WHEREAS, Elisha Smith, one of the heirs of
James Smith, Ute of Southampton Township, pre
sented a petition setting forth that said James
Snrtb, lately died, leuving a widow, Naomi, and
issue, twelve heirs, or the representatives of heirs,
vis : John, residing in Fulton County, Fa , Elisha,
the petitioner, Hetty Moss, intermarried with
Philip Moss, Precilla, intermarried with William
WipAeld, Jolly Vurphey, deceased, leaving a bus
bahd, Jas. Murpbey, and issue five children, to
wit; Sand), James, Philip, Elias and Jolly; Harri
son. Gideon, Harvey, Sarah intermarried with Hen
ry Smith. Morgan, Mathew, now dead, leaving five
children to wit, Sanh, Jamus, Philip, and Emtn
u.J who resides in Fulton County. The other heirs
reside in Bedford County except Morgan, or his
heirs, whote residence is unknown. That said in
testate died seized of three tracts of land, viz;
The Bickeu tract on mansion piece, containing
four hundred and forty acres, adjoining lands of
Geo. M iv, Le's lands, James Peun '1 and ot .era.
One other tract containing about sixty-six acres,
adjoining the above tract and Lewis Miller. One
other trar, containing about titty-five acres, ad
joining Lees iauds, uii situate in said Towns dps of
Southampton.
Notice is, thercfote, hereby given tint in persu
ar.ee of a writ of partition, or valuation to me
diiected I will proceed to bolt an Inquisition or
valuation, oa the premises, on Thursday, the 10th
day of April, 1862, when ..nd w here all parties in
