WEDNESDAY MORNING Sept 29, '69, Gen. Rosearans briefly telegraphed to tho Democratic authorities in Ohio that duty to his family and his credi tors forbade his acceptance of the nomination for Governor. This dis patch has been supplemented by a letter in due course of mail, in which the General devotes two columns to a discussion of the Democratic situa— tion. It is a trenchant compositicn, and goes far beyond John Quincy Ad ams, son, grandson and great-grand son, in the demand for a "new depart ure." What of old gave the Demo cratic party its prestige and spirit' General Roseerans says, "Was its profound faith in the ca pacity of man for self-government and progress, under institutions based on the great principles of libertu, frata= nity and equality before the mw, and its eitnTage in carrying the„Zogic of its faith into action. Thence arose that discipline, order and,progressive orig inal ty which hayo-m marked its history. " This ie. one of the most griphic and powerful statements of what the Dem ocyatic party of to-day is not, that we have come across. The party that Roseerana pictures was the party of Jefferson,Madison, and Jackson. The party of to day, under the leadership of Vallandigham, Pendleton, Jerry Black and Seymour, is its opposite in all the essential principles guarantee ing and protecting the rights of man. Then listen to this. Fancy its be- log addressed to a Democratic Con— vention in Pennsylvania, or such an * diences as Pendleton talks to in Ohio. Says the General: "The country requires, and the Dem ocratic party ought to be, a party of life of action. and vfprogress. Fossils and fault-finders do not properly he • long to tho party, and if found in it ought to go on the retired list, leaving to its opponents, of all shades and grades, all narrow and sectienal grounds, all monopolies and favoritism, based on slass, creed, race, color or na tional origin. The Democratic party of the United States ought to hold high the banner of universal freedom, impartial justice and equality before the law, of all who live beneath the flag of our country." Universal freedom, impartial justice and eqUality before the law, as Dem ocratic symbols, would be the most stupendous joke of the day. Yet this is the Democratic General Rosecrans says he believes in and to which ho is proud to belong, Who are his asso ciates. we would like to knew. Cer tainly not the men who make plat forms at Albany, Harrisburg, Colum bus, Indianapolis or Springfield. It is evident the gospel, acording to Pen dleton, has no favor with General Rosecrans. What would be more scath ing than this denunciation of the quib bling greenback doctrine, remember— ing that it is addressed to Democrats : "No local declarations inviting a popular prejudgment of any legal questions about the terms of payment of the national bonds should impair the priceless value of the public credit, at a time when it is all important to create the speediest means of ridding the country of these enormous op pressions; but every Democratic plat form should tend to raise higher and higher the public credit, and to satisfy the people of Europe that the Demo cratic party is the last party in the United States that proposes to whine or act reluctantly about the payment of the public debt, even though its pres ent holders should have bought it below 2ts fair value." What cutting sarcasm is here.— " Democratic platforms should tend to raise higher and higher the public credit," says General Rosecrans to the Ohio Democracy, whose constant la- bor it has been, and is now, to depre ciate the public credit by sacrificing the national honor. But the 'most unkindest' cut of all is the curt way Rosecrans dismissed the eleven stubborn jurors who may decline to acquiesce in his new de narture. "Should there be Demo crats," he says, "whose mental or ganization or temper does not permit them to recognize existing facts, or conform their action to great popular changes, let them, for the public good, abdicate the leadersh.p, and leave the energies of the people free to act in the line of life and progress." This sending the party to tophet with a vengeance. CAMPBELL vs. Lacock (4 Wright, 448.) This was a case in which one of two partners (Getty & Geissinger) sold out his interest to the other, who agreed to pay all the debts of the firm. Lacock became security for Geissinger, the purchaser, for the performance of the contract. Camp— bell, a creditor of the firm, sued La cock upon his guarantee.
