The opinion of Judge Kocknfellrr was filed
on Thursday morning, in the matter of the
Town of Iiloomsburg vs. the lSloomsburg
Water Co., dissolving the preliminary injuc-
lion.
A little cbihl of J. Keller, came near meetine
with a very unpleasant death on Tuesday after
noon. It fell into a cess pool, and when found
was nearly suffocated, only one leg being visi
ble. A few moments longer would have ended
its life.

Jacob Itomboy, who was married a few years
ago to Mrs. Arthur of this place, died at his
home in California, recently. He leaves a large
amount of properly in California, also in this
section where he lived for a number of years
and was well acquainted. Hisnuny friends will
mourn his loss.

On Friday afternoon last a horse belonging to
T, Conner escaped while being unhitched
nnd lan off. While attempting to turn th
corner of tho alley at E. H. Little's on
Third street, it slippid and fell against Mr. Lit
tle's iron fence, ba Ily damaging the fence, and
breaking the horse's leg. When it was found
how severely the horse was injured, it was shot
to end its sufferings, The fence was immedi
ately repaired.
Mr. Thomas A. Scott has resigned his posi
tion ns Presidcntot the Pennsylvania Railroad
Co, He has hem In the service of this company
for nearly thirly years, and gradually rose from
General Agent, until he roiched the highest
honor conferred that of Prtsident of tho road.
He tenders his resignation because of feeble
health, the nrduous duties imposed upon him
being moro than he can heir, in his present
condition.

or nine feet deep at that oint in order to get
the pipe under the culvert that crosses Market

Morris was able to be about on Tuesday, It

in death.

fendant. Affidavits were read and nreiments
made by J. It. Hobiun solicitor for the plain
tiff; and by Col. Freeze for tho Water Company
and Col. Knorr for Mr. Itlrklnblne. Among the
affidavits are those of four members of the Town
Council, a majority, saying that they believe the
work Is being properly done. Under this state
of facts, who is It that is asking for an injunc
tion? Judge ltockefollct took the papers und
promised an early decision.

On Tuesday last It was with profound irrlef
that our people leuned of the unexpected death
t lol. Jackson, of Berwick. He had iut re
tired to bed 00 Monday evening, apparenily in
good health, and died without a woid or strug
gle. He was 38 years old last March Ilia fu
neral took place on Thursday and was attended
by hundreds from nil sections of the country.

1st, 1S03; wounded and captured at Chancel-
nrsville, Va , May 3rd, 1803: transferred to
Company II , 57ih regiment, January 13,1805,
and discharged by special orders Mirch 10th,
lbGo. Such, in brief, is a history of his formal
record. lis actual one would involve a volume,
but is recorded in the hearts of his surviving
comrades. At the time ol his death ho was an
aid on Gov. Hovt's start".
As a politician, he has been an active, liber
al Kepu'jlican, tolerant to nil, but adhesive to
disorganization when he believed vital ques
tions were at stake. He was honored with nom
inations for office in this county, and at times
was the Chairman of the Republican organiza
tion. On Saturday last the writer sent him a letter
of invitation to address our citizens on Decora
tion Day. The reply came the evening of his
death that he cou Id not attend ''as he expected
to leave for Chicago ihehst week in May." He
had been solecteJ as a delegate to the Hepubli
can National Convention,
He was a graduate of Dickinson college, and
possessed fine literary talents. The most of our
readers have heard him as an orator, and fully
ppreciited his worth. He was an excellent
business man, and it will be impossible to re
place his loss to Iho large firm of which he-

classes and parties, by whom his sudden death
ill be deeply mourned.

On Tuesday morning the sad news Hashed
through the town, that Col. Jackson had died
during the night. He retired at an early hour on
Monday evening, not in very good heilth, and
at about ten o'clock was seized with an apoplec
tic fit, terminating in his deith in less than fif
teen minutes. He leaves a wife and two chil
dren to mourn him.
He was born March 2-ilh, 1342, in Berwick.
At tho age of 14 he entered Dickinson Semina
ry, at Williumsport, where he graduated at tho
end of two yeirs with honors. Two years
later, when only 18, he graduated at Diokin-O'i
College, Carlisle, where he was respected and
loved by his classmates and teachers
Less than two years he enjoyeJ the quiet of
home, and then yielded to his couotry's call;

lenant of Company H., which was formed iu
Berwick. Later lie became 1st Lieutenant of
the company. At the battle of Chancelloisville
he was taken prisoner and conveyed to Libby
Prison, from whence be escaped with several
companions, but was pursued and hunted down
by the blood-hounds of the enemy, and again
lodged in prison, where he remained until re
leased by an exchange which was effected about
a )car afier his attempted escape. In July of
03 ho was promoted to n captaincy, which po
sition he honorably filled to the end of the war.
In the battle of the Wilderness he a again
one ot Iho unfortunates. Wounded, lie was
captured and once more the walls of Libby
frowned upon him. Shortly after ho was taken
with 000 Union officers 10 Clurlesion where he
was under fire of the Union bitteries, poured
into the city from Moultrie. From this place
he was taken to Columbia, where he and Ills
co-i rades languished wilh only iho sky for a
canopy, burrowing in the ground at limes for
protection from Ihe cold Thus he pissed
ihrough all the varied scenes of war, fearless to
rashness almost, always generous and hooor-

husband. It is sad tint one so young, compar
ative, should die. There wis yet much fur
him to do iu life, and a bright future might
have been Ids, But, now his book is closed
and lifeless belles whero his presence was wont
