onel William H. Piichartt baa commenced a
it against Captain Bart Able, United States
Collector, for the amount ot his income tax,
(iosed upon his profit for the year 1866.
The suit involves the broad question of the
MBStitntionality of the income tax, and as such
tMH be viewed with interest throughout the
Union. If we mistake not, it Is the first instance
in which the constitutionality of the tax has
keen contested, although it is well known that
some of the most diHtinguished Jurists in the
ountry have questioned the authority of Con
gress to lay the tax. We understand that the

member of the U. B. Senate:

upon the subject of tbe. proposed location of tbe
United States Navyardat League Island. I
bave been Informed, and I believe. League
island has been wholly reclaimed troin tne
river Delaware, and is only prevented from
overflow by large banks of stone and earth. It
la snnounded, except upon one side, by a marsh,
and lor this cause, as well as from Insalubrity,
It bas been unimproved and unoccupied, except
as pasture land, at a moderate rent, since lta
reclamation. Tbe fust land la from six to eigbt
feet below bigh-water mark at all points, and
-would cost over a million dollars to level aud
fit for use as mucb as will be required for the
large purposes projected.
If the object Is to erect foundries, tbe spongy-
natwre of the soil would make It ImDossible to
get a proper foundation for tbe buildings except
at a great cost, nor could a well of sufficient,
sieptn oe uug lor large castings, it coma not
cost less than two or tbree million dollars In
bip-bouses, dry-docks, and other slruolures
now in the old yard, which would bave to be

reside in Kensington, nearly eight miles dis

the supply stores of the city. Tue approaches
are as low as the Island itself, and unfit for
