captured in Spnnls-h waters, or in teas near the

Central Department, on the road from Remedios
toMoran. Tbe Spanish forces are commanded
by General Puello. No complete report of the
battle bas been made, and the result Is not
known, but the Spaniards claim that 800 rebels
were killed.

object lor which the committee was appoiuted,

committee do not airree with cither the counsel
for the petitioner or retpoudcut, tho first claim
ing a clear majority of 212 votes for Mr. Thayer,
nudthc latter, one of whom claims n mnjority
or 20.r, and another 24.1, ih equally the clear
majority tor Mr. Gieeubank.
Without going Into details, your com nltleo
has not been able to find any such mnjority for
either of tho candidates; ami if tho determina
tion of tho question rested alone on the returns
ot the several divisions, corrected by all the
papers which threw any light upon them, and
ot the Illegal votes proved on the one side or
the other, and the count or the ballots, your
committee would have to report that neither of
the candidates was entitled to tho otlice; forthe
cattlesnes?, to ue no harsher expression, in
mot ot the papers in making up the return is
niofl unaccountable to your committee, and
show? ftrong evidence, if not of fraud, at least
nn attempt to commit it. Rut your commltteo
is of the opinion that much stronger and
grenter reasons cxltt, why the case should be
uccided npon other grounds, from all the testi
mony given.
Tbe contestant and respondent ask your com
mtttee to reject the votej ol some twenty three
eJU'Vrcnt divisions from the return. Evidence,
however, as given only to affect the Second
und Tenth divisions of the First ward, Seventh
of the Third, Sixth and Eighth of tho Fourth,
Sixth nd Seventh of the Seventeenth. Tenth
of the Nineteenth, and Fourth of the Twenty
hflh. Amongst the internal evidence presented of
tbe fraudulent mode of carrying on the election
in come of these division?, is the proot that tho
officers received more votes in a given time
than it was possible to do In the strict per
formance of tbelr duties. The purpose of the
officers in many cases peemed only to bo to
receive the votes and put them in the boxes!
without regard to whether the person was en
titled to vote or not, and in most of the divisions
there was a very large number of voters not on
tbe list.
With regard to the Tenth of the Nineteenth,
the committee says: "Without deciding who
were the proper officers at this election division,
it is sufficient for the committee to know, from
the testimony in this cae, that irom the con
duct of tboe holdlDg the election, and of tbelr
friends on the outside, the voters in this division
did not nnd could not exercise their lights, and
that no fair election was held."
The report concludes as follow?;
Your committee have reluctantly come to the
conclusion, thouzh going a step further in tbe
Second and Tenth dlvUions of tho First ward
than has ever been done before, that it Is their
imperative duty, Irom all the testimony glveu
in this ense, to reject the entire vote of the divi
sions above referred to. lfelcctlons are to be "free
and equal," and citixend are desirous of having
ther votes made effectual, the only way is to
boia the citizen and the election oincers to a
strict performance of their several duties. Mis
takes and irregularities will even then happen.
As such, they can be corrected, but when there
Is an almost total disregard of tbe election laws
by tbe officers, aud a denial on the part of ono
laf-s of voter ncninst their opponents, the time
bas come to say that, it such are the facts esta
blished, tiieir ballots shall not count.

following was done in the Legislature:
In tbe Senate a resolution was adopted autho
rlzlng tho Speakers of both houses to draw on
the Philadelphia City Treasurer for witness
fees, etc., in the Thayer Greenbank contest.
The Philadelphia Registry law passed finally, as
did also the General Registry law. and also the
act authorizing United mates commissioners in
Philadelphia to administer oaths and affirma
tions and to tako depositions to be used in any

In the House no action was taken on the
report ot the Ways aud Means Committee, pro
viding for final adjournment on April 9. The
Metropolitan Police bill was reported ou favor
ably by the Committee on Municipal Corpora
tions. Tho filtceuth amendment was passed to

Tbe Pennsylvania delegation, condstiug of
ticorge 11. stuart, vvunam welsh, and oiners,
called upon the President yesterday, at noon.

policy of the Government. The delegation was
formally introduced to tho Prosideut bv Mr.
Btuart, after which Mr. Welsh stated the object
oftbevixlt. He submitted a proposition mat
the President should appoint a commission of
five or seven gentlemen, to give their services
gratuitously to the Government, and who shall
act with the Secretary ot the Interior in the
management ot Indian affairs.
The President and Secretary ol the Interior,
who were present, expressed themselves satis-
fled with tbe proposition, and the President
intimated that he proposed to make a radical
chaime in the iDdlan nulicv of the Government.
