Ano'ber effort, and one that Is likely to result suci esfiully, is being made to secure a reorieve tor Gerald fcaton, who has been sentenced to be bung on Tbuisday next lor the murder of Timothy Ueennu in June last. Charles W. Brooke, Esq., who represented Knton on tne trial, and Detective Tag).'art, arrived in Harris buig at an early hour yesterday morning, and about noon proceeded to the Executive rooms, itberc, after waiting a little while, they Bccured an audience with Governor Geary. Mr. Brooke stated that the object of hi) visit was to present a number of documents In sup port of another effort to secure a reprieve for Eaton. Ho then placed in the hands of tbe Governor a petition signed by eleven ol the lury who convicted Eaton, remarking that tho twelfth man could not be found. Tbe jury say that, in the evidence and charge of the Court, they believed that technically tbe grade of the offense was murder in the first degree, and that they were required to, and therefore did, unite in rendering such a verdict; bnt still they believe, and upon reflection that belief is strengthened, that the circumstances attendant upon the commission of the offentte relieved it ol tbe character of one imperatively requiiing the Infliction of tbe extreme penalty of the law, and they further believe, and so respectfully present to his Excellency, that the enas 6f public justice wi'l be fully answered by a protracted term of imprisonment of tho pri soner. The next document was the following affi davit of Dr. Bbapleigb, which is evidently hero to prove that tbe second wound spoken of, which fact for the first time in given to the E nolle, might have been fired from a pistol in ands othwr than those of Eaton, and might haye been tne qirect cause of, Heeoan s de-ttu. This affidavit ws sworn io be I ore Alderman Dougherty, the most important witness on the trial aeainst baton: Pe:8oully appeared before me. tbe undsrslsned. who being duly sworn, doth depone and say that he mde a post mortem examination ot tbe body of uimoiDy ucenui, juue u, wos at me renusyivaoia HiBpilal; that he found a gunshot wound one and a ball lncbes below the eoelform cartilage, dlreo". y lu tbe centre of the body; this wound wm fatal; there was also a gunshot wound in the left groin, making two wouBua id an. a bu. if tiiiiuii, rnysician. The next paper handed the Governor was a a petition tigned by a large number of the members of tbe Bar, representing that they were present during tbe trial of Eaton, and that as lawyers they believe, and so desire to express to the Governor, that the case was not ot that character in which the Legisla ture ever contemplated a visitation ot the death penalty. While, to far as the question of fact was concerned, the jury mteht have been justified technically in rendering the form of verdict returned therein,-yet they. uetui it u caea iu wnicn tne uovernor, standing as the last legal sentinel over the rights ot a citizen, would be discharging fully his duty in refraining from committing tbe prisoner to the severe punishment ol the law, and they there fore pray the Governor to retract his execution oi tne aeatn-warrani. Tbe labt document was a petition siencd bv several hundred citizens, pratine for a reorieve. At tne ena oi tne interview Governor Geary assured the gentlemen tbat the matter should receive bis earliest attention. Nominations by the President! Washington, April 2.
