TAX COLLEOTOIW TO BE ELECTED.
An act to regulate "collection of taxes in bo
roughs and towii'liips," finally passed the Senate
list Wednesday, It provides that on the third
Tuesday of February next, and 011 that day
every year thereafter, the electors nf ench bor
ough and tosvnship In this Slate shall elect a
"collector nf taxes," whose term of cilice Bhall
commence on the first Monday of April and
continue nne year. The Court of Quarter Ses
sions is authorizid to fill vacancies occuring.
liefore entering upon his duties the collector
shall subscribe and file his oath in the Court of
Quarter Ses-ions nnd give bonds in double Ihe
probable nmounl of tates that shall come into
his hands, lo be nppioved by the Court. It Is
further provided that county ,townhip, borough,
mIioo! and other authorities authorized lo levy
taxes shall on or before August 1st of each year
after the first election of tax collector, ii-ue
their duplicates of taxes to the collectors of the
respective boroughs or townships, with their
warrants attached to collect the same, but road
taxes may be worked out as heretofore. The
collectors are vested with oil powers under ex
isting laws, and are allowed a commission of
two per centum of all taxes paid to them. Dur
ing tho month of September the tnxes charged
against them for the current year are to be en
titled to a reduction of five per cent, The lax-
ei iqion unseated lend are not lo bo placed in
Vie hands of the collector, but certified and re
turned to the County Commissioners, who shall
collect them as heretofore, 'Ihe act is not to

Courts of I.nglatid and so repeatedly decid
ed by the Supreme Court of Pennsylvania,
that tho purchaser could not bo held, but
the purchaser, as be discovers the fraud,
practiced on him, must return or tender the
article to the vender.

them, but it appears that there is no lasv
empowering them to use the public funds
for this purpose. To ascertain whether a
school board could provide books for indig
ent children, the directors of Saville town
ship, Perry county, as a foundation for a
case stated and submitted to the court, pur
chased and gave to an indigent pupil a book.
Judge Junkiu has rendered the following
decision :
Hoards of School Directors aro the crea
tion of statutory law, having no existence
outside of positive enactment. Noither
have they any powers beyond svhat the
statutes confer, or by neces.-ary implication
spring from tho duties imposed. The things
svhich they aro not empowered to do, they
must leave undone. They have no legislative
powers, are not, strictly speaking, a muni
cipal corporation. They are a special statu
tory tribunal, and it is a postulate long re
cognized that such bodies can exercise only
sttcli powers as are expressly conferred.
There is no act of Assembly svhich empow
ers school Hoards to furnish school books to
thoso pupils ss ho.e poverty prevents them
from buying for themselves ; anil without
such expriss authority, they cannot do so at
tho expense of tho District.
