fyears, practising his profession, and travelling

the supporter and advocate of Wnlg principles
and candidates. As belore, his legal business
became quite large, enabling him to live well
and to amass a comfortable property. During
the year 1H3U President Fillmore oilered him
the position of secretary of War, In his Cabi
net, but Mr. Bates declined the otlioe. Turee
years later he was elected Judge of the St.
Louis Land Court, holding the oflioe until 183(1,
when he resigned. He was presiding ollicerof
the Whig Convention held at Baltimore lu
1858, whlcn was the last national meeting of
that once powerful political organization.
The deceased did not ally himself to the Re
publican party Immediately upon its forma
tion. The citizen of a slave State, he hesitaied
about joining a party whosHopen opposition to
lavtry could not lail to injure his business
prospects if he early espoused them. In 18U0,
however, when It was evident beyond doubt
that the Whig party was hopelessly extinct,
he came out iu favor of Mr. Lincoln's election,
not because (as he himself wrote) the Repub
lican platform pleased him, for he placed but
little faith la political declarations, but
because it was "far better than any puo
llshed creed, past or present, of the Demo
crats." Mr. Bates, In fact, belonged to that
class of "old line Whigs" tint detested the
Democratio party and principles with an almost
personal animosity. His advocacy of Mr. Lin
coln's claims to eleoiion was rewarded by his
appointment as Attorney General of the United
Slates by the new .President. As such bis ad
ministration of the office was dlgnalizod by the
opinion lie delivered in July, le(il, favorable to
the Prebldent's power to suspend the habeas
corpus. For this Interpretation of the Consti
tution Mr. bates was severely censured by
many emiuentlawyers.and.ln turn, vigorously
defended by men of high reputations for legal
ability. The deceased resigned the Attorney
Generalship In December, 18(14, and was auc
oceaed by Mr. James Speed, oi Kentucky.

It may be remembered that In the pursuit of
convicts who escaped Irom ising .Slug In the late
revolt one of them, uumed Loon wood, alter
Ollerlng lo surrender, was unceremoniously
shot by Charles Sullivan, a guard of the prison.
Tho wounded prisoner liny- red several days in
the hospital, and died on Thursday. Ills rela
tives brought the body to this city, luteuding to
have liquiedy buried In Greeuvvood, but found,
In milking preparations for the funeral, that no
burial pei mil could be obtained without an In
vestigation Into the cause of ueath.
It appears that the only paper furnished to
the lumlly was a cerlillcate from tne physi
cian of tne prison, representing that Iiock
woi d died of a gunshot wound lu the ubdo-
nien. When this certificate was handed to an
undertaker, be shook his head and said that
Lockwood could not be burled on such a
t at er, and that 11 must be referred to the
ioard of Health. It was taken to Dr. Harris,
aud that gentleman thought it a case for the
Coroner, uud to the Coroner It was accordingly
transferred.
Yesterday Coroner Flynn visited the remains
at No. 214 Chryslie street, and has ordered a
post-moriem exsmlnatlon and au inquest,
Which be will hold to-day.
The case certainly calls for an Investigation.
There is the vital question to be settled In It,
whether a convict is entitled to the eousldera
tlon due a human belug, and whether It Is less
a crime to kill such a one than It is to kill any
other man under similar circumstances.
This prisoner and two others, after their
escape from prison, bid In a burn. Tne pri
soner's companions were discovered and se
cured, and tuey informed tneir captors where
Lock wood wus. The euard. .Sullivan, went
buck, and finding Lockwood In tne custody of
Mr. istornis, owner oi tne barn, oruereu min to
suriender, threatening lo lire upon bim. Lock
wood threw up bis arms and said treat be would
surrender, ut tue same time begging for his
Hie. Kullivan, however, cried out, ''Mow I've
tiotyou; I'll shoot you anyuow, you ," and

The prisoner was then treated as no humane
man would treat a decent ueg. anu. uoiwitu

wugou over a rough road, a distance of several
