The Attorney-General, under date of April lit, IMiW, In reply to a letter from the Secretary of the Knvy, kIvoi tlie following opinion: Hon. A. K. Hohik. Hii retarv of tho Navy Rlr: 1 have the honor to ai-kiiowlnduK the receipt of your letter of April 11, lHOii. In which you ask my opinion upon the true meaning and ctleet. of the act of t'on liress annroved June Vfi. lnrts. which dxesthe nunilaT of hours constituting a day's work of laii:rers, work men, ami mechanics Ititlin eiiiplnvment oi ine i mica Ststes, tiiken Iu eoiinectloii with the act of July PI, ls2, w hich provides "That section eight of tlie act to further promote the entcieiiry of Hie navy, Bpiuovcd Dei'eiiiber 111, lsrtl ism . oo niueimeii follows: 'That the o as . to rend as hi li rs of lubor ami the rate f wages of employes In the navy yurds sluill conforni, as nearly as con sistent with the pulillc, Interest, with those of pri vate estaiilislimeuts In the Immediate vicinity of the respective yiirds, to be determined by the ciiiu n andants of the navy yards, subject to the ap proval and revision of the Secretary of tlu Navy.'" Iu reply I have the honor to state, that the whole subject was itilly considered In the opinion of my picileeessor (Mr. Kvnrts) to the President on the i.)t h of November, IsiiH, to which I beg leave to refer you, and from tlie conclusions of which 1 see no reii-on to dill'er. in my opinion the statute of June lift, lsds, has nothing to do with the compensation to oe pum worMiicn hi ine navy yarns, ami leaves ilia" to be determined under tlie provisions of the act of jiiiv m, is iw. 'l ne provision that eight hours sluill constitute n day's hilior has no tendency whatever to show whether the day's labor thus established shall ic .paid at a lower or higher rate thanadav of ten hours' labor, or at tho same rale. The rnte of com- letisation is still lelt ny law to be determined under he tule prescribed by the statute of July 1ft, lsiii, so as to conform as nearly us consistent Id the public Interest with those of private esta iiisiuneiits in the immediate vicinity o the respective yards, to be determined bv the eotn iniitidants of navy yards, subject to the approval ami revision of the Secretary of the Navy. If private es tablishments iu the neighborhood emnloved their hands live hours the day only, there would obvi ously be no Justice In reducing the wages of those employed in the nuvy yards for eight hours to the uniotiut nnld by the day in private establishments, nnd the law Intended no such result. On the other hand, 1 II ml nothing in the statute which requires you to pay the same price for eight hours' labor which private establishments pnv for ten or twelve. as the iimount of service rendered or the quality of work made the fewer hours in the navy yards e'qul vnlent in value to the longer time hired Iu private establishments, or for some other reason make it consistent with public Interest. cry respectfully, your obedient servant. K. 1J. Hoar, Attorney-General. In consequence of the ulnive opinion, the Secretary of the Navy sends the following circular letter to cornniiiudittits of navv ynrds ami stations: Navy Department, Washington, D. C, April 22. 1H! Sir: The act of Congress, unproved June 2ft, lstis, constitutes eight hours u day's work for all laborers, workmen, and mechanic's employed on behalf of the 'Government. While llius establishing the length of a day's w ork, Congress omitted to re peal the net or July Hi, is;2, requiring the wages ii employes in the navv yards to conform, us nearly ns consistent with the public interest, with those of private establishments iu tlie Immediate vicinity of the yards. I'ntll these laws nre repealed, the departments must abide by them. The ilepiirliiicur has no authority to extend the hours of labor by making more than eight hours a (lav's work. but it lias the right to employ mechanics, workmen. and laborers extra hours, and to pay them prorata for extra labor. Where, therefore, necessity exists for extra labor, you nre at liberty to exercise vour discretion in the matter, so ns to nssist the working classes, and id the same time do Justice to the Gov- mucin, v er.v respcciiuuy.
