On the Count's mentioning, with imprenemenl, that bis motion was to increase the amount of damages to $50,000, Mr. Beach, who was coun sel for tho defendant, exclaimed in a somewhat excited manner, "You can increase it to a mil lion if you wish." "Very well," returned Ihe imperturbable Count;" "I take you at your word. Although John Real, who killed Officer 8me dick, is far gone In consumption, and will pro bably not live six months, he is taking as much interest in the possibility of being set at liberty as though he were good for twenty years more of pleasurable freedom. Ho Is hardly more than mere skin and bones, and his moral nature seems to have grown as emaciated as his body. Ills counsel, cx-Judge Stuart, contends that the Supremo Court, which denied Real a new trial, was an invalid tribunal under the provisions of the new State Constitution, which emphaticully forbids a judge who has tried a case from taking n purl in it upon appeal. Judge Barnard origi nally tried the case, and hence became disquali fied from deciding in it upon appeal. The Supremo Court Room Las been crowded to ex cess during Ihe development of these newphascs in the Real case, and will continue to be so until some ultimate decision has been arrived at. Thins Theatrical. A little bird, call it a journalistic magpie, has whispered to me that at least two theatres in this city are about to pass into other hands. One of these is tho Tammany, which, by-the-by, eecms to have experienced the process known as "passing into other hands" ever since its first inception. The expenses are very great, but . somehow or other people won't go there. Tho attractions there of late have been of the most Mood-thirsty and harrowing description, but the star of the Tammany, under the present ma nagement at least, seems on tho decline. Yet Jlr. Leonard Grjver looks happy enough to be long to the Fat Men's Club, and is as beaming and debonnair as he ever was during bis palmy days at Washington or his Sinn-f ul days at the Chcsnut Street Theatre, Hilladelphia. The other theatre over whose spirit u change is to creep is the Fifth Avenue. Mr. Daly has done artistically well there, but he has lost money. He tried hard to cmulato "Wallack's, and even surpassed that brilliant old iogylsm in the style in which several of his plays were produced. He pays larger salaries to the members of his stock company, and he ought to pack bis little theatre nightly, but he don't. Perhaps this is partly duo to the fact t Jint personally he is. timid, almost bashful an Ktrcmely phenomenal accident for one who has ten so much of the world. To be bashful is a (tonstrobity in a newspaper man, as Mr. Daly )as been. In a theatrical manager it is abso lutely criminal. If Mr. Daly would only thaw, and stay thawed, he would make many friends. And is not the art of making frlonds a part of the art of success in life, whether a man be a crossing-sweeper or a sensation newspaper in terviewer? Dir. Train. George Francis Train and the Cooper Institute have bad a fight, and Mr. Train lays his damages at $2000. On Sunday evening he was to have preached I mean lectured on the "Old Fogies of the Bible." In consequence of his having blazoned bis intentions, however, In a manner distasteful to the political creed of the pro prietors of that building, he found, on proceed ing thither, the doors closed against him. He forthwith went home, wrote fifty-five letters and as many epigrams to the daily and weekly press of this city, and procured one of the most exteuBlvo and gratis advertisements of the period.
