ROW OFFICE EXTORTIONS.
Illegal Fee. Action of the Bar Report of the
Committee of tbe Law Association.
The committee appointed by the Law Association
upon the subject of the Illegal fees charged by pub
lic oincers In the county of Philadelphia, and to
consider the most effectual means of reducing the
charges to those stated In the fee bills, beg leave
to report
That they have bad several meetings, at which
the matter submitted to them has beeti discussed,
but that owing to the various engagement of the
members of the committee, they have not been
able to complete the duties of their appointment,
and respectfully ask that they may be continued
until the next meeting of the association, when they
will be able to present In full their plans for tbe
suppression of the extortions practised by the
ofilcers of the law upon litigants.
Your committee beg leave, however, now, to sub
mit some of the measures which they have agreed
to recommend, and which, if adopted and carried
out, as the committee trust and believe they may
be, will be, they think, eftlcaclous la speedily reduc
ing the fees from Irregular and extortionate charges
to the fixed legal fees established by the acts of
Assembly on tbe subject, and wnich your committee
believe are more than compensatory and remunera
tive to the officers.
Yonr committee And upon examination that, ex
cept In one or two of the ooiues, there Is an increase
In the Illegal fees and extortion after each election
as each new incumbent assumes his office; and
that however oatraareous mav h ve been the illeirui
gains of bis predecessor, the new officer Is not oua
tent until he has either Increased upon the existing
charges, or made and created new ones even more
Illegal and extortionate; indeed, the fee bills are
utterly Ignored, and If the various acts of Assembly
had been repealed they would not more effectually
have been banished from mind and memory. This
Is particularly the case In the otlloesof the Sheriff
and Keglster of Wills, and It Is therefore to these
'wo omcers mat yonr sommutee will direct their
attention first.
In the case of Jackson vs. Pardue, 8 Penn'a R.,
6S2. the Supreme Court ruled that "the Legislature
have shown great anxiety to restrain onloers from
charging cr taking illegal fees;" and that the officer
is prohibited from "taking greater or other fees than
those expressed or limited ; from charging, demand
ing, and taking any fee when tbe busiuess for which
tbe charge is made has not been actually performed;
and from charging or demanding a fee for services
unless the services are expressly provided for by the
act." 1 he court add, "The object of the act was to
shield debtors from oppression, and particularly to
guard against compensatory fees. The penalty Is
given to the party Injured ; and whether the charge
Is made lgnorantly, or oppressively, and fraudu
lently, Is iuimateriaL" In that case the illegal fee
was paid upon an execution, but the court held that
the officer who laued the execution, with his costs
endorsed, was liable.
Your committee beg leave then to present the fol
lowing measures for your Immediate action:
1. That a solicitor be chosen by the association
at once for the purpose of prosecuting actions to re
cover and enforce the penalties prescribed for taking
and charging illegal feel, la all cases which may be
brought to his notice.
Your committee will say In this connection that
tbe name of John J. .Kldgway, Esq.", has been sub
mitted to them to till the position of solicitor, but
they leave action upon this nomination to tbe asso
ciation, recommending, however, bis appointment.
8. That the solicitor be directed to notify
the Sheriff to eomply with tbe eleventh seotlon of
the act of February 48, lssfi, which requires him to
place and keep op in some conspicuous part of his

"An aet relating to townHhlps and county and town
ship offices;" and also to request all officers of the
Bow and the Kecorder of Deeds, whose fees are
ascertained, limited, and appointed by an act enti
tled 'An aet to establish a fee bill," passed March

tor, who shall thereupon take action upon the same,
without cost, charge, or trouble to the citizen fur
nishing the same, or requiting his sttendance at
Court, as the receipts, with the record of the particu
lar case, will be all the evidence necessary to re
cover. Your committee beg leave to submit an act which
they have prepared, and which they would recom
mend should at once be forwarded to Harrlsburg in
such a manner as will secure Its Immediate passage,

An act relating to the mnde ef procedure in certain
actions.
Section 1. That In all actions Instituted In any
court, or pending an appeal from aldermen or jus
tices of the peace, brought to recover Illegal fees,
er tho penalty piovided by law for receiving illegal
fees, the plaintiff mav enter judgment for the
amcunt claimed on or at any time after the
third Saturday arter the return day, unless
the defendant, his cleik, or deputy, as herein
after provided, shall have tiled a sufficient affidavit
of dtfense stating the natute and character of tho
same: provided that the plaintiff shall have filed
within two weeks after the return day a statement
specifying the fees charged to be llleg.il, tue date of
payment, and the name of the ofilcer, clerk, or
deputy who received the same; and in all cases the
affidavit ef defense shall not be considered sufficient
unless made by the officer, clerk, or deputy alleged
to have received the same. And the Courts of Com
mon Pleas shall have original concurrent jurisdic
tion of all such actions.
Section U 'J hat It shall be lawful to go to trial
upon the said statement and affidavit of defense
without other pleading, saving to each party the
right of amendment as in other oases.
Section 8. That the provisions or an act of Assem
bly, entitled an Act relation to the Conntv of Phila
