The following li a copy of the bill passed by City
Councils for the creation of a Paid Fire Department,
and transmitted to the Mayor fur his approval or
rejection:
Section I. The Select and Common Connclls of the
city of Philadelphia (to ordan. Tnat the Fire Drparw
ment shall consist of seven (T) Fire Commissioners,
one Chief Engineer, Ave Assistant Engineers, and as
Disny foremen, englnemen, hoseinon, nook and Ud
der men, and other persona, to be divided Into com
panies, as the numk'f of engine and other Ore ap
paratus belonging to the city shall from time to time
require.
Section I. The sad Fire Commissioners shall be
Citizens of Philadelphia, of good charaoter, not
otidcr thirty jears 01 age, who shall serve without
com pen Ration, and be elected as follows: Three ny
Select Council and four by Common Council on the
last sated meeting In Decern rr, 1ST0. The said
Commissioners, when elected, shall draw for their
respective terms of office, three for the term of tw
years and four for the term of four years ; and every
second year thereafter, at tueir first stated
meeting, in the month of February, there shall be
elected in the same manner three or fonr persons,
as the case may be, by the Select or C iruirfon Coun
cils, In which the vacancies may occur, to serve for

ber shall, at all times, be represented by one mem
ber In said Board of Fire Commissioners. The sld

Section 8. That In case of ueath, resignation, dts

fusal to perform the duties Incumbent upon their

Sec tl n 4. That the said Fire Commissioners shall

Ave hook, and ladder companies; and thereafter
such numlter of companies as they may from time
t lime be authottzed and directed by Councils.

atricdy accountable therefor to Councils, ty whom,
upon conviction of dereliction of duty, malfeasanoe
In oillce, or violation of anv of the provisions of this
ordinance, after a hearing before the Joint 0m
m it tee on Fire Department, they shall be removed
from office.
Section 5. The said Fire Commissioners shall hold
at least two stated meetings monthly, and keep a
correct record of all their proceedings, subject at
ah times to the Inspection of. the Mayor and Coun
cils, and their committees, and shall annually, In
the month of January, prepare an accurate report
to Councils or the state of tne department. Tiiey
shall have authority, in conjunction with the Com
mittee on Fire Department to tit up and appropriate
to their use, and that of the engineer!, suitable
rooms as offices, the necessary expenses of which
shall be defrayed out of the fuuds appropriated
for the UBe of the department, and -the
presldynt of the commissioners shall have
authority to draw warrants upon the City
Treasurer for such sum or sums of moneys as they
mav from time to time require, not exceeding the
appropriations by Councils; provided that all bills
for expenditures shall first be submitted to and ap-
? roved by the Committee on Firo Department,
hey shall have power to suspend or expel any
member of any Are company, and to reorganize any
comr any, and they shall also adopt a suitable uni
form to be worn by the officers and men. The said
Fire Commissioners shall also have authority to
make such rules and regulations for the govern
ment, discipline, and ordr of the department, and
for the extinguishment of Ures, as tbey may. think
nectasary and expedient, provided such rules and
regulations be not Inconsistent wi ll any ordinance
of Council. All meetings of the Fire Commission
ers snail be open to the public.
Section. That on the Sd day of January, 1ST1,
the Hre Commissioners, as herein provided for,
shall meet and organize and elect from their num
ber a president, 'i'bey shall alio elet a secretary
and messenger, who. by virtue of their oilloes, shall
be members 01 the Fire Department. The secretary
shall also perform the duties of clerk to the Chief
Engineer, and the messenger shall also be messen
ger to the Chief Engineer. The said Fire Commis
sioners shall al bo give public notice byadvertise
ment In at least three newspapers for one week that
they are prepared to receive applications for mem
bership in the tire Department and proposals for
the sale or lease to the city of such lire apparatus,
houses, horses, and other property needed by them
(or the purposes of the department.
Section 7. All officers and members of the Flro
Department shall be persons of good moral charac
ter, and shall retain their respective positions for
and during good behavior, and for such times as
they perform their duties harmoniously with their
associates and satisfactorily to the Fire Commis
sioners. They shall not be subject to removal on
account of any political, religious, or other senti
ment t-nterteiued by them, so long as such opinion
or sentiment does not Interfere with the faithful
aid efficient die charge of their duties as members
of the Fire Department.
8ction8. That the salaries of the officers an t
employes of the Fire Department shall be as fol-

Firemen, each, eight hundred (400) dollars per an
num. Tillermen and drivers, each, seven hundred and
fifty (750) dollars per annum.
Foremen, each, four hundred and fifty (430) dollars
per annum.
And the hose and hook and ladder men, each,
three hun Jred and sixty 300) dollars per annum.
And all of said salaries shall be payable monthly.
(Section 9. Every officer and member of the Fire
Department shall, before entering upon bis duties,
sign the following agreement to be deposited with
the Fire Commlsbloners:
"I, A. B., having been appointed a member of the
Philadelphia Fire Department, hereby agree to abide
by ail the ordinances of the Councils and rules aud
regulations of the Fire Commissioners relatlug
then to."
Any officer or member who (hall neglect or refuse
to sign the same shall not be entitled to receive any
compensation whatsoever.
Section 10. No person under twenty-one years of
age shall be an officer or member of the Fire Depart
ment, nor shall any person be an officer or meinoer
Who Is not a legal voter In the city of Philadelphia;
and no person holding office of any kind under the
United mates. Commonwealth of Pennsylvania, or
city of Philadelphia shall hold any office created by
this ordinance.
Section 1L The Chief Engineer shall have the sole
command at tires over the Assistant Kugtneers,
Officers, and members of the Fire Department, and
all other persona who may be present at nres. Tie
shall direct all proper measures for the extinguish
ment of nres, protection of property, and preser
vation 01 order. It shall be his duty to examine
taito the condition of all the lire apparatus and
houses connected therewith a often as the Fire
Commissioners or Councils may require ; and when
ever the engines or other apparatus shall jed
alterations or repairs he shall report the
name to the Fire Commissioners, who shall
cause the same to be made, lie shall trans
mit to the Fire Commissioners all returns of officer,
members, and companies ; keep f tr and exact roll

admission and discharge, and name, age, occupa
tion, and residence of each member, lie suau, an
nuafly, in the month of Jauuary, and oftener If re
quired by the Fire Commissioners or Councils, report
to them of the condition of the bouses, fire appa
ratus, and other property of tho department, toge
ther with the names of the officers and members of
the various companies, tho number of llres since

damage as near as cau be ascertainei.

Section is. Every engine company shall have one

Section 19. Fsoh engine company may have extra
men no; exceening four In number, and eci hook
and ladder company not exceeding six. They shall
not be entitled to pay except when ordered on
duty in the plaoe of absentees, when they slMll re
ceive the same pay, to be deduoted front the
monthly sslary of such absentees. Said extra men.
shall be furnished by the Commissioners with hat
and badge without charge therefor; In the case of a
vacancy in the company to which they are attached
they shall. If worthy and competent, be eligible to
promotion to fill the same.
r ectlon 1. The Fire Commissioners may grant to
any officer or member of the department. If they
deem it compatible with the interests of the depart
ment, a vacation, not exceeding two weeks in any
one year, upon such terms as they may think expe
dient. Section to. The Fire Commissioners shaH have
power to remove such of the lire-alarm signal boxes
as may not be needed, and locate the same and such
others as tbey shall deom necessary ; and they shall
also niBke such modifications In said boxes and the
manner of giving alarms of fire as thev shall con
sider requisite aud necessary for the efilolent work
ing of the Fire Department ; provided the same be
done nndei the supervision of the Department Of
Fire-alarm and Polico Telegraph.
Section SI. The present Fire Department Is here
by placed under the dlreotlon and control of the
sahl Fire Comm 1st loners, subject to thetr rules and
regulations; and they shall bavo full power and
autnoilty to suspend any company or companies
from active service for violation of the same, or
dismiss them from the Fire Department. The pre
sent Chief and AsafetvSit Engineers are hereby di
rected to report tajwi obey the rules and regula
tions of said Fire Commissioners, and whenever
they shall deem the services of the said Chief a ad
Assistant Engineers no longer necessary thetr term
of office shall cease.
Section ss. That the Fire Commissioners are
hereby authorised, If they deem It advisable, to
lease upon such terms and for such length of time
not exceeding three years as they shall think neces
sary and expedient, or purchase saoh of the appa
ratus, bouses, and other property of the present lire
crmpanles as will insure the immediate and efficient
service of the department. No house rented or
leased by the said Fire Commissioners for the use of
the department shall be occupied by other tenant or

Section S3. That It shall not be lawful for any per
son or persons to Injnre, rtfaoe, or In any manner
destroy any ol the lire apparatus, or property of the
aame, or any police or lire-alarm telegraph box or
wire, or hinder or obstruct any engine or hook and
ladder company, or any member thereof, or officers
of the department, from freely passing along the
streets of the city to or from a Ore, or In any manner
hinder or prevent any of the said fire companies, or
any membeT orfoQloerof the department, from ope
rating at any lire.
Section 84. That It shall not be lawful for any per
son or persons knowingly to give or cause to be
given any false alarm of fire by means of the tele
graph signal boxes.
Section 2ff. That it shall not be lawful for any per
son or persons, without the consent and authority
of the Fire Commissioners, to have In his or their
possession, use or make, or cause to be made or
used, any key or keys to any fire-engine, hook and
ladder house, or telegraph signal box, nor shall any
person or persons not a member or officer of the
Fire Department use, or wear, any part of tho uni
form determined upon by the Fire Commissioners,
wltbont their permission first had and obtained.
Section 86. Any person or persons violating any of
the provisions of sections S3, 24, and 35, of this ordi
nance, shall surfer and pay a tine of not less than
live dollars, nor more than one hundred dollars, for
the use of the city. Such fine to be recoverable as
like penalties are now by law recoverable.
Section 87. That the sum of foo.ooo be and the
same is hereby appropriated to the Fire Department
for the expenses of 171, for the following purposes,
to wit:
