying about a half
hour, and the thiol, that of Bird ys. Culp,
using up the balance of the week, the jury
not rendering a verdict until after supper
on Saturday evening. This was an action
for damages brought by Jnmes Bird against
Culp and McWilliams, of Northumberland
couuty, for culling timber on a tract ot
land in Locust- township. It involved u
question of title as well as the value of the
timber cut, and as there was a mass of
documentary evidence on both sides it waa
a slow and tedious trial. Ikclcr & Herring
and Miller wero counsel for plaintiff, nnd
Wolvcrton and Freeze for defendant. The
verdict was for plaintiff for 000, but a
motion has bceu made to treble a portion
of It and to double another portion, which,
if it prevails, will considerably increase

A man giving Ills name as Ueorge Will
lams, nnd his residence as Montour nnd
Columbia counties, arrived here on Mon
day aflcrncou on tho D. L. & W. road In
a stale of Intoxication. At tho station ho
took 'i sent with the driver of tho 'bus to
come up town, and nn the way up attempt
ed to steal a small package belooging to
a lady passenger, but was detected by the
driver, Jaiues Kleckner. When tiny
reached the hotel Kleckner notified I). Lay-
cock, chief of police, ami the man was
watched. He went into Bombard's jewelry
store and asked to see somo rings, which
were shown him, but he left without pur.
chasing. Soon afterwards he went into
several business places and tried to sell a
new ring without success. He then went
Into MoKelvy's storo and when the clerk's
back was turned slipped two pieces of val

who were watching from outside, then

this ho was lodged In the lock-up over
night, it was the intention to swear out u
warrant for larceny, but on his phomlso to
leave town be was not prosecuted.

censes In Benton ou Monday Judge Elwcll
said, In substance, as follows:
Tho laws of Pennsylvania, ns they
stand upon tho statute book, contemplate
tho granting of licenses to public houses
for tho entertainment of strangers and
travelers, whenever necessary for that
purpose.
It Is thought by many good citizens,
among whom nro thoso who rcmonstrato
nnd those who wero witnesses In theso
cases, Ihat no licenses should bo grnntcd
under any circumstances.
Courts sit to ndmtnlstci the laws, not to
repeal them. Tho opinion of tho Supremo
Court, delivered by Judge, Agnow, nnd re
ported for the guldanco of tho suuordlnato
Courts, holds that whether any or nil li
censes should bo grnntcd Is n legislative
nnd not a judlclal.qucstlon. Ho says that
for tho Courts to hold that no llccr.se shall
bo granted to any ono or Mint Itccnscs shall
bo granted to ovcry ono who has tho re
quired certificate, Is not to decide judicially
on the merits, but to determine beforehand,
outside of the law and bv the exercise of
ntbitrary will.
The law requires that tho Courts shall fix
a time by a rule or standing order, when
applications shall be hoard as therein pro
vided. If the Courts should disregard the
law so far ns to icfuso all licenses, why fix
a time for hearing ? Why hear at all, if
tho law which provides for licenses when
necessary for the public Is to bo disregard
ed? The question is not whether It Is neces
sary that places bo licensed for the sale of
liquor. If necessary for the entertainment
ol strangers and travellers, the law,
whether wisely or unwisely, bns declared
that the sale of liquor is an incident to the
business.
In respect to the application of J. B.
Mcllcnry those opposing allege that bis po
tltion does not comply with tho law because
ono of the petitioners is not a reputable
person. This objection is not sustained.
It Is shown that the person named is of
good repute ns a business mnn and ns a
citizen. And this by tho almost unanl
mous testimony of bis neighbors, and by
all except some few who set up a standard
of reputation not recognized by tho general
sentiment of tho public. Better that nei
thcr that person nor nny other drink (It all,
but it docs not appear that bo drinks to
that excess thaPmakcs lilm disreputable.
In regard to tho necessity for two hotels
in Benlon, there Is a diversity of opinion
among the witnesses. Tho granting of this
license will not increase the number of ho
tcls, ns we have at the present term rejected
the application for a renewal of n license
to ono ot the hotels formerly licensed, tho
certificate not being signed as icqulrcd by
law.
There appears by tho evidence, to be
considerable travel on the roads through
Benton., and there nro times when ono bo
tel cannot accommodate the public. It Is
about ten miles In any dlrictlon to a hotel.
We think the weight of evidence sus
tains the nllcgntlons ot the petition and ccr
tlllcatc.
Mr. Hess has kept a hotel at his place for
thirteen jenrs, and until imw no complaint
has been made against lilm; on the con
trary, it Is admitted Hint he has kept for
thu country a first-class hotel. He Is shown
to be nn honest, tempeinto and consclen.

The charge of allowing drunkards at his
place at Iho tlmo designated (Long's sale)
Is not supported. Persons nt tho sale had
bottle-i, and there was elder there, the salo
being a fourth of n mile or more from tho
hotel. When they camo to tho village, Mr,
Hess finding that they were intoxicated,
closed h.s bar.
Ills sale of liquor to Stino does not show
that he knowingly violated the law. Stine
was nearly twenty-ono years of age, he
looked fully of that age, he was a married
man ani lived nt JNcwton Hamilton, Perry
county.
Hess' hostler boy, n minor, had a glas3 of
beer once In the three months that he lived
with Mr. Hess. In that ono instance there
wn3 a violation of law that applies to all
citizens ns well ns to landlords. Under
the circumstances detailed, as Mils was tho
only instnnco of the kind shown to have
occurred, in full continence that It will not
occur again, we havo concluded not to
withhold the renewal on that ground.
In respect to voune men sitting on tho
porch of tho hotel on Sunday wo havo to
say that while there is no penalty in tho
statute against It, yet a hotel should not bo
allowed to bo a lounging place for boys,
young men or tho nclchbors- It does not
appear that there worn noises or disturb
ances nt the lintel on Sunday, nor docs It
appear that drinking wns allowed, but the
moral sentiment of the community
Is justly opposed to such gath
erings on Sunday, nnd most natur
ally raises a suspicion Mint drinking
is permitted. Young men nnd boys of iho
neighborhood are not tho kind of strangers
and travelers Intended to be provided forby
the statute. They havo no business to bo
about n hotel. .V landlord U under no
obligations to keep a r'em for voung men
to go Into, to mako their toilets on n Pun
day morning, In what wns proven on that
subject wo do not find sufficient to with
hold tins license, but shnll require somo re
form in this respect for tho future.
Landlords must understand that tho
Court has n hold upon them notwithstand.

spect to theso licenses wo shall expect nnd
require n rigid ndherenco to the law.
Lounging at tho hotels on Sunday, furnish.
Ing drinks on Sunday, or election days, or
to minors or to persons of known Intern
perato habits or Intoxicated at the time,
must be strictly guarded against, so that
tho good citizens will not havo grounds
to suspect any violation of law, or to com
plain of tho manner of conducting their
hotels In any respect.
A monument has recently been erected
In Wlldwood cemetery, at Wllllamport,
to the moinory of Ellslm Howell Biggs, at
ono tlmo n resident of this town. Tho de
sign was furnished and drawn by tho Hev.
J. H. Hopkins. Tho monument Is mado of
lino while Sicilian marble. On tho top of
tho gable Is a beaded cross which runs Mm
full length of tho tomb. Under tho two
sldo gables nt tho head thcM Is nn nntlquo
cross In relief while nt tho foot Is the mon
ogrnm. Under Hie two sldo gables set In
cusped panels nro tho Greek letters alpha
and omena. On tho left and right sides
set In plain panels nro tho Inscriptions:
"Ellsha Howell Biggs," nnd "Nov. 18, 1843,
April 1, 1883."
Theso nro mado In mcdlmvnl letters and
between each word Micro Is a small cross.
The workmanship It very fine and Is equal
to anything that has been done nbtoad,

found In the river near James Sponenberg's
last Saturday morning; was buried at Ber.
wick in tho evening. Ho appeared to bo
nbout 45 years of age, sandy whiskers nnd
black hair, over .five feet in height, with
serious wounds in tho fore rlait of tho
head, couple empty pocket books in his
clothes, besides a match box. He wore a
blue blouse, u bluo shirt nud bluu overalls.
It is now pretty well ascertained, nnd
beyond the shadow of a doubt, that the
new railroad that forms the connecting
link with Ncscopcck and Derlnger, above
Hock Glen, will soon bo accomplished, fol-
lowinir through Nescopeck Gap. This will
raise Iho. real estate of Nescopeck. The
surveying party, nt present writing, are
putting up nt the St. Charles. They nro n
jolly and Intelligent crew. They killed a
black snake on the Nescopeck creek last
Saturday, 0 ft. 4 Inches long; was dissected
and found to conlnin a red squirrel.
Harry Cooper Is fully established in his
new domlcil and It is ono of the finest resi
dences, not only In Nescopeck, but along
the river.
The streets of Nescopeck nre vastly im.
