I need not wurn you against tho danger of being influenced by prejudice. You know by every day's experience how men's minds are warped and wronged ly it. We want yon to try this case as did the Creeks of old blind to everything else than the case before you. On this Sunday night, when the ministers of God were performing their sacred ollices throughout this broad community, this pour, dei'euctiebs old woman was brutally murdered. Thus tar wo agree with the commonwealth Our law, and that of the whole civi lized world, requires that the uHsasNiu should bo spcedfly and surely punished; and wesupuoil that law. but the law of Pennsylvania does not ask the blood of a inno cent man; no man shall sutler until his guilt lias been proven most conclusively. 1 may here guy that this case is purely und solely circumstantial, and wo will argue that It is most .uncertain, unreliable and decep tive, citing case alter case where many au innocent man has beeu tacrillced by it. We are to guard strictly against such a sacritlce in this caw. As part of our dofouco we will show you tlio prisoner's excellent character. I know that in a conclusive case, where no doubt of guilt is left, it is nf no weight; but in a mere circumstantial case, n full of doubt as this, it is all powerful for tlio salvation of the prisoner. We will show you that all through his life he has beeu found to be a man of such moral character as to render him incapable of such u crime. We will show you that he could have had no motive fur such a murder, which the commonwealth has failed to show. 'i'hey say it is a monstrous crime, but do not show a motive for it. We will piove that when old Mr. Hill died he left a will boiiucalhing to his wife, the mur dered lady, a life estate in all bis property, remainder to his heirs; so that nothing could ever have gone to Mrs. Twitched, her daughter. We will show by record that Mrs. Hill gave to tier daughter the house at Tenth and Pine streets, in which they lived. Hlie wished to give all she had to her only child. They were on the most amicable terms, and there was nothing to mar the barmonv of thcirfntercourso. In regard to those dogs, of which to much bus been said, we will satisfy you that it was the habit to keep them looked up at ulglit, aa they were on this night. Also, that the door leading from the room in which the murder was committed to the entry was closed; so that Mr. and Mrs. Twitchell, who were in their bed asleep, could not have heard the noise. Boyce was a prominent membjr of Conuicss from (South Carolina lor seven or eight jrars immediately preceding the war, und was one of that body of fierce f-ecessloulsts who scouted the idea of waiting for the co-operation ci otber States, and insisted that South Carolina should go out alone. Withal, he has been held by his leilow-Rebcla a man of more than ave rage ability and in fluence. We hail, therefore, his words ot advice to the Carolinians, printed elsewhere, as among the most cheering signs of a return of common Bense to tho nxc-cating politicians. The following Is the article referred to: The lion. William W. Boyce, or South Caro lina, prefaces a letter to the (Southerners with the remark that the election of General Grant is a protest agali st political assassinations in the South, and adds that President Grant will un doubtedly, If necessary, employ the whole military power to establish equal rights through out tbe Uuited States. Mr. Uoyce next recom mends a policy for the South, as follows: First. You ought to regulate the relations between the whites and the blacks so a-i to have as much harmony and good feeliug as possible between them. To this end nothing is so efficacious as kindness to the bl ick9. Second. You ought to have perfect tolerance of political opinion. Let every one, white and black, vote as he ph ases, and trust to your tact and natural influence for a just share ol pohtioal power. Third. You ought to extend a cordial and kind welcome to the Northern people to eetllcaaiong you, without regard t) their political opinions. Once you did this, the troubles of tho future would be largely overcome, and your material progress would 6e wonderful. See what immi gration is doing for the Northwest, in spite of its austere climate. Think what immigration would do for the genial South. Fourth. You ought to feek to conciliate the Federal Government. Remember the Scripture injunction: "Agree with thine adversary quickly." The Federal Government for the present, and lor years to come, means the Republican party. Do not wage a frantic war agoinfit this party. Remember that the Demo cratic party is not strong enough now to be of any service to you. Be calm and conciliatory, and wait the course ot events. It would be fortunate it you were in that independent condition that both parties North would bid for yoursuppoit. Filth. General Grant will, I think, earnestly desire to make bis administration national, and restore real peace and harmony to the late belligerent sections. AJmoderate conservative course ou the part of the South will facilitate his policy in this direction. Sixth. In conclusion, the thing you want is peace. To get peace, you must procure it by peaceful means. Let the Republicans and De mocrats North wage a bitter war auainst each other if they choose; your condition calls lor more resene.
