a Kail Itoad Company, tho defendant
pleaded that tho plaintiff, In payment
or Ills rare, had oirorcd an excursion
ticket good only onn day that had pass
ed. To this tlio plalnlifT replied that
tholtallroad Company had often car
ried plalntiir and others holding such
tickets on other days than tho day of
Issue, and that tho conductor had al
lowed tho plaintiff to cuter tlio car,
where ho remained until ejected. Tho
court held that tho defendant should
havo Joined Issue on tho material ques
tion whether tho contract under tho ex
cursion ticket was confined to a single
day or extended ton longor period, and
further decided thattho replication was
insufficient, nnd therefore gavo Judg
ment for tho Itall Itoad Company.
From tho decision, which diners some
what from tho general courso of decis
ions in such cases it appears that per
sons holding "excursion tickets" can
only uso them on tho days specified,
notwithstanding tho occasional prac
tice on tho part of conductors to allow
them to pass on other davs.
Tin: Safest Places. Lightning
has been ticcompanied by nn unusually
large numbor ol accidents this summer
many persons having been struck and
killed by it. In viow of tho fatality
tho electricity oftlioclouds carries with
it, it may not bo unndvisablo to stato
a few facts of general benefit. Tho safest
situation during n thunder storm is tlio
lu-einent, for when a person Is below
the surface of tho earth the lightning
must strlko it before it can reach him,
and will In all probability bo expended
in it. Dr. Franklin advised pcrsous
apprehensive- of lightning to sit in tho
middle of a room, not under a metal
lustre, or any conductor, and to lay
their feet upon another chair. It will
bo still sarer, ho sald,to lay two or threo
bedsof matrcsses in tho middlo of tho
room.and folding them doublo, to place
chairs upon them. Persons in tho field
should prefer open parts to tlio vicinity
or trees, etc. Tho distanco or a thun
der storm, and consequently the danger
is easily estimated. As lightning trav
els at tlio into of 102,000 miles in a sec
ond, its effects may bo considered as in
stantaneous within any moderate dis
tance. Sound, on tho contrary, is trans
mitted only nt tho rato of 1,1-12 root, or
about VAft yards in asccoud. By accur
ately observing, therefore, tho tlmo
that intervenes between the Hash and
tho noiso or tho thunder which follows
it a very near calculation may bo made
of its distance, nnd thcro is no better
means of removing apprehensions.

tended effect of that portion of tho act
or April 5, 1870, which related to tho
killing of woodcock, or indeed any pro

mandery was in waiting, and took its
proper position. The column then
marched through tho principal streets
under tho Marshalslilp or Sir Knight
O. B. Brock way, and at Kosteubaudcr's
Hotel tho officers or tho Qrand Lodeo
joined tho procession, which then
marcned directly to tho Hall.
At this point occurred tho most pleas
ing part or tho programme. As sooa
us tho Knights had disarmed tliemsel ves
they wore invited to participate in a
Magnificent dinner prepared by tho
now Commandery. They atoas if thoy
had Just relumed from a seven years
slego or Jeru-alem; but there was
enough, and to spare.
