Tho Afton Cornet Band will hold a festival
on the evenings of May 21 and 22 for the bene

Dr. II. W. McReynolds and Col. S. Knoir
have been appointed trusters of the Normal
School on the part of the State by the Supern.-
temlent of Public Instruction, to serve for three
years.
Tho Philologinn Literary Society will bold a
Strawberry and Ice Cream Festival in the Op
era Houso on Saturday evening of this week,
for the benefit of the Milton sufferers.
Mr. 13. Jacoby denies tho insinuation of the
Town Council at their last meeting thatho has
in his possession tools belonging to the town,
and alleges that he delivered to tho present
street commissioner every thing belonging to the
town as ,aoon as the new 'appjintmcnt was
made.
Four members of the Town Council have in
dicated their disapproval of the injunction pro
ceedings against tho Water Works; the court
in an opinion filed has indicated pretty clearly
that the town has no eroundof complaint; the
citizens generally are indignant atcn forced liti
gation which is almost curtain to result in u
large bill of costs for the town to pay. Wouldn't
it be a good time to stop now
A. poor boy named Holder, died last week,
Wednesday, in Habbtown. Having no Iriends
nor money it became necessary to have him
burled at the public expence. Considerable dif
ficulty was experienced in getting the proper
machinery into working order, all the members
of the boird of poor directors being out of
town.

Tho livery stable of the lluckalew brothers
is a complete establishment. They run omni
buses to every train, keep the streets sprinkled,
and can furnish any kind of a conveyance from
a four-horse wagon down to a pony plneton.
No town can boast of better livery accommoda
tions, nor of more gentlemanly and obliging
proprietors.
Col. C. G. Jackson's will was admitted
to probate on the 15th Inst. The widow and
M. W. Jackson are tho executors. A bequest
of $2,000 is made to the Board of church ex-
tensiou of the M, E. Church, and $3,000 to the
Missionary Society of that church. Col. Jack-
son had a life policy of $10,000 in the ..Etna in
favor of his wife. His estate amounts to some-1
thing between S200.000 and $300,000.

by Vice President Wheeler. It is also said that

Kansas all winter," says this writer, "and only
only one colored person was convicted of

larae. Some one kindly carried it from the

Joe, a noble Newfoundland dog belonging to
.Air. Richard took it in charge, showing almost
human tenderness in his sympathy for lna in
jured friend. He lay down on the pavement
by the side of the little dog and would allow no
one to touch it. Several boys tried every de
vice to get Joo away but all in vain. Wo do
not know what became of the litllo dog, but
hope that some one kill oil it to put it out of its
misery.

Early on last Thursday morn ing the sad news
reached us of the death of Miss Elmira Poust,
a most estimable young lady who has been a
Dieted two or more years with a nervous, men
tal and optic affliction. Having nearly rccov
ered her health, it was believed that an opera
tion by a skillful optician might restore her
siaht. She was taken to Wilkesbarre a few
weeks ago where her eyes were operated on
from which she teemed to have recoived no
iniurv. but was feeling very comfortable. Th
prospect of speedy recovery seemed to bright-
en, but alas; several days subsequen tly she be
came suddenly very ill and expired within lif-
teen hours. She was the only daughter of Jon
athan Poust and the bereaved parents hare th'
sympathy of a deeply allected community,

common right a borough is bound to keep its

Certainly in some form, the courts hnvo pow
r lo compel tho performance of this duty or to
punish for Its nn performance. In many of
tlio blates it is held that nn Indictment will llo
gainst the municipal corporation itself for ne
glecting tho duty lo keep lis streets in repair.

ndiclcd for neglect of duly. In this State the
practice has uniformly been to proceed agajnst
the officers.
The 7lh section of the Act organizing the
Town of llloomsburg confers upon it all the
powers of boroughs given by tho several sec
tions of tho Acts oflS3i, 1S51 nnd 1S50 there-
n mentioned. The Act of 1S31 makes il tho
July ofn bmgea of a borough to cause to be
opened all the streets, lanes or alley, and for
neglect or refusal so lo do mnkes him liable to
ike penalties as incurred by supervisors of
highways for similar offences.
The Act of 1851 gives power to regulate tho
road', streets, Ac, nnd tho height', grade'.
widths, slopes and forms thereof and all needful
urisdiction over the same. It is also by the
lith section made the duty of the burgess to en
force the ordinances and regulations to remove
nui'nnces and exact a faithful perlormance of
the duties of the officers appointed
Needful jurisdiction over the streets and at-
eys includes both the power and the duty to
keep them in reaionable repair and safe lo bo
traveled. When the law grants anything to any
one, llist M'o is granted without which the

The Tuwn Council have control of tho funds
of the corporation. Tho street commissioner- is
but a subordinate officer subject also to tho con
trol of the council. .The council nre therefore
responsible to the public if the streets aro per.
milled to be out of repair to the extent charged
in this indictment.
They arc not indictable for errors of judgment
in matters committed to their discretion. But
ibis immunity does not extend to neglect or re
fusal to do what tho law enjoins upon them.
Il is contended that no general law imposes
upon council the duty of seeing toil that the
streets are in repair. I hold however that the
territory incorporated by the Act of 4 March
1870 as "The Town of Bloomsburg" becamo
and is subject to the general laws so far as re
gards tho powers and organization of a town
ship, and also to tho general laws in regard to
boroughs with few exceptions
I hold also that independent of legislation in
regard te jurisdiction over the streets that the
common law impoicd upon the municipal au
thorities tho duty of keeping tho streets within
their borders in repair.
The indictment, as amended, alleges with
reasonable certainty that the defendants were
town council and acted as such and it also al
lege) that they neglected their duly. Accord
ing to tho precedents this is a sufficient aver
ment, that the matter neglected was a duty.
The motion to quash the indictment is over
ruled and the defendants are directed to plead
thereto,

There has been somo dissatisfaction on
the adjournment resolution passed by the
House on Saturday, but nearly every
body has become reconciled. Two or three
measures of Importance will fail by reason of
adjournment on May 31st, but they are not
of a kind upon which satisfactory legisla
tion could be had if Congress should remain
in session all Summer. There will be no
difficulty in passing the appropriation bills,
tlio Uto agreement bill, the Eaton tariff
commission bill, and disposing of the more
important private bills on tho calenders of
the two Houses,
Tne friends of General Grant here figure
out considerable gains for him if the New
York and Pennsylvania delegates to Chica
go disobey instructions. Theso alleged gains
are in the west and south mostly. No doubt
whatever is felt by any of Grant's Washing
ton friends of his nomination on the first
formal ballot.
Senator Bayard will have up to-day his
bill providing for tho payment of Feder
al election marshals, and hopes to pass it.
As the bill lias the samo "rider" that caused
a veto of the Immediate Deficiency bill, Mr.
Hayes will probably veto this, also, audit
is said that he will call nn extra session of
Congress, if, after tho veto, no provision is
made for the marshals, I havo failed inad
vertantly to mention that a paper called the
'Exodus," has lately been established here
by an association of colored men. In Us
first number it piesented the name ot Sena
tor Bruco as a cainlidate for Vice-President,
and argued with great force that, if the
Radical party wished to act tip to its pro
fession of special regard for the Colored
raje it could do so by giving to Senator
Bruco this nimiiiatlon. Hun, Fredrick
Douglass, the ablest of all of tno Colored
citizens, publishes a letter this morning In
which he, also, advocates Ilruce's nomina
tion, The Impending split in the Radical
party will cause the defeat of any candidate,
no matter who he may be, and tho sugges
tion toolfer tho, empty honor to Bruce Is at
least harmless,
Washington will entertain inoro strangers
than ever before except at ti "flreat Re
view" at the close of the war, aDd the Pres
idential inaugurations, Tho boat race has
not only captured all Washington, but, ap
parently, all the other cities. So far every,
thing promises well, and the contestants are
ill excellent condition.
